House Election Law
Summary:
The House Election Law Committee held an orientation and then opened a public hearing on House Bill 67-FN-A, which would make permanent the use of accessible voting machines in local elections and provide funding for additional systems. The chair outlined committee procedures, noting a heavy workload of roughly 70 to 80 bills, mostly Tuesday meetings, likely time limits on testimony, and a default of executive session unless a bill is specifically noticed. Members and staff were introduced, and the Secretary of State’s office described its election-related responsibilities, including voter registration, cybersecurity, ballot-counting equipment, and the Help America Vote Act (HAVA) program.
Secretary of State David Scanlan and Deputy Secretary Aon Hennessy explained the current pilot program created by last year’s law, which requires accessible voting systems for local elections and allows the state to share machines with municipalities during the first half of 2025. They said the office has made hardware available, but towns have raised concerns about the speed of implementation and the cost of programming each election, especially for towns with multiple ballot questions. Scanlan said the state is also vetting longer-term options, including devices that could remain in polling places year-round, and suggested the committee consider delaying the bill’s effective date to January 1, 2026 to better align with implementation needs. Hennessy said the current state devices are older and complicated to reset for each election, and estimated programming costs could be about $600 for a small single-election ballot and much higher for towns with multiple elections.
Supporters of the bill emphasized the importance of accessible voting for people with disabilities. Representative Robert Wy said the measure builds on 2024 law and would move the pilot into a permanent agreement, citing ADA concerns and prior testimony about discriminatory voting experiences. Fred Forier, a legally blind voter from Exeter, testified that accessible voting systems allow him to vote privately and independently and urged support for the bill. Committee members asked about the gap if the pilot ends before a permanent system is in place and about the cost range for programming. No vote was taken during the hearing, and the committee moved on after public testimony began.

Summary:
The House convened with a quorum, the flags were escorted by the Nisei Veterans Committee Color Guard, the Pledge of Allegiance was led by Scout Alexander Bertelsen, and Reverend Masao Umoto delivered the invocation. The House then approved the previous day’s minutes and took up House Resolution 4692, recognizing the 84th anniversary of Executive Order 9066 and honoring Japanese Americans who were forcibly relocated and incarcerated during World War II. The resolution recounted the history of the incarceration, the service of Japanese American veterans, the findings of the 1982 commission that the policy was driven by racial prejudice and war hysteria, and the later federal apology and reparations. The resolution was adopted by voice vote, and guests connected to the Japanese American community and remembrance observances were recognized.
Several members spoke in support of the resolution, emphasizing the constitutional failures of the wartime incarceration, the importance of remembrance, and the need to guard against fear-driven violations of civil liberties. Remarks also highlighted personal family histories, the experiences of camps such as Manzanar and Camp Harmony, and the service of the 442nd Regimental Combat Team and other Japanese American units. After adoption, the House agreed to spread Representative Stonier’s remarks upon the journal.
The House then considered a motion to re-refer Engrossed Second Substitute Senate Bill 536 to the Community Safety Committee instead of the Environment and Energy Committee. Representative Abbarno argued the bill dealt primarily with criminal penalties and prosecutorial authority, while Representative Fitzgibbon opposed the change, saying the bill’s predominant subject matter remained environmental. The amendment failed on a voice vote. The House then adopted the motion to read and refer the day’s introductions to the designated committees, with SB 6066 sent to Transportation. Finally, the House returned HB 1065, HJM 1412, and ESHB 1819 to the Rules Committee, announced caucuses, and adjourned until 9:55 a.m. Friday, February 20.

Summary:
The House opened with a series of ceremonial recognitions, including Bernalillo County Day, Pecos Elementary, Las Vegas, New Mexico Highlands University, the New Mexico International School, and the Sun Country golf organizations. Members and guests offered brief remarks praising county staff, educators, university programs, and local public service, and several caucus and committee announcements were made. The House also received a gubernatorial message authorizing consideration of House Bill 303, which was then removed from Rules, ordered printed, and referred to the House Commerce and Economic Development Committee.
The chamber then adopted a long slate of committee reports, moving multiple bills and memorials forward, including House Bills 294, 298, 38, 127, 151, 165, 47, 63, 64, 184, 200, 309, 311, 329, 310, and memorials 20 and 51. Most reports were adopted without objection, and several measures were advanced with committee substitutes or amended versions. The House then proceeded to third reading on selected bills.
On final passage, House Bill 128 passed 61-1. The bill updates presumptive workers’ compensation coverage for full-time firefighters with occupational cancers and other illnesses, and debate focused on the exclusion of volunteer firefighters, the evidentiary burden for exposure claims, and whether the bill should be expanded later. House Bill 109, dealing with the Water Project Fund and allowing the New Mexico Finance Authority to award funds without legislative authorization through December 2029, passed 61-0. House Bill 158, requiring accountability and evaluation plans for agencies receiving growth funds, passed 63-0. House Bill 49, increasing the penalty for serious violent felons who possess firearms or destructive devices to a second-degree felony, was debated extensively over sentencing discretion and the distinction between serious violent and nonviolent felons; the transcript cuts off before the final vote on that bill.
