Summary:
The subcommittee met with a quorum, approved the minutes, and welcomed new members before taking up Council on Postsecondary Education regulations 13 KAR 2:120 and 13 KAR 2:130. The regulations, as amended by staff and agency amendments, update public university and KCTCS performance funding models to conform to 2024 Senate Bill 191 and the performance funding work group’s recommendations. Changes discussed included replacing the underrepresented minority metric with an underrepresented students metric defined as first-generation students, adding an adult learner metric, increasing the low-income degree premium, adjusting small-school and nonresident credit-hour weights, revising data aging and progression metrics, and adding STEM+H criteria in 13 KAR 2:120.
Travis Pal of the Council on Postsecondary Education explained that the changes reflect the work group’s three-year review process and that the work group ultimately voted to define underrepresented students as first-generation students and to apply half-weighting between research and comprehensive universities for the new metric. Michael Frasier of the Kentucky Student Rights Coalition and Eastern Kentucky University student government opposed 13 KAR 2:120, arguing that the regulation improperly applies weights where the statute does not clearly authorize them and that the funding changes disadvantage comprehensive universities and vulnerable students. He asked the committee to find the regulation deficient or, alternatively, recommend legislative clarification and a revised fiscal analysis. Pal responded that weighting has been part of the model since 2017, that CPE was following the statute and work group recommendations, and that the model could be changed by future legislation.
Members asked about the timing of the broader performance funding review, and Pal said the full model is reviewed every three years, with the next work group cycle beginning in 2026. No motion to find the regulation deficient was made, and the committee allowed the regulations to proceed to the committee of jurisdiction. The committee then approved a staff amendment to Teachers’ Retirement System regulations 102 KAR 1:195 and 102 KAR 1:340, which require annual reporting of accumulated sick leave, leave policies, and salary schedules to TRS and make technical changes to the final average salary calculation and related definitions.

Summary:
The House Administration Committee met to consider a series of resolutions and bills covering arts districts, child care background checks, federal worker relief, health care reform, court transparency, school tax reassessment, municipal charter changes, constitutional amendment procedures, data center nondisclosure agreements, state employee benefits governance, and lieutenant governor vacancies. Members also noted that House Concurrent Resolution 12 had been removed from the agenda and that public comment would be limited to one minute per speaker.
The committee released SCR 167 to study arts, culture, and creative districts in Delaware; HB 438 to close a loophole in the child care service letter requirement; SB 268 to provide interest-free loans, free transit, and tax deferrals for federal workers during shutdowns; SS2 for SB 1 to expand and permanently strengthen primary care investment while also addressing hospital cost growth; HCR 147 to request a Court of Chancery report on audio recordings and automated case assignment; SB 322 to replace the current post-reassessment 10% school revenue increase authority with a 2% annual increase option under safeguards; SB 306 to amend the Rehoboth Beach charter; HB 440 to require voter approval for constitutional amendments after legislative approval; SB 312 to bar nondisclosure agreements for large data center projects; SS1 for SB 289 to change State Employee Benefits Committee governance; and SB 264 to require a special election to fill a lieutenant governor vacancy.
Testimony was mixed on several measures. Arts, child care, federal worker relief, primary care, court transparency, data center transparency, and the lieutenant governor vacancy bill drew mostly supportive testimony, while SB 322 and SB 306 drew both support and opposition, especially over tax impacts and the proposed spouse/partner restriction in Rehoboth Beach. HB 440 prompted debate over whether 55% voter approval was the right threshold for constitutional amendments, and SB 312 was supported as a transparency measure by residents affected by prior data center NDAs. All of the listed measures were released from committee by roll call vote, with some members voting no on HB 440, SB 306, SB 312, SS1 for SB 289, and SB 264.

Summary:
The House opened with a series of ceremonial recognitions, including Bernalillo County Day, Pecos Elementary, Las Vegas, New Mexico Highlands University, the New Mexico International School, and the Sun Country golf organizations. Members and guests offered brief remarks praising county staff, educators, university programs, and local public service, and several caucus and committee announcements were made. The House also received a gubernatorial message authorizing consideration of House Bill 303, which was then removed from Rules, ordered printed, and referred to the House Commerce and Economic Development Committee.
The chamber then adopted a long slate of committee reports, moving multiple bills and memorials forward, including House Bills 294, 298, 38, 127, 151, 165, 47, 63, 64, 184, 200, 309, 311, 329, 310, and memorials 20 and 51. Most reports were adopted without objection, and several measures were advanced with committee substitutes or amended versions. The House then proceeded to third reading on selected bills.
On final passage, House Bill 128 passed 61-1. The bill updates presumptive workers’ compensation coverage for full-time firefighters with occupational cancers and other illnesses, and debate focused on the exclusion of volunteer firefighters, the evidentiary burden for exposure claims, and whether the bill should be expanded later. House Bill 109, dealing with the Water Project Fund and allowing the New Mexico Finance Authority to award funds without legislative authorization through December 2029, passed 61-0. House Bill 158, requiring accountability and evaluation plans for agencies receiving growth funds, passed 63-0. House Bill 49, increasing the penalty for serious violent felons who possess firearms or destructive devices to a second-degree felony, was debated extensively over sentencing discretion and the distinction between serious violent and nonviolent felons; the transcript cuts off before the final vote on that bill.
