Barnhart said he understood Quack could make that decision and that the Commonwealth did not have input so long as the network was maintained, but he was not involved at the time. A legislator then read from the KCNA statute and argued that the board, not agency staff, is supposed to direct KCNA contracts and operations, saying House Bill 314 did not change those duties. The chair agreed the committee’s intent was for the board to control KCNA and direct contracts, and the discussion ended with a transition away from the KCNA dispute toward future testimony, including a presentation from Zayo Networks on open access networks and broadband infrastructure.
