Summary:
The Assembly Budget Subcommittee on water and coastal resilience heard an overview of the governor’s Proposition 4 spending plan, with presentations from the Department of Finance, the State Water Resources Control Board, the Department of Water Resources, the Legislative Analyst’s Office, and later coastal agencies. Members discussed the water chapter’s major allocations for drinking water and wastewater, recycled water, tribal water infrastructure, groundwater recharge and SGMA implementation, dam safety, flood protection, integrated regional water management, Salton Sea projects, and water data/stream gauges. The LAO noted that many programs are established and have clear funding processes, but some newer or less-defined programs may warrant more detailed future budget requests and reporting. No votes were taken on the agenda items.
Members raised concerns about groundwater subsidence, water deliveries from the Delta, the pace of water storage investments, instream flows, and whether bond dollars were being used to backfill General Fund reductions. Administration witnesses said groundwater recharge spending is being paced because prior years already funded substantial SGMA work, that Delta operations are governed by water quality, salinity, and species requirements, and that Proposition 1 storage projects have moved slowly because they are locally led and require permitting and financing. The Water Board and DWR said they use public needs assessments, annual plans, and existing grant processes to prioritize projects, and Finance said some General Fund programs were shifted to Proposition 4 to help balance the budget. Members also asked for clearer public tracking of bond spending and more concise future reporting.
In the coastal resilience portion, the Ocean Protection Council and Coastal Conservancy described Proposition 4 funding for sea level rise adaptation, coastal flood management, habitat restoration, public access, and San Francisco Bay projects, with a multi-year rollout based on project readiness and recent large state investments. The Conservancy said it would use its existing rolling grant process, while OPC said its sea level rise grants would build on existing programs and new technical assistance. The Department of Fish and Wildlife explained its proposed use of bond funds for climate-ready fisheries, hatchery modernization, salmon monitoring, whale- and turtle-safe fishing gear, and a specific hatchery operations request tied to the Friant settlement. The LAO said the coastal chapter’s proposed first-year spending is relatively modest but generally reasonable given staffing and project readiness, while members emphasized oversight, transparency, and coordination across agencies and jurisdictions.

Summary:
The committee heard testimony on a non-germane amendment to HB 297 that would create the Granite State Home Mitigation and Resiliency Program. Insurance Commissioner DJ Beton, joined by department staff, explained that the proposal is intended to help homeowners afford insurance by funding proactive home improvements that reduce risk and improve insurability. He cited similar programs in other states, especially Alabama, Louisiana, and North Carolina, as evidence the model can work and noted that industry representatives were present in support. He also said the program would use means testing aligned with the Department of Energy’s weatherization program to target lower-income applicants.
Members asked about the non-germane process, who would administer the program, and how the bill would prevent misuse of grant funds. The commissioner said the department would administer the program using one repurposed existing position, with Treasury handling fund flow through an MOU. Staff explained that applicants would have to show completed work through a signed contract, itemized work, and a sworn contractor affidavit, with some upfront payment allowed for materials and the remainder paid after completion. The chair and members discussed that the amendment is being attached to a different bill only to move the proposal through committee and on to House Finance for further consideration.

Summary:
The committee first approved the May 5 minutes and then heard House Bill 578, which would define sex in Louisiana law as biological sex, replace references to gender with sex in various statutes and forms, and direct the Law Institute to make conforming changes. Supporters from the governor’s office said the bill would bring clarity and consistency, while opponents argued it could create conflicts with existing law and weaken protections tied to gender identity. After debate, the committee reported HB 578 favorably.
Members then considered House Bill 1250, a measure aimed at aerospace-related litigation. The bill would allow a special motion to strike certain claims against aerospace flight entities when the claims are preempted by federal law. Senators raised concerns that the language was broad enough to affect airports, airlines, contractors, and even unrelated incidents, and the author said he was willing to work on narrowing amendments. The committee nevertheless reported HB 1250 favorably. House Bill 718, dealing with liability protections for private airstrips used for recreation, was amended to narrow its scope and then reported favorably, while House Bill 163, a narrower related airstrip bill, was voluntarily deferred so the committee could work from the other measure.
The committee also approved House Concurrent Resolution 61, which asks the Louisiana Law Institute to review possible conflicts between the constitution and statutes on expropriation. House Bill 180, defining foreign adversaries and agents of foreign adversaries for a proposed constitutional amendment, and House Bill 192, a constitutional amendment barring foreign adversaries from expropriating land in Louisiana, were both reported favorably. House Bill 1008, which sets out academic freedom and whistleblower protections for higher education, was rejected on a roll-call vote after concerns about its scope and limits on university discipline. House Bill 638, a prompt-payment bill for contractors, was set aside while amendments were being located.
Finally, the committee took up House Bill 71, which would extend existing liability protections for justified use of force to properly trained armed security guards. The author and the Board of Private Security Examiners said security officers receive training and often face dangerous situations, but opponents argued the bill would give too much protection to personnel with far less training than law enforcement and could shield bad shootings. After debate, the committee voted to defer HB 71. The last measure discussed was House Bill 1082, which would change venue rules for lawsuits involving the Municipal Police Employees’ Retirement System so actions by the system would be filed where the employer is located; the author said the bill was meant to help small municipalities, and members indicated they were open to narrowing amendments.
