Criminal procedure: mental capacity; outpatient treatment for misdemeanor offenders with mental health issues; provide for. Amends 1974 PA 258 (MCL 330.1001 - 330.2106) by adding sec. 1021 & ch. 10A. TIE BAR WITH: SB 219'25

Summary

SB 221 would amend Michigan’s Mental Health Code to create a new process allowing certain defendants charged with misdemeanor offenses to be diverted from criminal prosecution into assisted outpatient treatment. The bill adds a new chapter establishing how a court-ordered assessment may be requested by the prosecutor, the defendant, or defense counsel, and how a psychiatrist or other qualified mental health professional would evaluate whether the defendant meets the criteria for diversion. If the defendant qualifies and there is no objection at the hearing, the court may enter an assisted outpatient treatment order instead of proceeding immediately through the ordinary criminal process. The bill sets the treatment order at up to 180 days and provides that if the defendant does not comply, existing civil commitment/treatment procedures under the Mental Health Code would apply. It also keeps the misdemeanor charge pending for a limited period while the person is in treatment, but requires dismissal after 90 days in most cases, or 180 days for a serious misdemeanor. The bill separates treatment compliance from criminal release conditions, limits bond conditions during the diversion period, and requires the treatment provider to notify the relevant courts and prosecutor when treatment ends.

Impact

SB 221 would add a new diversion pathway in the Mental Health Code for misdemeanor defendants with mental health needs, shifting some cases from the criminal system into assisted outpatient treatment and involving both district and probate courts in the process. It would also carve these diverted cases out of existing provisions in sections 1022 to 1044, create new procedures for assessment, petitioning, and court orders, and tie noncompliance to civil treatment enforcement rather than immediate criminal sanctions. The bill would affect prosecutors, defense counsel, district courts, probate courts, treatment providers, and misdemeanor defendants, especially those whose offenses are linked to mental illness.

Sentiment

The available voting history suggests strong support for the bill. It was reported favorably out of committee without amendment and then passed the Senate unanimously, 37-0. That pattern indicates broad agreement with the bill’s overall approach of using treatment-oriented diversion for misdemeanor offenders with mental health issues.

Contention

The main points of potential contention built into the bill are procedural and discretionary rather than ideological. The bill allows either side to oppose the initial motion for assessment, and if there is an objection at the hearing on the petition for assisted outpatient treatment, the diversion petition must be dismissed and the case proceeds under the ordinary competency provisions. Another possible concern is the balance between public safety and treatment: the bill limits bond conditions, keeps charges pending for a period, and uses civil enforcement for treatment noncompliance, which may raise questions for prosecutors or victims’ rights advocates about accountability. The bill also applies only to misdemeanor offenses and is tied to enactment of SB 219, making it dependent on related legislation.
