Caption

An Act to Provide for a 5-year Automatic Repeal of Agency Rules

Summary

LD 490 would amend the Maine Administrative Procedure Act to create a “sunset” system for agency rules. Under the bill, any rule finally adopted or finally amended on or after January 1, 2026 would automatically repeal five years after its final adoption date, unless the rule is renewed through a legislative process. The bill also applies to rules adopted before that date if they are later amended after January 1, 2026. The bill establishes a renewal process for agencies that want a rule to remain in effect beyond the five-year period. An agency may submit a request to the Legislature between two and one years before the repeal date, and the request must explain the basis for renewal and include a cost-benefit analysis. The relevant legislative committee would review the request and may recommend legislation to renew the rule for another period of up to five years. The Secretary of State would also be required to notify the agency at least 18 months before a rule’s automatic repeal date.

Impact

If enacted, LD 490 would significantly change how Maine administrative rules are maintained by adding an automatic expiration date to most new or newly amended agency rules. It would affect state agencies, the Secretary of State, the Legislature, and regulated parties by requiring periodic review and renewal of rules, and it would likely increase legislative oversight of administrative rulemaking. The bill does not repeal existing rules outright, but it would place future rules under a recurring sunset framework and allow the Legislature to renew or let them expire.

Sentiment

No committee transcripts or recorded votes were provided, so there is no direct evidence of support or opposition from hearings or floor action. Based on the bill’s structure, it appears to reflect a reform-oriented approach favoring periodic review, accountability, and legislative control over agency regulations. The absence of recorded debate makes the overall sentiment difficult to gauge beyond the bill’s apparent policy intent.

Contention

The main point of contention is likely to be whether automatic repeal of agency rules improves accountability or instead creates instability and administrative burden. Supporters would likely favor the bill for forcing regular review of regulations and requiring agencies to justify continued rules with cost-benefit analysis. Opponents would likely argue that a five-year sunset could disrupt long-term regulatory programs, create uncertainty for businesses and the public, and increase workload for agencies, committees, and the Legislature. The renewal process and the level of legislative involvement are likely to be the most debated features.
