Howard County Board of Education - Student Member - Voting Ho. Co. 7-26

Summary

HB1171 changes the voting authority of the student member on the Howard County Board of Education. Under current law, the student member may vote on most board matters but is excluded from a list of specified topics. This bill narrows and reorganizes those exclusions, updating the categories of matters on which the student member may not vote. As amended, the student member remains able to vote on board business generally, but is barred from voting on matters involving the appointment and salary of the county superintendent, employee discipline and appeals, appointment and promotion of staff, discipline of certificated staff, and collective bargaining for both certificated and noncertificated employees. The bill also preserves the exclusion for student suspension and expulsion, while removing several older exclusions from the statute, including those related to geographical attendance areas, school construction and property matters, donations, condemnation, consolidation and transportation, and budgetary matters. The act takes effect July 1, 2026.

Impact

The bill amends Section 3-701(f)(7) of the Education Article, which governs the Howard County Board of Education’s student member. It changes state law by revising the list of board actions from which the student member is excluded, thereby altering the scope of the student member’s voting rights on local school board matters in Howard County. The practical effect is to modernize and narrow the statutory exceptions, while leaving the student member’s general voting role intact.

Sentiment

The bill appears to have been broadly supported. It received a favorable committee report, passed the House by a wide margin, and passed the Senate unanimously. The voting history suggests little opposition and a consensus that the changes were acceptable or routine.

Contention

No committee testimony is provided, and the recorded votes show limited controversy. The main policy issue is the extent of a student board member’s participation in sensitive governance matters. The exclusions that remain focus on personnel, labor relations, and disciplinary decisions, indicating concern that the student member should not vote on issues involving confidential employment matters or collective bargaining. The bill also removes several older exclusions, suggesting some interest in expanding student participation in board governance while preserving limits on core administrative and labor issues.
