Unlawful surveillance. Adds a prohibition against using a tracking device to the list of conditions a court may impose when issuing a protection order. Increases the penalty for stalking to a Level 5 felony if the offense is committed by means of a tracking device. Provides that a person who knowingly or intentionally places a tracking device on an individual or the individual's property without the individual's knowledge or consent commits unlawful surveillance, a Class A misdemeanor, unless certain exceptions apply, and increases the penalty to a Level 6 felony if the person is the subject of a protective order or has certain prior convictions. Establishes a sentence enhancement if a person uses a tracking device to commit or facilitate the commission of a crime.

1977 fund membership. Modifies the definition of "salary of a first class patrolman or first class firefighter" for the 1977 police officers' and firefighters' pension and disability fund (1977 fund). Allows an airport authority to participate in the 1977 fund. Increases the maximum age for a firefighter to be appointed to a fire department and become a member of the 1977 fund from 35 years of age to 39 years of age. Makes corresponding changes.

Prohibits a person from carrying a firearm in or near: (1) a chute; (2) polls; (3) certain areas where voters congregate or are likely to congregate; or (4) any room where ballots are being counted. Provides that the offense is a Class C misdemeanor. Enhances the offense to a: (1) Class A misdemeanor if the person has a prior unrelated conviction for the offense; or (2) Level 6 felony if the firearm is pointed at another person. Specifies: (1) a defense; and (2) certain notice requirements. Prohibits other defenses. Defines particular terms. Makes conforming amendments.

Tuition caps. Provides that the commission for higher education shall determine a tuition rate and mandatory fee cost of living adjustment for specified postsecondary educational institutions. Requires that, except for cost of living adjustments, the tuition rate and mandatory fees at specified postsecondary educational institutions may not increase from the time the student initially enrolls until the student graduates for an undergraduate student who is an Indiana resident.

Requires the driver education advisory board to consult with the commissioner of the bureau of motor vehicles (commissioner) and the state police department, and advise the commissioner in the administration of the policies of the commission and the bureau regarding driver education in: (1) the procedures of a law enforcement officer during a traffic stop; and (2) the actions a person should take during a traffic stop, including appropriate interaction with a law enforcement officer. Requires the bureau of motor vehicles to include in any driver education manual published by the bureau the following: (1) A description of the procedures of a law enforcement officer during a traffic stop. (2) An explanation of the actions a person should take during a traffic stop, including appropriate interaction with a law enforcement officer. Provides that driver education curriculum must include instruction about actions to take during a traffic stop, and the appropriate interaction with a law enforcement officer during a traffic stop.

Provides the following: (1) Not later than October 1, 2023, each public elementary school and state accredited nonpublic elementary school shall provide to the department of education (department) information regarding whether the school provides instruction on cursive writing to students and, if cursive writing instruction is provided, the grade level of students to whom the instruction is provided. (2) Not later than December 1, 2023, the department shall prepare a report regarding the information and submit the report to the legislative council.

Cigarette tax evasion. Provides that if a person unlawfully transports cigarettes without an Indiana tax stamp, the person commits: (1) a Class C infraction if a person possesses more than 1,000 cigarettes; (2) a Class B misdemeanor if the number of cigarettes is between 2,000 and 7,500; (3) a Class A misdemeanor if the number of cigarettes is between 7,500 and 15,000; and (4) a Level 6 felony if the number of cigarettes is at least 15,000.

Property tax relief. Permits counties, cities, and towns (including Marion County) to establish a neighborhood enhancement property tax relief program (program) to provide an assessed value deduction for longtime owner-occupants of homesteads having an assessed value of not more than $200,000 in certain designated areas. Authorizes the redevelopment commission (or the metropolitan development commission in the case of Marion County) to identify the areas for purposes of the program based on specified conditions. Requires the county auditor to notify each owner of property that qualifies for a deduction under a program and provide the owner with an application for the deduction. Requires an owner of property that qualifies for a deduction to apply to the county auditor to receive the deduction. Provides a penalty for wrongly receiving the deduction that is the same as the penalty for wrongly receiving the homestead standard deduction.
