Marion County fairgrounds noise mitigation. Requires installation of industry standard noise barriers at the Marion County fairgrounds in connection with automotive races or events.

Private card games. Defines "private low stakes card game" and provides a defense to certain gambling crimes if the gambling was a private low stakes card game. Makes conforming amendments.

Tobacco products tax. Provides that a tax is imposed on the distribution of cigars at a rate of 24% of the wholesale price of a cigar for cigars having a wholesale price not exceeding $3. Provides that a tax is imposed on the distribution of cigars at a rate of $0.72 per cigar for cigars having a wholesale price exceeding $3 per cigar.

Equal educational opportunity. Extends certain antidiscrimination educational rights statutes to prohibit discrimination based on sexual orientation and gender identity.

Study of deferred retirement option plan. Urges the legislative council to assign to the pension management oversight study committee during the 2023 interim the task of studying whether to extend the maximum time frame to remain in the deferred retirement option plan from three years to five years for a member of the state excise police, gaming agent, gaming control officer, and conservation enforcement officers' retirement plan, 1925 fund, 1937 fund, 1953 fund, or 1977 fund.

Right-of-way and thoroughfares. Requires a county to use eminent domain to increase the apparent right-of-way for a county highway, instead of by requiring dedication of additional right-of-way as part of a subdivision plat. Requires a county, city, or town (unit) to use eminent domain to establish or expand a thoroughfare, instead of by requiring dedication of private property as part of a subdivision plat. Prohibits a unit that must proceed with eminent domain regarding a right-of-way or thoroughfare from imposing an additional fee on an applicant for filing a subdivision plat.

Allocation of wastewater utility costs. Allows a utility company that: (1) provides both water and wastewater service; and (2) has acquired wastewater utility property; to request, in the context of a petition by the utility company to the Indiana utility regulatory commission (IURC) for preapproval of a plan for proposed service enhancement improvements to the utility company's wastewater utility property, authorization from the IURC to allocate a portion of the eligible costs of the utility company's wastewater utility property to the utility company's water customers. Provides that if the petition includes such a request for an allocation of costs, the utility company shall provide a copy of: (1) the petition; and (2) the utility company's case in chief; to each intervenor in the utility company's last general rate case. Provides that the IURC may approve the request if the IURC finds that: (1) because of reasonable and necessary improvements that are proposed for the wastewater utility property, the resulting rates charged to wastewater customers would reach levels necessitating the provision of financial assistance to those customers; (2) the total rates charged by the utility company for water service will not increase unreasonably as a result of the allocation; (3) the utility company has included information in its proposal regarding the availability of grants or low interest loans and whether the utility company considered using grants or low interest loans to help finance or reduce the cost of the service enhancement improvements; and (4) the utility company has developed an asset management program. Provides that an increase in the total rates charged for water service by the utility company as a result of the allocation is not unreasonable to the extent the allocation results in an increase in authorized total revenues of 2% or less. Provides that if the IURC approves a utility company's request for an allocation of costs, the utility company shall include a notice on or with water customer monthly bills specifying the amount of the service enhancement improvement adjustment rider approved by the commission that recovers necessary wastewater utility improvements.

Welding certifications on public works projects. Requires that contractors on a public works project meet certain standards relating to the welding of structural steel.

Redistricting commission. Establishes a redistricting commission (commission) to create, hold hearings on, take public comment about, and recommend plans to redraw general assembly districts and congressional districts. Provides for appointment of four commission members by the legislative leadership. Establishes the redistricting commission nominating committee (committee) to receive applications from and evaluate applicants to fill the five remaining positions on the commission. Provides for selection of those five commission members from pools of applicants selected by the committee. Requires the legislative services agency (agency) to provide staff and administrative services to the commission. Establishes standards to govern the commission and the agency in the creation of redistricting plans. Provides that the general assembly must meet and enact redistricting plans before October 1 of a redistricting year. Authorizes the general assembly to convene in a session to act on redistricting bills at times other than the times the general assembly is currently authorized to meet. Repeals the current law establishing a redistricting commission for congressional redistricting.

Preschool and child care facility drinking water. Requires the public finance director to prepare an annual report to the general assembly that provides information on the programs of the Indiana finance authority under which the drinking water in schools, preschools, and child care facilities is tested for the presence of lead. Requires the owner or operator having authority over a child care facility or a preschool to test the drinking water in the child care facility or preschool before January 1, 2026, unless the drinking water in the child care facility or preschool has already been tested through a lead sampling program conducted by the Indiana finance authority. Provides that if the testing of the drinking water in a child care facility or preschool indicates that the presence of lead in the drinking water equals or exceeds the action level for lead (15 parts per billion), the owner or operator of the child care facility or preschool shall take action to: (1) eliminate the source of the lead in the drinking water; or (2) install a water filtration system. Establishes requirements applying to a water filtration system installed in a child care facility or preschool. Requires the environmental rules board to adopt rules, including emergency rules, that conform with the Lead and Copper Rule Improvements proposed rule that is being developed by the U.S. Environmental Protection Agency.

Elimination of credit time. Provides that a habitual violent offender is not entitled to good time credit.

Minimum wage. Amends the definition of "employee" for the purposes of the minimum wage statute. Increases the minimum wage paid to certain employees in Indiana as follows: (1) After June 30, 2024, from $7.25 an hour to $9.02 an hour. (2) After December 31, 2024, from $9.02 an hour to $10.07 an hour. (3) After December 31, 2025, from $10.07 an hour to $11.11 an hour. (4) After December 31, 2026, from $11.11 an hour to $12.10 an hour. Provides that after December 31, 2027, and each subsequent December 31, the hourly minimum wage increases at the same percentage as any increase in the Consumer Price Index for the preceding calendar year. Increases the cash wage paid to tipped employees as follows: (1) After June 30, 2024, from $2.13 an hour to $3.30 an hour. (2) After December 31, 2024, from $3.30 an hour to $4.71 an hour. (3) After December 31, 2025, from $4.71 an hour to $6.12 an hour. (4) After December 31, 2026, from $6.12 an hour to $7.54 an hour. Provides that after December 31, 2027, and continuing for each subsequent December 31, the cash wage required to be paid to employees is equal to 70% of the hourly minimum wage. Provides that, if the federal minimum wage or cash wage is higher than the state minimum wage or cash wage, employers are required to pay the higher federal rate.

School board candidate filing deadline. Changes the time frame that a candidate for a school board office is required to file the candidate's petition of nomination. Modifies deadlines concerning a statement questioning the validity of a petition of nomination or contesting the denial of certification.
