Minimum wage. Makes changes to the definition of "employee" for the purposes of the minimum wage statute. Increases the minimum wage paid to certain employees in Indiana as follows: (1) After June 30, 2023, from $7.25 an hour to $9.02 an hour. (2) After December 31, 2023, from $9.02 an hour to $10.07 an hour. (3) After December 31, 2024, from $10.07 an hour to $11.11 an hour. (4) After December 31, 2025, from $11.11 an hour to $12.10 an hour. Provides that after December 31, 2026, and each subsequent December 31, the hourly minimum wage increases at the same percentage as any increase in the Consumer Price Index for the preceding calendar year. Increases the cash wage paid to tipped employees as follows: (1) After June 30, 2023, from $2.13 an hour to $3.30 an hour. (2) After December 31, 2023, from $3.30 an hour to $4.71 an hour. (3) After December 31, 2024, from $4.71 an hour to $6.12 an hour. (4) After December 31, 2025, from $6.12 an hour to $7.54 an hour. Provides that after December 31, 2026, and continuing for each subsequent December 31, the cash wage required to be paid to employees is equal to 70% of the hourly minimum wage. Provides that, if the federal minimum wage or cash wage is higher than the state minimum wage or cash wage, employers are required to pay the higher federal rate. Makes technical corrections and corresponding changes.

Preschool and child care facility drinking water. Requires the person or entity having authority over a child care facility or preschool to test the drinking water in the child care facility or preschool before January 1, 2025, to determine whether lead is present in the drinking water in a concentration equal to or exceeding 15 parts per billion. Excepts a child care facility or preschool from this testing requirement if its drinking water: (1) was tested through the Lead Sampling Program for Schools and Child Care Facilities conducted by the Indiana finance authority in 2019 and 2020; or (2) has otherwise been tested for lead at least once after 2017. Provides that, if testing indicates that lead in the drinking water of a child care facility or preschool equals or exceeds 15 parts per billion, the person or entity having authority over the child care facility or preschool is required to take action to reduce the concentration of lead to below 15 parts per billion.

College savings tax credit. Provides that "qualified higher education expense" includes qualified education loan repayments under Section 529(c)(9) of the Internal Revenue Code.

Licensing of independent electrical contractors. Establishes the Indiana commission on independent electrical contractors (commission). Specifies various forms of electrical work that are not subject to regulation by the commission. Provides for the issuance of a statewide license for independent electrical contractors. Specifies duties and privileges associated with holding a statewide license. Specifies powers and duties of political subdivisions with respect to the statewide license. Provides that the penalty imposed upon a political subdivision that fails to recognize and honor a statewide license is the intercept of part of the local income taxes that would be distributed to the political subdivision.

Bail. Defines "charitable bail organization" and allows a charitable organization to pay bail on behalf of specified defendants if the organization meets certain criteria and is certified by the commissioner of the department of insurance (commissioner). Specifies the circumstances under which a certification may be revoked, and exempts from the certification requirement a person that pays bail for: (1) not more than three individuals in any 180 day period; or (2) a relative. Requires the commissioner to adopt rules, including emergency rules, for the certification of charitable bail organizations. Prohibits the state and a political subdivision from: (1) posting bail for any person; or (2) for the purpose of posting bail for any person, providing a grant or other funding, directly or indirectly, to an entity that posts bail for any person. Requires a person paying cash bail, including a charitable bail organization, to execute an agreement allowing the court to retain all or part of the bail to pay certain court costs. Requires that bail be returned to the person who posted it. Provides that a case management system developed and operated by the office of judicial administration must include a searchable field for certain information of the bail agent or a person authorized by the surety that pays bail for an individual.

Interactive gaming. Authorizes the following persons to conduct interactive gaming: (1) A licensed owner of a riverboat. (2) An operating agent operating a riverboat in a historic hotel district. (3) A permit holder conducting gambling games at the permit holder's racetrack. Provides for the licensure of persons providing services and equipment for managing and conducting interactive gaming. Specifies requirements for the conduct of interactive gaming. Imposes an adjusted gross receipts tax of 18% on interactive gaming. Provides for revenue sharing to cities and counties in which casinos are operated. Makes an appropriation. Makes conforming and technical changes.

Vehicle Bill. None

Accelerated depreciation. Couples Indiana depreciation provisions with federal depreciation provisions under Section 179 of the Internal Revenue Code.

Ownership of Kankakee Meanderlands. Requires the department of natural resources to offer to grant and convey by deed to an eligible property owner not more than four acres of the property along the Kankakee River known as the Kankakee Meanderlands Wetland Conservation Area that abuts the private property of the eligible property owner. Defines "eligible property owner".

Bail. Prohibits a court from requiring an arrestee to pay bail as a condition of pretrial release, unless: (1) the court finds by clear and convincing evidence that the arrestee is a flight risk or danger to the community; (2) the arrestee is charged with murder or treason; (3) the arrestee is on pretrial release not related to the incident that is the basis for the present arrest; or (4) the arrestee is on probation, parole, or other community supervision. Requires that the amount of bail be the lowest amount required, based on the defendant's financial circumstances, to assure the arrestee's appearance at trial and to protect the community.

A CONCURRENT RESOLUTION terminating the public health emergency first declared on March 6, 2020, in Executive Order 20-02.

Regulation of hospitals and nursing homes. Repeals provisions that allow a county or city hospital to withhold from disclosure the individual salaries of hospital employees. Sets forth financial reporting requirements for hospitals concerning revenue generated from the ownership, operation, or management of a nursing facility. Requires the state department of health to: (1) jointly with the office of the secretary of family and social services, develop and finalize before July 1, 2024, quality metrics to improve clinical, administrative, and quality of life care for health facility residents; and (2) post on the state department's Internet web site certain information concerning a health facility's inspection reports, survey reports, and ownership information. Requires a health facility to disclose a description of the services provided by the facility and the rates charged for the services to prospective residents. Requires a health facility to: (1) post personnel and licensure classification information for on duty personnel; (2) retain personnel and licensure information for employees for public inspection; and (3) maintain a record of every inspection report and final citation issued to the health facility for public inspection. Prohibits a health facility from taking retaliatory action against an employee because the employee: (1) discloses or threatens to disclose actions or practices implemented by the health facility that the employee reasonably believes is in violation of federal or state law, rule, or regulation; (2) provides information or testifies in investigations or hearings; or (3) assists or participates in proceedings to enforce state law. Provides for relief to the employee.

Deduction for AmeriCorps education awards. Allows an individual who receives a Segal AmeriCorps Education Award during a taxable year to deduct the amount of the Segal AmeriCorps Education Award from the individual's adjusted gross income.

Dental hygienists. Provides that a dental hygienist may administer an immunization that is recommended by the federal Centers for Disease Control and Prevention Advisory Committee on Immunization Practices for individuals who are not less than 11 years of age on the order of a dentist or other health care provider qualified to order the immunization, if the dental hygienist: (1) is certified in cardiopulmonary resuscitation; (2) has successfully completed a course of training in immunization that meets specified requirements; and (3) administers the immunization in accordance with a protocol that includes specified requirements and procedures. Prescribes reporting requirements for a dental hygienist who administers an immunization. Provides that a dental hygienist: (1) is not required to administer immunizations; and (2) is not required to complete immunization training if the dental hygienist chooses not to administer immunizations.

Virtual student instructional days. Establishes: (1) a definition for "virtual student instructional day"; and (2) requirements for virtual student instructional days. Provides that a public school may conduct not more than three virtual student instructional days that do not meet the established requirements. Provides that a public school that does not comply with these provisions may not count a student instructional day towards the 180 day student instructional day requirement. Allows the department of education to waive these requirements.
