Illinois House Bill HB4012

Amends the Video Gaming Act. Prohibits a home rule unit of local government with a population of over 1,000,000 from enforcing any local ordinance passed prior to the effective date of the amendatory Act prohibiting the operation of video gaming terminals within the corporate limits of the municipality. Removes a provision allowing for the use of a game device without a license if the game device is used in an activity that is not gambling under the Criminal Code of 2012. Prohibits a home rule unit of government with a population of over 1,000,000 from imposing any fee for the operation of a video gaming terminal in excess of $250 per year. Amends the Criminal Code of 2012. Changes the definition of "gambling device" to include any vending or other electronic machine or device, including, without limitation, a machine or device that awards credits and contains a circuit, meter, or switch capable of removing and recording the removal of credits that offers a person entry into any contest, competition, sweepstakes, scheme, plan, or other selection process that involves or is dependent upon an element of chance for which the person may receive a gift, award, or other item or service of value if that offer is incidental to or results from: (A) the purchase of an item or service of value; or (B) the purchase or gratuitous receipt of a coupon, voucher, certificate, or other similar credit that can be redeemed for or applied towards an item or service of value from such machine or device or elsewhere. Provides that participants in a game of skill or chance where money or other things of value can be won but no payment or purchase is required to participate shall not be convicted of gambling except where participation in such game of skill or chance is accomplished using a gambling device prohibited by these changes to the definition. Provides that a gambling offense involving such a gambling device is a Class 4 felony. Effective immediately.

Amends the Code of Civil Procedure. Provides that each of the following is void and unenforceable if it allows the application of Shari'a or any foreign law, legal code, or system that denies the parties the fundamental liberties, rights, and privileges guaranteed under the United States Constitution or the Illinois Constitution: (1) a ruling or decision of any state court, arbitration panel, tribunal, or administrative agency that is based, in whole or in part, on Shari'a or any foreign law, legal code, or system; (2) a contract, or contractual provision if severable, that provides for the choice of Shari'a or any foreign law, legal code, or system; or (3) a contract, or contractual provision if severable, that grants jurisdiction to a foreign tribunal if a ruling, decision, or provision allows the application of Shari'a or any foreign law, legal code, or system that denies the parties the fundamental liberties, rights, and privileges guaranteed under the United States Constitution or the Illinois Constitution. Sets forth exceptions. Prohibits a court, arbitration panel, tribunal, or administrative agency from transferring any civil action if the transfer would result in the application of Shari'a or any foreign law, legal code, or system that would violate or likely violate the fundamental liberties, rights, and privileges of the parties guaranteed under the United States Constitution or the Illinois Constitution.

Reinserts the provisions of the introduced bill with the following change. Provides that the itemized statement of all purchases made using the credit card in the preceding month that the townships, park districts, municipalities, school districts, and community colleges must vote to verify may not be redacted in a manner inconsistent with the Freedom of Information Act (rather than may not be redacted). Removes provisions requiring townships, park districts, municipalities, school districts, and community colleges to post itemized statements of their credit card purchases on their websites.

Amends the Fire Protection District Act. Provides that the board of trustees of a fire protection district may, by majority vote of the board of trustees, adopt a resolution to transfer moneys from the fire protection district's ambulance service fund to another fund controlled by the fire protection district if (1) the fire protection district has not approved another transfer from the fire protection district's ambulance service fund under the provisions in the same year; (2) the moneys remaining in the fire protection district's ambulance service fund after the transfer are sufficient to pay for the remaining obligations and costs payable from the district's ambulance service fund in the current and subsequent fiscal years; and (3) the transfer does not impair the fire protection district's finances or public safety mission, including, but not limited to, emergency medical services, ambulance services, rescue services, fire suppression services, or any other public safety endeavor established by the fire protection district. Effective immediately.

Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Provides that the amendatory Act may be referred to as the Pension Equity Act. Provides that, beginning on January 1, 2027, for all purposes under the Code (including, without limitation, the calculation of benefits and employee contributions), the annual earnings of a Tier 2 sheriff's law enforcement employee shall not include overtime and shall not exceed $145,649.97 (instead of $108,600, as adjusted annually beginning in 2011) plus the lesser of (i) 3% of that amount or (ii) the annual unadjusted percentage increase (instead of one-half the annual unadjusted percentage increase) in the consumer price index-u for the 12 months ending with September 2026. Provides that, beginning on January 1, 2028, that amount shall annually thereafter be increased by the lesser of (i) 3% of that amount, including all previous adjustments, or (ii) the annual unadjusted percentage increase (instead of one-half the annual percentage increase) in the consumer price index-u for the 12 months ending with the September preceding each November 1, including all previous adjustments. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Provides that the amendatory Act may be referred to as the Pension Equity Act. Provides that the changes shall not result in any retroactive adjustment of any employee contributions. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the Unified Code of Corrections. Restores the general recidivism provisions of the Code before the effective date of Public Act 101-652. Provides that the third-time offender provisions resulting in a sentence of natural life imprisonment apply when the defendant has attained the age of 18 at the time of the third offense (rather than 21 years of age or older when the first offense was committed). In the provision that when a defendant, over the age of 21 years, is convicted of a Class 1 or Class 2 forcible felony after having twice been convicted in any state or federal court of an offense that contains the same elements as an offense now (the date the Class 1 or Class 2 forcible felony was committed) classified in Illinois as a Class 2 or greater Class forcible felony and those charges are separately brought and tried and arise out of different series of acts, that defendant shall be sentenced as a Class X offender, provides that the 3 offenses may be felonies rather than forcible felonies. Provides that the Class X sentencing provision does not apply to Class 1 or Class 2 felony convictions for theft.

Amends the Illinois Vehicle Code. Changes the model year and registration date requirements for a Special Hauling Vehicle with regard to its allowable combined weight and axle weight to the model year of 2034 (rather than 2024) and registration date of January 1, 2035 (rather than January 1, 2025). Changes the criteria regarding weight limitations for tow trucks and vehicle combinations during towing operations. Provides that specified criteria regarding weight limitations do not apply to a covered heavy duty tow and recovery vehicle. Provides that clearing a vehicle does not include towing the vehicle from the scene of disablement. Provides that any person, firm, or corporation that violates a provision regarding restricted rights to use highways shall be fined $150 (rather than $75) per every 500 pounds or fraction thereof for any excessive weight. Provides that any excess size or weight movement conducted under a person that does not meet certain requirements shall be void and the movement unpermitted. Makes other changes.

Amends the Firearm Concealed Carry Act. Prohibits an employer from discharging, disciplining, penalizing, discriminating against, or refusing to hire an employee or applicant solely on the basis that the employee or applicant exercised his or her right under the Act to lawfully store a concealed firearm in the employee's vehicle in the employer's parking lot. Provides that an employer, its officers, employees, and agents are immune from civil liability for any claim arising out of, or in any way related to, the mere presence of a lawfully stored firearm in an employee's vehicle in the employer's parking lot, including, but not limited to, claims for damages resulting from theft, discharge, or misuse of the firearm by a third party, unless the claim is based on the employer's own willful or wanton misconduct or gross negligence independent of the lawful storage protected by the Act. Allows a person aggrieved by a violation of these provisions to bring a civil action in circuit court within 2 years after the date of the alleged violation. Describes the relief that is available in such an action.

Amends the Illinois State Police Act. Creates a registry of persistent domestic violence offenders within the Illinois State Police. Provides that the Illinois State Police shall maintain the registry based upon information supplied to the Illinois State Police by court clerks and information available to the Illinois State Police from the Department of Corrections and local law enforcement agencies. Provides that the Illinois State Police shall make the registry available for public inquiry on the Internet. Provides that the registry must consist of the persistent domestic violence offender's name, date of birth, conviction date, county of convictions, and a current photograph of the persistent domestic violence offender. Provides that, if a person is convicted of an offense committed against a domestic abuse victim and the person convicted has at least one prior conviction for an offense committed against a domestic abuse victim, then the court shall, upon proof of any prior convictions committed against a domestic abuse victim, order the person to register as a persistent domestic violence offender. Provides that a defendant who is required to register must be assessed a registration fee in the amount of $150. Provides that the Illinois State Police shall remove from the registry the name and other identifying information of a persistent domestic violence offender after a specified number of years following the defendant's most recent conviction.

Provides that the Act may be referred to as Trey's Law. Creates the Invalidity of Certain Nondisclosure Clauses Act. Provides that a nondisclosure clause in a settlement agreement is void and unenforceable as against the public policy of this State to the extent that the nondisclosure clause prohibits an individual from disclosing to any other individual or entity or reporting to law enforcement an act of sexual abuse or facts related to an act of sexual abuse that was committed or allegedly committed against the individual before the individual attained 18 years of age. Provides that nothing in the Act may be construed to prohibit an individual from agreeing to keep confidential any other provision of a settlement agreement, including the amount or payment terms of a settlement. Applies to any settlement agreement entered into before, on, or after the effective date of this Act.
