Amends the Illinois Power of Attorney Act. Provides that a power of attorney not otherwise invalidated or revoked is suspended on the appointment of the Office of State Guardian or public guardian as a temporary, limited, or plenary guardian of the principal. Provides that after the appointment the court may revoke a power of attorney only if the named agent or successor agent under the power of attorney received notice of a petition for guardianship of the principal in accordance with the Probate Act of 1975, and that the agent failed to assert authority as agent before appointment of the Office of State Guardian or public guardian. Provides that if an agent or successor agent under a power of attorney does not receive notice of the petition for guardianship of the principal or an individual does not know that the individual was named as an agent or successor agent under a power of attorney for the principal, that agent, successor agent, or individual may petition the court presiding over the guardianship to lift the suspension of the agency upon a showing by clear and convincing evidence that it is in the principal's best interests to reinstate the agency so that the agent, successor agent, or individual may act in accordance with the terms of the agency. Provides that notice of a petition to lift the suspension of the agency and a copy of the petition shall be given to the guardian, the person with a disability, to those persons whose names and addresses are listed in the petition for guardianship under the Probate Act of 1975, and any guardian ad litem not less than 14 days before the hearing.

Amends the Digital Library Protection Act. Provides that no publisher shall enter into a contract or license agreement to distribute electronic literary materials to a library that: (1) restricts the library from performing customary operational functions; (2) restricts the library from performing customary lending functions; (3) restricts the library from disclosing the terms of the contract or license agreement to any other library in the State; or (4) requires the library to violate the Library Records Confidentiality Act. Provides that a violation of the Act constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Provides that any contract to license electronic literary materials to a library that includes a provision prohibited under the Act is deemed unenforceable and void. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change. Effective immediately.

Amends the State Finance Act. Creates the Municipal Water Infrastructure Sustainability Fund. Provides that moneys in the Fund shall be used by the Environmental Protection Agency to provide dedicated, ongoing financial support to water and wastewater systems owned by municipalities to allow the water and wastewater systems to make capital repairs, upgrades, and improvements with the goal of preserving public ownership of the water and wastewater systems and preventing forced privatization due to unaffordable infrastructure costs.

Amends the Illinois Procurement Code. Provides that, for contracts, goods, and services procured by the Department of Transportation, no business shall be a small business, regardless of type, if (i) its annual sales for its most recently completed fiscal year exceed the small business size standard for its specific industry, as established by the U.S. Small Business Administration, or (ii) it employs more individuals than the number set forth in the small business size standard for its specific industry, as established by the U.S. Small Business Administration, whichever is applicable.

Amends the Illinois Vehicle Code. Provides that for the purpose of providing the Secretary of State with records necessary to impose a revocation, upon filing with the clerk of court, the clerk shall forward in a manner and form prescribed by the Secretary (i) a copy of a Uniform Citation and Complaint where the officer indicated a crash type of fatal, (ii) a copy of information or an indictment in which a person is charged with a violation of the Code that resulted in the death of another person, or (iii) a copy of information or an indictment in which a person is charged with reckless homicide. Allows the Secretary to adopt rules to implement the provisions. Provides that the Act may be referred to as the Protz-Liddy Act. Effective January 1, 2027.

Reinserts the provisions of the introduced bill with the following changes. Provides that all fees received pursuant to contracts or agreements (rather than contracts only) entered into by IEMA-OHS shall be set apart in a special fund to be known as the Low-Level Radioactive Waste Facility Operation Fund (rather than the Radioactive Waste Site Perpetual Care Fund). Provides that all payments received by IEMA-OHS (formerly the Department of Nuclear Safety) pursuant to the settlement agreement entered May 25, 1988, in the matter of the People of the Illinois, et al. v. Teledyne, Inc., et al. (No. 78 MR 25, Circuit Court, Bureau County, Illinois) shall be held in the Sheffield February 1982 Agreed Order Fund by the State Treasurer separate and apart from all public moneys or funds of the State, and shall only be used as provided in such settlement agreement. Provides that interest earned by investment of moneys accumulated in the Sheffield February 1982 Agreed Order Fund shall be deposited into the Sheffield February 1982 Agreed Order Fund (rather than the Radioactive Waste Site Perpetual Care Fund) for the continued maintenance of the Sheffield Low-Level Radioactive Waste Site and surrounding buffer zone to protect the public health and safety on a continuing and perpetual basis. Effective immediately.

Amends the Public Funds Investment Act. Provides that a public agency may invest any public funds in any security that matures or that may be tendered for purchase at the option of the holder within not more than 7 years of the date on which it is acquired and that has the highest rating category (AAA) assigned by Standard & Poor's corporation, Moody's investors service, or other similar nationally recognized statistical rating organization. Effective immediately.

Amends the Illinois Pesticide Act. Provides that, beginning January 1, 2029, it is unlawful for any person to sell, offer for sale, use, or distribute within this State any corn, soybean, or wheat seed coated or treated with a pesticide containing neonicotinoids, unless a valid waiver is issued by the Department of Agriculture. Lists requirements for the waiver. Directs the Department of Agriculture to adopt rules and annually report to the General Assembly regarding the waivers. Provides for civil penalties for violations (but not other penalties under the Act). Directs the Department of Natural Resources and the Department of Agriculture, in consultation with the University of Illinois, to conduct a study regarding alternatives to the use of pesticides containing specified ingredients to be submitted on or before January 1, 2029.

Amends the Illinois Prescribed Burning Act. Requires the Department of Natural Resources, after consulting with the Illinois Prescribed Fire Council and the Department of Insurance, to adopt rules establishing a Prescribed Burn Liability Claims Pilot Program for the purpose of providing, for a period of 6 years after the effective date of the amendatory Act, coverage for losses incurred by eligible persons as a result of prescribed burns conducted in accordance with the Act by certified prescribed burn managers. Sets forth programmatic requirements for the pilot program. Creates the Prescribed Burn Liability Claims Fund. Allows the Department to impose and collect specified premiums and fees to implement and administer the Act and to maintain the solvency of the Fund. Provides that moneys in the Fund shall be expended by the Department for purposes of the Prescribed Burn Liability Claims Pilot Program and its administration and for no other purpose. Allows the Department to contract with any entity to serve as the third-party administrator of the program and to assist in administering the Fund. Provides that the provisions of the amendatory Act shall not be construed to limit the liability of a person who is enrolled in the pilot program for damages in excess of the cap established by the Department by rule. Further provides that the provisions of the amendatory Act shall not be construed to impose liability on the State for any payment of any claim beyond the amount of moneys available in the Fund. Requires the Department to adopt rules. Defines terms. Amends the State Finance Act to make a conforming change. Effective immediately.

Amends the Notice by Publication Act. Provides that when any notice is required by law, court order, or by any contract, to be published in a newspaper, it is considered to be in compliance with the publication requirements if published in an online news media or digital news media platform as long as the media or platform serves the locale in which the notice is required to be published. "Online news media" or "digital news platform" means any website or digital platform that is regularly updated with content at least 5 days per week, has maintained this frequency of publication for no less than one year, and serves the geographic area relevant to the notice. Provides that the provision applies to all notices required to be published on or after the effective date of the amendatory Act.

Amends the Code of Criminal Procedure of 1963. Provides that if the court orders an unfit defendant to be placed in the custody of the Department of Human Services, during the period of time required to determine bed and placement availability at the designated facility, the defendant may (rather than shall) remain in jail. Amends the Juvenile Court Act of 1987. Provides that, in proceedings under the Minors Requiring Authoritative Intervention, Addicted Minors, or Delinquent Minors Article, initiated in a county, other than the county in which the minor who is subject of the proceedings resides, the court in which the proceedings were initiated may at any time before or after adjudication of wardship transfer the case to the county of the minor's residence. Provides that not later than 15 working days after the date an order of transfer is entered, the clerk of the court transferring a proceeding shall send to the clerk of the receiving court in the county to which the transfer is being made an authenticated copy of the court record, including all documents, petitions, and orders filed therein, and the minute orders and docket entries of the court. Provides that the clerk of the receiving court shall set a status hearing within 10 business days after receipt of the case and shall notify the judge of the receiving court and all parties. Provides that the receiving court shall review the court record immediately upon receipt. Provides that within 20 business days after receipt of the record, the reviewing court shall send a notice to the transferring court indicating it has accepted the case and scheduled a status date. Provides that until the transferring court receives this notice it continues to have jurisdiction over the case. Provides that if for any reason the receiving court does not accept the transfer, the receiving court shall, within 20 business days after receiving the case, send a notice to the transferring court indicating its reasons. Provides that the transferring court will continue its jurisdiction of the case and shall set the matter for status within 20 business days. Effective immediately.

Provides that a State agency may exercise, without prior procurement compliance monitor review, administrative actions that are specifically provided for in a contract that has been entered into in accordance with this Code. Removes provisions that provide that each State purchasing officer owes a fiduciary duty to the State.
