VEH CD-CDL DRIVER SCHOOL

Summary

HB3608 amends the Illinois Vehicle Code to tighten regulation of commercial driver training schools and other entities that provide entry-level driver training or commercial driving curriculum. The bill makes clear that a person or business may not operate a commercial driver training school, or provide CDL-related instruction such as skills, road, or pre-trip training, unless licensed by the Secretary of State. It also preserves several exemptions, including public schools, certain educational institutions, large employers training their own employees, enhanced-driving-skills schools, and driver rehabilitation programs. The bill adds a new oversight mechanism requiring the Secretary of State to review, on a quarterly basis, the federal FMCSA Training Provider Registry and compare it with Illinois-licensed commercial driving schools. If an entity appears on the federal registry but is not in good standing as a licensed Illinois school, the Secretary must notify it to cease operations, report the issue to the federal agency, and publicly post the entity on the Secretary’s website. If the violation continues for more than 12 weeks, the entity becomes subject to penalties under the new enforcement section.

Impact

HB3608 would expand and clarify state licensing requirements for commercial driver training providers, especially those involved in CDL and entry-level driver training. It creates new state enforcement tools, including civil penalties of up to $50,000 per violation plus up to $10,000 per day for continuing violations, and authorizes injunction actions by the Secretary of State, the Attorney General, or a county State’s Attorney. Collected penalties would be deposited into the Motor Carrier Safety Inspection Fund, and the bill would also align state oversight more closely with federal FMCSA training-provider requirements.

Sentiment

No committee transcript or recorded vote information is provided, so there is no documented legislative debate to gauge support or opposition. Based on the text alone, the bill appears to be framed as a safety and compliance measure aimed at preventing unlicensed commercial driver training operations and improving oversight of CDL training providers. The absence of recorded discussion means the overall sentiment cannot be measured from the available materials.

Contention

The main potential point of contention is the bill’s regulatory and enforcement burden on commercial driver training schools and related training providers, particularly the new civil penalties, public posting of alleged violators, and the requirement to stop operations if not in good standing with Illinois licensure. Another possible issue is the interaction between state licensing rules and federal training registry status, which could raise concerns for providers operating across jurisdictions. The bill’s exemptions may also be relevant if stakeholders argue that certain training entities should be treated differently or that the scope of covered instruction is too broad.
