POTAWATOMI LAND TASK FORCE

Summary

HB3546 creates the Potawatomi Land Transfer Task Force Act. The bill establishes a 40-member task force, appointed by the Director of Natural Resources, to address the transfer of land in DeKalb County—specifically Shabbona Lake and State Park lands—to the Prairie Band Potawatomi Tribe under Senate Bill 867 of the 103rd General Assembly. The task force’s purpose is to identify the agreements and protections needed to ensure that Illinois residents living on the affected land continue to receive services and that their rights are protected as the land becomes a Native American reservation. The task force must include representatives from the tribe, state legislators for the district, DeKalb County and Shabbona-area local governments, public safety agencies, utilities, schools, health providers, transportation, environmental and other local institutions. The Department of Natural Resources must provide administrative support. By December 31, 2030, the task force must submit a comprehensive report to the tribe and the Department, including recommended provisions for a land management agreement under the State Parks Act. The bill also conditions the land transfer on completion of that report and adoption of the recommendations by both the tribe and the State of Illinois, and it dissolves the task force once the transfer is completed or if the transfer is rescinded or overturned.

Impact

The bill would create a new statutory task force and impose a procedural condition on the land transfer authorized in Senate Bill 867. It does not itself transfer land, but it effectively delays completion of the transfer until the task force finishes its work and the parties adopt a land management agreement. It also directs the Department of Natural Resources to administer the task force and ties the transfer to the State Parks Act framework, affecting state management of park property and the legal process for conveying state-owned land to the Prairie Band Potawatomi Tribe.

Sentiment

No committee transcripts or recorded votes were provided, so there is no direct evidence of formal support or opposition in the available materials. Based on the bill text, the measure appears intended as a protective and transitional framework rather than a direct land conveyance, suggesting a cautious, process-oriented approach. Its emphasis on preserving services for local residents indicates an effort to address concerns that may arise from the transfer.

Contention

The main point of contention is likely the underlying land transfer itself and how it affects Illinois residents, local governments, and service providers in the Shabbona area. The bill reflects concern that converting the land into a Native American reservation could disrupt public services, infrastructure, and local governance, so it requires broad representation from county, township, municipal, emergency, utility, school, health, and other local entities. Another likely issue is the condition that the transfer cannot proceed until both the tribe and the state adopt the task force’s recommendations, which could be viewed either as necessary protection for residents or as an added hurdle to the transfer.
