INTERGOVERMENTAL AGREEMENTS

Summary

HB2588 amends the State Comptroller Act to expand and clarify the Comptroller’s authority to offset amounts owed to certain public entities against payments otherwise due to a person from the State treasury or other funds held by the State Treasurer. In addition to existing offsets for the State, the federal government, local governments, school districts, public institutions of higher education, and circuit court clerks, the bill adds public agencies or associations created under the Intergovernmental Cooperation Act, including intergovernmental risk management associations and self-insurance pools. The bill also authorizes the Comptroller to enter into intergovernmental agreements with these newly added entities to establish procedures for offsetting debts, and it requires a written agreement or court order when such an entity requests a deduction. It preserves the existing 25% cap on deductions from wage, salary, contractual personal-services payments, and pension annuity payments, and it retains exemptions for certain payments such as small claims under $50, senior citizens and persons with disabilities property tax relief payments, prepaid tuition trust fund payments (except for child support), and most child support trust fund disbursements. The act takes effect immediately upon becoming law.

Impact

HB2588 would amend Section 10.05 of the State Comptroller Act, broadening the list of entities that can participate in state payment offsets and clarifying how those offsets may be administered. It would affect the Comptroller’s warrant-deduction and payment-offset procedures, and it would create a statutory basis for intergovernmental agencies and associations to recover debts through offsets, subject to agreement or court order and existing payment-protection limits.

Sentiment

The available voting history suggests the bill had generally favorable support in the House, passing a motion 68-29 on April 10, 2025. No committee transcripts are available, so there is no recorded debate to indicate detailed support or opposition arguments. The vote margin indicates meaningful support, but not unanimity, suggesting some concern about the scope of offset authority or the entities newly included.

Contention

The main point of contention appears to be the expansion of offset authority to public agencies or associations organized under intergovernmental agreements, including risk management associations and self-insurance pools. Supporters likely view this as a practical debt-collection tool for public entities, while opponents may be concerned about giving additional governmental bodies access to deductions from state payments and the potential impact on payees. The bill’s continued limits on deductions and its requirement for a written agreement or court order for these new entities appear designed to address those concerns.
