Idaho 2026 Regular Session

Idaho House Bill H0769

Introduced
2/25/26

Caption

MOTOR VEHICLE FINANCIAL RESPONSIBILITY – Adds to existing law to establish provisions regarding appraisals by competent and disinterested appraisers and to establish a dispute resolution process.

Summary

House Bill 769 would require every automobile insurance policy issued, renewed, executed, or delivered in Idaho to include an appraisal process when the policyholder and insurer disagree about the actual cash value or amount of a loss, including repairable loss amounts and total-loss amounts, or about the settlement offer on a third-party liability claim. Either side could invoke the appraisal process by written demand, and each party would select a competent and disinterested appraiser. The bill sets deadlines for selecting appraisers, completing appraisals, and, if necessary, moving to a further dispute-resolution step with a mutually selected umpire. If the two appraisers cannot agree, either party may trigger the umpire process. The umpire would review the parties’ documentation and issue an award selecting one of the appraisals, and that award would become the controlling amount for the claim. The bill also authorizes the Idaho Department of Insurance to adopt rules to implement the new section, and it makes an insurer’s failure to follow the required procedures a violation of Idaho’s insurance code. The act is declared an emergency and would take effect July 1, 2026.

Impact

The bill would add a new section to Chapter 12, Title 49, Idaho Code, creating a mandatory appraisal-and-umpire framework in automobile insurance policies and tying noncompliance to enforcement under chapter 13, title 41, Idaho Code. It would affect auto insurers licensed in Idaho, policyholders, and third-party liability claimants by establishing a formal method to resolve valuation disputes over vehicle damage, total loss values, and settlement offers. The Department of Insurance would gain rulemaking authority to administer the process.

Sentiment

No committee transcript or vote record was provided, so there is no direct evidence of debate or recorded support/opposition in the materials supplied. Based on the bill text, the measure appears designed to standardize claim valuation disputes and may be viewed as consumer-protection oriented while also giving insurers a defined process for resolving disagreements. The emergency clause suggests the sponsor considered the issue timely and important.

Contention

The main likely points of contention are the mandatory nature of the appraisal provision, the costs each party must bear for its own appraiser, and whether the process could speed up claims or instead add another layer of procedure. Insurers may be concerned about added compliance obligations and potential disputes over third-party settlement offers, while policyholders may focus on whether the process provides a fair and accessible way to challenge insurer valuations. The bill also leaves implementation details to the Department of Insurance, which could become a point of interest for stakeholders.
