Family Empowerment Scholarship Program

Summary

S0508 amends Florida’s Family Empowerment Scholarship Program to add new disclosure and service-notice requirements for participating private schools. Before a student’s initial enrollment, a private school must provide parents written information about the school’s academic programs and policies, specialized services, code of conduct, attendance policies, and the therapies or services it offers. The bill also requires schools to update information about specialized services and therapies at least once per school year, or sooner if the school district updates its list of equitable services. For students with an individualized education plan, education plan, English language learner plan, or 504 plan, the bill requires the parent to be informed within 30 days after the district provides a private school services plan about which modifications, accommodations, and therapies in the student’s plan will be honored before enrollment. The parent and school are then to discuss which programs and services may meet the student’s needs. If a private school fails to meet these requirements, the commissioner may deem the school ineligible to participate in the scholarship program.

Impact

The bill amends section 1002.394, Florida Statutes, governing private school participation in the Family Empowerment Scholarship Program. It imposes new pre-enrollment notice obligations and service-disclosure duties on participating private schools, particularly for students with IEPs, ELL plans, or 504 plans, and gives the commissioner authority to remove noncompliant schools from the program. The practical effect is to strengthen transparency and parent information before scholarship students enroll, while increasing compliance responsibilities for private schools that accept scholarship students.

Sentiment

The bill appears to have broad support in the Senate, passing its committees unanimously and clearing the Senate floor 37-1. That voting pattern suggests general agreement with the goal of improving parent notice and clarifying what services scholarship students can expect at participating private schools. The lack of recorded committee testimony limits insight into detailed debate, but the overwhelming votes indicate the measure was viewed favorably overall.

Contention

The main point of potential contention is the added regulatory burden on private schools participating in the scholarship program, especially the requirement to specify in writing which accommodations, modifications, and therapies will be honored for students with special plans. Supporters likely view these requirements as necessary consumer protections and transparency measures for families, while any opposition would likely center on administrative complexity, compliance costs, and the possibility that schools could lose eligibility for failing to meet the new standards. The near-unanimous committee votes suggest any such concerns were limited or outweighed by support for the bill’s student- and parent-focused protections.
