This House Resolution recognizes May 10, 2023 as Major George S. Welch Day in the State of Delaware.

This Concurrent Resolution commends the 2023 Delaware State Teacher of the Year, Ashley Lockwood, and all of the District Teachers of the Year.

This Senate Concurrent Resolution proclaims May 2023 "Cystic Fibrosis Awareness Month" in the State of Delaware.

This Act requires all candidates for statewide office, the General Assembly, and all elected county offices, to request a criminal history background check, no later than the filing deadline, from the State Bureau of Identification. The State Bureau of Identification must, within 10 days of receipt of the request, provide the Commissioner of Elections with a report of the candidates criminal history or a statement that the Bureaus Repository contains no information relating to the candidate. The Commissioner of Elections must then determine if the candidate is qualified under Section 21 of Article II of the Delaware Constitution to be considered a candidate and have their name appear on the ballot. The candidate will be considered a provisional candidate until the Commissioner of Elections determines the candidate is qualified. The information obtained by the Commissioner of Elections, from the Bureau, will not fall under the definition of public record in Chapter 100 of Title 29. The candidate must pay the cost of the criminal history background check, but the cost may be reimbursed from the candidates campaign funds as an authorized campaign expenditure. This Act will take effect January 1 after enactment.

This substitute bill provides more clarity on the process by which a tenant may file an action in the Justice of the Peace Court to withhold rent payments in escrow. Specifically, the bill provides what the tenant must file in order to bring such action and how such actions proceed in court. This substitute bill also provides the remedy of termination of lease when the conditions of the rental unit threatens the life, health, or safety of the tenant or a member of the tenants household. This substitute bill also clarifies the appeal process for actions to withhold rent payments in escrow. This substitute bill also provides a tenant the right to raise as an affirmative defense to an action for summary possession filed by the landlord that a condition exists that threatens the life, health, or safety of the tenant or a member of the tenants household if the tenant satisfies specific requirements. If the Court determines that the tenant has satisfied those requirements, the Court may order that in lieu of summary possession, the tenant pay all base monthly rent owed to the landlord to an escrow account established by the Court. The Court may order the landlord to remedy the conditions alleged by a specific date. If both the landlord and tenant comply with the Courts order, the amount held in escrow will be paid to the landlord within 30 days, and no judgment for possession shall be entered. Finally, this substitute bill provides that the Act will take effect 180 days after its enactment into law in order to provide the Justice of the Peace Court sufficient time to enact rules to implement the Act.

This Act requires that parents and other persons under investigation for child abuse and neglect be given written and oral notice of the allegations made against them; the right to consult counsel prior to speaking with a DSCYF investigator; the right to refuse entry to the DSCYF investigator; the right to withhold consent to medical examinations of the children; the right to refuse to submit to a drug test; and the right to consult legal counsel prior to signing a safety plan.

This Act is a comprehensive amendment of the Town Charter for the Town of Clayton. It sets forth detailed basis for removal from office of Mayor and Town Council and process for filling any vacancies on Town Council. The Amendment allows the Mayor and members of Town Council to participate and vote in Council meetings by remote electronic means, when unavoidable circumstances prohibit in person attendance, so long as all members can hear and speak with one another. The Act allows the Town to borrow up to an amount not to exceed 20% of the assessed value of assessable and taxable real property within the Town limits. The Act also allows the Town to purchase general obligation bonds not to exceed 20% of the assessed value of all real estate subject to taxation within the Town. The Act establishes the Towns power to regulate orderly growth and development including subdivisions and site plans and procedures for securing financial guarantees to ensure satisfactory completion of new land development. The Act also allows the Town to adopt the assessment of Kent County in lieu of making its own independent assessment and valuation for purposes of levying town taxes. The Act specifies the Town Manager is the Town Tax Collector. The Act allows the Council, by ordinance, to impose impact fees and the purpose for such impact fees. The Act specifies the duties of the Police Chief and Town Manager. The Act specifies all appointments and promotions of Town employees shall be under the direction of the Mayor and the Town Council including hiring, termination, promotion or discipline of all employees. The Act specifies use of Town money by Town Council. The Act sets forth new election procedures, including voter qualifications, voter registration, and conduct of elections for Town elections.

This bill creates a special license plate to help underwrite Youth and Conservation Day for the Delaware Ducks Unlimited youth members known as Greenwings. Greenwings are younger Ducks Unlimited members who participate in the conservation, restoration, and management of wetlands and associated habitats for North American waterfowl. The purpose of this license plate is to raise money to educate our youth in the continued conservation of our habitats to benefit our wildlife and people. This plate is intended for use by individuals of all ages.

The General Assembly previously restricted municipal, town, and city police departments from operating speed enforcement equipment outside of its corporate limits. This Act completely restricts the ability of municipal, town, and city police departments to make arrests for speeding that occurs outside of the municipality, town, or citys corporate limits. This Act also defines corporate limits for the purposes of 21 Del. C. § 701.

This Act is a substitute for House Bill No. 224. Like House Bill No. 224, this Act narrows the meaning of firearm for purposes of the Delaware Criminal Code by more closely aligning the definition of firearm with the definition in the federal criminal background check law. The reference to a BB gun is no longer necessary because a BB gun does not use an explosive force to propel a projectile.

This Act requires police officers to enter private property to enforce custody orders when a court order requires them to do so.

This legislation is the Delaware Pre-Authorization Reform Act of 2023.

Currently, an application for a new license to purchase for resale of alcoholic liquor for transfer of an existing license, or for a substantive change to a license or licensed premise, shall be filed with the Commission. This Act amends the definition of "substantive change" to include live music with or without the use of PA systems; and to include external speakers for "piped-in" or pre-recorded music.

This Senate Concurrent Resolution recognizes the importance of community health workers as well as "Community Health Improvement Week" in the State of Delaware.
