Caption

An act to amend Section 45308 of, and to amend and repeal Section 45277.5 of, the Education Code, relating to school district employees.

Summary

AB 2120 would make a Los Angeles Unified School District-specific change to the Education Code governing classified employees under the merit system. First, it would extend LAUSD’s authority to hire certain classified employees from outside the top three ranks on an eligibility list when the job requires special qualifications such as bilingual ability, a driver’s license, specialized licenses or certifications, or a bona fide occupationally required gender. The bill also removes the information technology electronic communications technician classification from the list of covered classifications, while leaving the other listed management, confidential, and analyst positions subject to the special hiring rule. Second, the bill would allow LAUSD to retain, during layoffs, a classified employee hired under these special hiring provisions even if that means departing from ordinary seniority-based layoff and reemployment rules. That exception would apply when laying off the employee would cause the district to lose one of the qualifications that justified the employee’s original hire. The bill is written as a special statute for LAUSD and would make the hiring authority indefinite rather than temporary, replacing the current sunset date of January 1, 2027.

Impact

AB 2120 would amend Education Code Sections 45277.5 and 45308 to create and preserve LAUSD-only exceptions to the statewide merit-system rules for classified school employees. It would broaden LAUSD’s flexibility in filling certain positions requiring special skills or characteristics and would also modify layoff and reemployment rules so the district can keep employees whose qualifications are deemed essential. Because the bill extends an existing local exception and affects a crime-related enforcement provision tied to merit-system violations, it is treated as creating a state-mandated local program, though the bill states no reimbursement is required.

Sentiment

The available voting history shows strong support and no recorded opposition in committee, with unanimous or near-unanimous do-pass votes and a recommendation to place the bill on the consent calendar. That pattern suggests the bill was viewed favorably and as relatively noncontroversial among committee members. The absence of committee transcript material limits insight into detailed floor or stakeholder debate, but the procedural history indicates broad agreement on the need for the LAUSD-specific adjustments.

Contention

The main policy tension is between local flexibility for LAUSD and the statewide merit-system principles of rank order hiring and seniority-based layoffs. Support for the bill appears to rest on the argument that the state’s largest school district needs special accommodations to recruit and retain employees with hard-to-fill qualifications, especially for specialized or bilingual roles. Potential concerns, though not reflected in recorded opposition, would likely center on fairness to other applicants and employees, the erosion of seniority protections, and the use of a district-specific exemption rather than a statewide rule.
