This act is the Alabama Community Land Trust Act of 2026. This act: (1) authorizes Class 1 municipalities to create by ordinance nonprofit community land trusts to promote affordable housing and productive land use; (2) provides for trusts' formation, governance, and board of director's composition, duties, and authorities; (3) requires trusts to be annually audited by the Department of Examiners of Public Accounts; (4) prohibits trusts from engaging in related political activity; (5) grants trusts certain powers to effectuate their duties, including acquiring, leasing, and constructing affordable housing properties; (6) requires trusts to publish tenant selection criteria and an annual report providing certain information regarding its activities, including funding sources, employees, owned property, contracts entered into, and other information determined by the Alabama Housing Finance Authority; (7) provides requirements for ground leases entered into by trusts, including a lease must grant the trust and then the organizing municipality a right to purchase all improvements thereon and that leases may not exceed 99 years; and (8) exempts trust-owned affordable housing property from ad valorem taxes for three years, subject to conditions, and trust leased affordable housing property from 20 percent of ad valorem taxes for 20 years.

This act adds Section 13A-10-40.1 to the Code of Alabama 1975, to: (1) establish the crime of bail jumping in the third degree when a person violates any condition of court-ordered monitoring when lawfully released from custody, with or without bail, subject to defense; and (2) provide a violation is a Class C misdemeanor.

This act amends Sections 27-31B-3, 27-31B-6, 27-31B-8, and 27-31B-9, Code of Alabama 1975, to: (1) further provide requirements that captive insurance companies must satisfy to conduct business in the state, including banking, employment, ownership, recordkeeping, and background requirements and submitting an operation plan detailing insurance types and limits, financial statements, and investment, underwriting, and rate making policies; (2) increase the amount of capital and surplus that pure captive insurance companies must possess from $100,00 to $250,000, that reinsurance captive insurance companies must possess from $10,000 to $1,000,000, and that protected cell captive insurance companies must possess from $100,000 to $250,000, or an amount determined by the Commissioner of Insurance; (3) require branch captive insurance companies to possess at least $250,000 of capital and surplus and risk retention groups to possess at least $1,000,000 of capital and surplus, or an amount determined by the Commissioner of Insurance; (4) provide additional criteria for the commissioner to consider when determining if captive insurance companies will promote the general good of the state, including examining the competence of contractors and legal counsels and the company's business plans; and (5) require annual audits of a captive insurers' financial conditions and annual certification of loss reserves and loss expense reserves.

This act is the Child Predator Death Penalty Act. This act amends Sections 13A-5-40, 13A-6-61, 13A-6-63, and 13A-6-65.1, Code of Alabama 1975, to: (1) provide rape in the first degree, sodomy in the first degree, and sexual torture are capital offenses when the victim is less than 12 years of age; and (2) require individuals convicted of these crimes to serve a minimum of 30 years in prison prior to being considered for parole.
