Summary:
The committee took up several joint resolutions dealing with agency rules. H.J.R. 1090, approving energy- and agriculture-related agency rules, was adopted and passed 10-0. H.J.R. 1091, covering business and commerce rules, was also adopted and passed 10-0. H.J.R. 1092, which had been split out from the business and commerce packet because of a reported $10 million cost impact on one business, was adopted after discussions with regulators about delaying remodeling requirements and addressing safety concerns; it passed unanimously. H.J.R. 1093, approving health-related agency rules, passed 11-0, with some Oklahoma Health Care Authority major rules noted as being handled separately in the Senate.
The committee then discussed H.C.R. 1094, a major rule from the Long-Range Capital Planning Commission. Members raised concerns that the agency’s rule impact statement contained errors, incorrect notice and hearing information, and an incomplete economic analysis. After debate over whether the resolution could be amended or had to be accepted or rejected as a whole, the committee voted 11-0 that it did not pass. The committee then considered H.J.R. 1095 with an amendment to specifically disapprove a proposed permanent rule change by the Long-Range Capital Planning Commission that would have allowed the commission to ignore its own rules in the “best interest of the state.” The amendment was adopted 11-1, and the resolution as amended passed.
At the end of the meeting, the chair thanked members and staff for their work and said the committee would try to move the resolutions to the floor on Thursday, with another meeting likely needed to address additional major rules coming from the Senate. A committee member also suggested a brief educational review of a prior procedural issue at a future meeting, and the chair agreed to discuss broader concerns about the administrative rules process in a later wrap-up.

The committee also reviewed emergency regulations from the Board of Medical Imaging and Radiation Therapy, the Board of Emergency Medical Services, the Transportation Cabinet, and the Department of Workplace Standards. The EMS package covered licensing classifications, compliance audits, ambulance service rules, and electronic forms; the Transportation Cabinet’s emergency rule established procedures for street-legal special purpose vehicles; and Workplace Standards’ emergency rules updated Kentucky requirements to align with federal standards and House Bill 398, including shortening the discrimination complaint filing deadline from 120 days to 30 days and adjusting appeal procedures. Staff amendments were approved where offered, and members asked several clarifying questions about the rationale and effect of the workplace and EMS changes.
The Department of Fish and Wildlife Resources explained rules on aircraft and drone use in taking wildlife and on reciprocal hunting and fishing agreements with neighboring states. The agency said the drone restriction was intended to align with federal law and address hunter complaints, while the reciprocal agreement rule was a cleanup of older agreements that had lapsed or been overlooked; the committee deferred the wildlife regulation 301 KAR 2:031 at the agency’s request. The Department of Education also presented multiple KHSAA-related and standards updates, including academic eligibility, sports timing, health and physical education standards, and career studies/financial literacy standards; staff amendments were approved, and members questioned the athletic forms and the designation of KHSAA as the state’s athletic agent. Finally, the Cabinet for Health and Family Services presented emergency regulations to support a pediatric teaching hospital expansion and related certificate-of-need changes, which the agency said were aimed at improving pediatric and neonatal access to care; staff amendments were approved, and the committee concluded by setting its next meeting for October 13 at 1:00 p.m.

Opponents, including NBEO officials, ARBO, Pearson VUE, and several optometrists, argued the Canadian exam is not equivalent, does not test the same biomedical science content, is not validated for U.S. scope of practice, and raises concerns about test security, transparency, and portability across states. Committee members questioned both sides about prior communication with the board, whether Kentucky would be the first state to adopt such a change, the rationale for the proposal, and the cost difference between the exams. Supporters said the board had received some written comments and one phone call, and that the proposal was driven by access concerns and the presence of Canadian students. Opponents said they had not had direct discussions with the Kentucky board before the hearing. The committee next considered several emergency regulations from the Public Protection Cabinet’s Department of Alcoholic Beverage Control implementing SB 100. The rules covered tobacco, nicotine, and vapor product licensing, including the application form, denial standards, and transitional licensing. ABC counsel said the department had received about 5,500 applications and issued nearly 5,000 licenses, with additional provisional licenses issued to avoid interruption in sales after the law’s effective date. He said some applications remained pending because inspections and photographs revealed possible unauthorized nicotine vapor products, and the department was seeking documentation before approval. A staff amendment was adopted without objection before the ABC presentation continued.
