Summary:
The Administrative Regulation Review Subcommittee met for its January meeting, approved the minutes from the prior meeting, and welcomed the new regulations compiler. The first item was a repealer from the Council on Postsecondary Education, 13 KAR 2:111, which was explained as necessary because Senate Bill 77 from the 2025 session removed the regulatory authority for advanced practice doctoral degree programs at comprehensive universities. The subcommittee then reviewed a large package of State Board of Elections regulations with staff-suggested amendments. The package would update definitions and election procedures, require e-poll books to be ready before polls open, change the standard and timeline for removing an election officer, add oversight by a State Board appointee on election days, recognize the Kentucky party, require voter registration records to be added to electronic voter records, require ballots to fit all races and questions on a single sheet, adjust precinct consolidation petition deadlines, and update incorporated forms and identification references. The package was approved without objection.
The Office of the Attorney General’s Office of Regulatory Relief also presented multiple regulations with staff amendments, covering funeral planning declarations, cemetery companies, pre-need cemetery merchandise and funeral/burial contract sellers, and crematory contract sellers. These changes were described as adding specificity, streamlining forms and reporting, and bringing the regulations into compliance with KRS Chapter 13A; they were approved without objection.
The Board of Examiners of Psychology presented several regulations, including compact rules, grace-period extensions, and significant fee increases for applications, renewals, reinstatements, exam retakes, and reciprocity. Board representatives said the increases were needed because many fees had not been raised since 2002, the board was operating at a deficit, and legal and administrative costs had risen sharply after the termination of state legal services. Members expressed concern about the size of the increases, but the chair said he would not hold the matter up and would raise the issue with the committee of jurisdiction. The subcommittee also approved staff amendments for the Energy and Environment Cabinet’s air quality regulations and the Education and Labor Cabinet’s education regulations, which updated nontraditional instruction procedures, waiver requests, instruction topics, superintendent assessment requirements, and academic standards. The meeting ended with the next meeting scheduled for February 9 at 1 p.m., and the agenda was adjourned without further objection.

The committee opened by noting it was likely its last hearing of the 2026 session, then took up several resolutions. SCR 54, on appointing a hydrogen fire safety expert and training on hydrogen-related protocols, and SCR 59, on allowing certain health care professionals to practice without a license during a state of emergency, drew no testimony. Testifiers said the measure should ensure an integrated system with EMS infrastructure, real-time access for dispatchers and field personnel, and public education about the system; they also noted that Smart911 is no longer being used on Oahu and Maui and that a statewide, integrated approach is needed. Members agreed to work the suggested language into the resolution. SCR 179, urging Maui County to enforce fire code provisions on brush clearance, fuel breaks, roadside vegetation clearing, and emergency access, was noted as having no testimony but continuing to raise important issues.
SCR 74, calling for an audit of no-bid contracts issued under emergency proclamations from 2020 through 2025, drew strong support from a late testifier who tied the measure to emergency procurement concerns after the Lahaina wildfire and COVID-era contracting. The witness argued that procurement rules should not be waived in ways that compromise safety, and described concerns about unlicensed contractors and construction problems in a state housing project. Members asked about the scope of the audit and whether it would interfere with criminal investigations; the witness said the audit should cover a broad range of contracts, including nonprofit contracts, and should not be limited to the wildfire period. The committee also heard SCR 28 SD1 on creating a Hawaii Vietnam Veterans Medal, with support from the Department of Defense and veterans advocates, who said the resolution is intended to do the groundwork for a future appropriation and to determine eligibility and distribution procedures.
Finally, SCR 60 SD1, requesting updates on the “Breaking Cycles” rehabilitation and restorative justice study, received support from the Department of Corrections and Rehabilitation, the Correctional System Oversight Commission, and reform advocates. The department asked that reporting be annual rather than quarterly because of the complexity of the OCCC project, and supporters said the measure would promote transparency and help ensure the study’s recommendations are implemented. No votes were taken in the portion of the hearing provided.

Summary:
The committee first took up amended bill 10-13, a school funding and education appropriations measure. Senator Schaible walked through the final version, which included changes to foundation aid, transportation grants, free and reduced-price meals funding, paraprofessional and teacher support programs, Native American education items, library and school facility projects, and several one-time grants. Members discussed removing the science center grant funding, and Senator Meyer objected to that removal, arguing that Grand Forks had raised matching private and local funds and that other cities had received similar state support. Bank of North Dakota and OMB representatives raised concerns that the draft included policy changes and procurement/IT exemptions that needed further discussion. Members agreed the bill would be delayed until Monday so the Bank, OMB, and NDIT could confer and work through the mechanics and policy issues before the committee moved it forward.
