She said WIFA’s current budget ask was essentially for no additional cuts, while members asked about costs, project qualifications, and public-private structure. The committee then took up House Bill 2097, which would impose a six acre-feet-per-acre groundwater pumping cap in irrigation non-expansion areas, add reporting and well-measurement requirements, and set a $150 penalty for violations. ADWR said the bill could require additional staffing and that the cap and substitution provisions had technical concerns; environmental groups argued the cap was too high and could still encourage overpumping, while supporters said it would finally place a limit on INA pumping. HB 2097 passed 6-4. Finally, the committee heard House Bill 2116, which would appropriate $1 million to the Colorado River Litigation Fund; the sponsor described it as a contingency for ongoing Colorado River negotiations, and the committee moved the bill forward after brief discussion.

Several agencies briefly identified themselves and answered procedural questions, but most items drew no substantive opposition. The Board of Veterinary Examiners regulation included an agency amendment that removed a proposed limit on the number of facilities a veterinary manager could oversee. The Department of Education regulations updated fee waiver and meal program procedures, while the Department of Public Health regulation clarified notification and conference-request procedures. The Department of Revenue and Kentucky Public Pensions Authority items were largely technical or conforming changes, including a special-needs trust definition added for consistency with Senate Bill 85.
The most extensive discussion involved the Department for Medicaid Services’ 1915C child waiver regulations. Kentucky Protection and Advocacy testified in opposition to the waiver’s lack of participant-directed services, arguing that consumer-driven services such as respite and community living support are required and especially important in rural areas and for higher-acuity children. Cabinet representatives responded that the waiver is intended to provide wraparound services to keep children in homes and communities, that it has CMS approval, and that the program is limited to 100 slots with about 21 participants already enrolled. Members did not move a deficiency motion, and the chair indicated the regulations would continue through the process. The meeting adjourned after setting the next meeting for Tuesday, August 11 at 1:00 p.m.

Travis Pal of the Council on Postsecondary Education explained that the changes reflect the work group’s three-year review process and that the work group ultimately voted to define underrepresented students as first-generation students and to apply half-weighting between research and comprehensive universities for the new metric. Michael Frasier of the Kentucky Student Rights Coalition and Eastern Kentucky University student government opposed 13 KAR 2:120, arguing that the regulation improperly applies weights where the statute does not clearly authorize them and that the funding changes disadvantage comprehensive universities and vulnerable students. He asked the committee to find the regulation deficient or, alternatively, recommend legislative clarification and a revised fiscal analysis. Pal responded that weighting has been part of the model since 2017, that CPE was following the statute and work group recommendations, and that the model could be changed by future legislation.
Members asked about the timing of the broader performance funding review, and Pal said the full model is reviewed every three years, with the next work group cycle beginning in 2026. No motion to find the regulation deficient was made, and the committee allowed the regulations to proceed to the committee of jurisdiction. The committee then approved a staff amendment to Teachers’ Retirement System regulations 102 KAR 1:195 and 102 KAR 1:340, which require annual reporting of accumulated sick leave, leave policies, and salary schedules to TRS and make technical changes to the final average salary calculation and related definitions.
