Both bills were presented as safety measures, with railroad labor testimony in support, and both were left pending after brief public testimony. The committee also heard SB 2141, a Zaffirini bill concerning specialty license plates for judges, with the substitute aimed at reducing security risks by changing how judges are identified on plates; it too was left pending. Finally, the committee heard SB 2439, another Zaffirini bill, described as a TDLR cleanup measure related to ATV and off-highway vehicle safety certification. The bill would abolish the current training and certification program, which supporters said was burdensome and underused given the small number of approved instructors statewide. Senate Bill 1210, also by Hughes, would address conflicts between the Texas Supreme Court and the Court of Criminal Appeals on constitutional questions by making the Supreme Court the final arbiter in limited circumstances. Chris Hilton supported the bill, but Allen Place, Jack Rohde, and Philip Furlow opposed it, arguing it was unconstitutional, unnecessary, and could create practical problems in criminal post-conviction litigation. The bill was left pending after testimony. The committee also heard Senate Bill 311, which would conform the Government Code to the Texas Constitution by clarifying the Supreme Court’s original writ authority against lower courts and officials other than the governor. Justice Evan Young and Chris Hilton supported the bill as a clarification of existing authority, while no one testified against it; the bill was left pending. The committee then recessed to allow the chamber to rearrange for the Senate session.

He said the subpoena change would speed investigations and align the Attorney General’s authority with other agencies, and that the restitution change would help recover more fraudulently obtained Medicaid funds. No public testimony was offered. Members questioned why the funding should go to the Attorney General’s office rather than the BCA, whether the new records authority was federally required, how the venue language would work across state lines, and whether the added FTEs indicated the fraud problem was larger than expected. Ellison and Wonka responded that the federal grant requires the work to stay within the Medicaid Fraud Control Unit, that the unit’s investigators are specialized and work with, but separate from, law enforcement, and that the venue provision applies only within Minnesota while out-of-state matters would be referred to the appropriate authorities. The amendment that had been posted was withdrawn and not offered.
