Summary: The committee first took up House Bill 2777 by Representative Rose, which would bar the death penalty for defendants who can prove by clear and convincing evidence that they had schizophrenia or schizoaffective disorder and active psychotic symptoms at the time of the offense. Members debated whether the law’s remaining language is merely symbolic or still harmful, and whether other criminal statutes already cover conduct such as prostitution, incest, and offenses involving minors.
