Summary:
The Long Range Capital Planning and Utilization Committee met in organizational session and first elected Representative John Cluder as clerk. A nomination of Senator Mark Makoni as vice chair was made but not voted on because he was absent; it was carried over to the next meeting. Several Department of Safety and Department of Transportation property items were approved as well. Safety received approval for a 10-year lease, with renewal options, for the State Police aircraft hangar at 91 Airport Road in Concord. Transportation was authorized to continue disposal efforts for remnant parcels in Concord, Conway, Lisbon, Effingham, and Mount Vernon, with testimony explaining market conditions, appraisals, access limits, and easements; members asked questions about access and buildability, but each item was approved. During the Berlin lease item, the committee was told the FAA objects to any lease longer than 50 years at that airport, so the request was revised from 55 years to 50 years on the record before approval.

Some members raised concerns that raw statistics can be misleading because judges also do substantial off-the-bench work and often help cover other courts’ dockets.
There was also testimony and discussion about the bill’s conduct and discipline provisions. A representative of the Texas Civil Rights Project opposed parts of the bill that would tie pay raises to changes affecting judicial independence, warning about subjective bail-related discipline standards and possible chilling effects. The executive director of the State Commission on Judicial Conduct cautioned against civil penalties for complainants, saying it could discourage good-faith complaints and create litigation risks. Other witnesses supported accountability reforms but urged caution about unintended consequences, especially for family and emergency cases and for judges handling warrants and other time-sensitive matters. After testimony, the committee withdrew the committee substitute and left HB 1761 pending, then recessed the committee.

The committee also took up S. 1114 on automatic record sealing, with Sen. Friedman and others arguing that the current petition-based process is slow, burdensome, and disproportionately harms people with criminal records, especially Black and Latino residents. Testimony also supported H. 1965/S. 1132 on compensation for wrongful conviction, with advocates and sponsors describing a faster administrative claims process, transitional support, and higher compensation without the current cap. Sen. Payano testified for S. 1241 to expand educational programming for incarcerated emerging adults, saying education reduces recidivism and improves reentry outcomes.
A substantial portion of the hearing focused on S. 2522, an update to Massachusetts’ shield law for reproductive and gender-affirming care. Sen. Friedman, the Attorney General’s office, and DPH Commissioner Robbie Goldstein said the bill is needed to strengthen protections against out-of-state legal attacks, protect patient and provider data, clarify enforcement authority, and add a state-level EMTALA-style emergency care requirement. Committee members asked detailed questions about prescription labeling, the prescription monitoring program, attorney discipline, custody and full faith and credit issues, and whether the bill’s enforcement language could create unintended limits or conflicts. The Attorney General’s office said it would provide follow-up written testimony on several technical questions.
