House Bill 4430 extended tort claims protection to certain state-employed providers who work for entities such as FQHCs, and House Bill 4431 did the same for nurse practitioners working for state agencies; both passed 5-0.
Later, House Bill 2964 changed medical-record copying language from “shall be charged” to “may be charged,” giving facilities discretion on whether to charge patients for copies of their records; it passed 5-0. Finally, House Bill 3834 was heard for research funding on ibogaine therapy for PTSD and related conditions among veterans, firefighters, and police officers. The sponsor said the goal was to allow Oklahoma research, not to remove the substance from controlled status, and a witness described the treatment as a monitored oral session used in Mexico and supported by some studies. The bill passed 5-0, and the chair adjourned the meeting, noting the laid-over bills would likely be heard the following week.

Summary:
The committee heard a Department of Corrections capital budget presentation on HB 25, focused largely on urgent maintenance and security needs at the New Hampshire State Prison for Men and other DOC facilities. DOC officials described the governor’s proposed priorities: boiler surge and radiator tank replacements, electronic controls and camera upgrades, and replacement of HVAC units using R22 refrigerant. They also outlined additional requested projects totaling $15.4 million, including a body alarm/man-down system at Northern New Hampshire Correctional Facility, steam line and trap repairs, fire alarm replacements, and removal of an underground diesel tank in favor of above-ground storage.
DOC testified that many systems are well beyond their expected service life, including 40-year-old boilers, outdated analog cameras, and HVAC equipment using discontinued R22 refrigerant. They said the men’s prison is relying on a leased temporary boiler, has significant steam leaks causing major water loss and reduced boiler efficiency, and is dealing with frequent fire alarm faults and deteriorating wiring. On the body alarm system, they said the vendor no longer supports the equipment and replacement parts are no longer available. On the diesel tank, members questioned whether it could be abandoned in place or whether fuel could be reused; DOC said it had not explored all alternatives and would follow up, while noting the tank is underground and tied into the warehouse system.
Members also asked whether some current investments could be reused in the planned new men’s prison. DOC said some items, such as air handlers, might potentially be moved, but most projects are needed to keep the current facility operational and would not be practical to transfer. Questions were also raised about the leased boiler arrangement, the use of the man-down system by staff and visitors, and whether the kitchen project could be converted to a modular unit. DOC said the modular kitchen approach is necessary because the existing kitchen cannot remain fully operational during repairs. The committee then moved to lapse extensions, and DOC identified several projects no longer needing extensions, including items numbered 64, 65, and 66 in HB 25, with the chair noting those balances would be deleted and that the lapse amount was $550,500.

The Senate took up floor debate on H. 4206, An Act Modernizing the Commonwealth Cannabis Laws, with repeated amendment votes focused largely on cannabis regulation, transparency, youth access, and the Cannabis Control Commission (CCC). Early motions included suspending Senate Rule 38A to continue past 8 p.m., which passed by standing vote. Most amendments offered by Senator Tarr were rejected, including proposals on possession limits, CCC executive director appointment and removal, legislative control over medical marijuana licenses, a multi-agency task force on illegal cannabis, annual CCC hearings and reports, an ombudsman, a legislative liaison, a youth-cannabis study commission, supply-and-demand study, and increased penalties for distribution to minors. Amendment 33 by Senator Driscoll, directing the CCC and other agencies to study regulation of intoxicating hemp products, was adopted. Amendment 7 by Senator Brownsberger, allowing cannabis discount and loyalty advertising to existing customers and opt-in email lists, was also adopted. Amendment 29 by Senator O’Connor, allowing the CCC to temporarily suspend or revoke medical marijuana licenses during investigations of illegal sales, was adopted as well.
Several other amendments were debated and defeated, including Senator O’Connor’s billboard advertising restriction for cannabis and Senator Tarr’s proposal to increase penalties for selling marijuana to minors. The chamber then took up the bill’s corrective and Ways and Means amendment, adopted both, ordered the bill to a third reading, and then passed it to be engrossed by roll call vote. The final vote showed the bill advancing despite some opposition, including from several senators who voted no on engrossment.
After the cannabis bill, the Senate considered and passed two land-related bills by roll call: H. 4772, authorizing easements in Lowell, and H. 4362, authorizing release of agricultural preservation restrictions in Westford. The Senate also adopted a motion that when it adjourned, it would do so in memory of Stephen P. Foutou of Newton, followed by a moment of silence. The chamber then adopted an adjournment order and recessed until the next meeting.
