Summary:
The Judiciary Committee heard several Senate bills. SB 2149 would exempt paternity proceedings involving allegations of domestic abuse from mediation and clarify the domestic abuse mediation exemption in divorce cases. The Department of the Attorney General and the Hawaii State Coalition Against Domestic Violence supported the measure but recommended technical and conforming changes, including updating references from HRS Chapter 584 to 584A and aligning the language more closely with the Uniform Mediation Act. Members discussed whether the bill’s wording could limit who may bring a support person to mediation, and the chair suggested the intent was to preserve survivor choice while avoiding ambiguity. No vote was taken in the portion heard.
SB 2203 would create an offense for law enforcement officers using masks or personal disguises. The Office of the Public Defender, ACLU of Hawaii, Legal Clinic, and many other supporters argued the bill would improve transparency, accountability, and public trust, while still allowing safety exceptions. Law enforcement agencies, including the Department of Law Enforcement, Honolulu Police Department, and the Honolulu Prosecutor’s Office, raised concerns about operational needs, undercover and auxiliary units, body cameras, and possible supremacy clause issues if the bill is aimed at federal officers. The chair noted the bill appeared likely to move forward and asked agencies and advocates to work on possible amendments; testimony count was reported as 114 in support, 3 opposed, and 2 comments.
SB 2251 would appropriate funds for the victim witness assistance program in the City and County of Honolulu Prosecuting Attorney’s Office. The prosecutor’s office supported the bill, saying it would replace shortfalls from declining federal funding and help maintain victim services and rights information. A former program director also testified in support. When asked, the office said it would not object to a simple reporting requirement. The committee then moved on to SB 2311, which would address claims against the state and add reporting and timing requirements; the Department of the Attorney General testified with concerns and recommendations, and members began questioning current practices for handling claims and settlements.

The committee first heard Senate Bill 47, sponsored by Senator Regina Birdsell at the request of the Insurance Department. The bill would clarify that a birth mother’s health insurance is the primary policy for a newborn’s care unless the mother has no coverage or no employer-sponsored coverage. Birdsell and Insurance Commissioner DJ Benton Court said the measure simply codifies the department’s long-standing interpretation of existing law. Representative Miles asked whether the coverage would extend to a grandchild if a young woman on her parents’ plan had a baby, and Birdsell said it would. The hearing on SB 47 was then closed.
The committee next heard Senate Bill 121, introduced by Grant Bosi for Senator Kevin Avard. The bill requires insurers to notify the Insurance Department when they stop writing an entire line of business or, in some cases, when they change Medicare Advantage offerings. Benton Court said the bill was prompted by disruption in the Medicare Advantage market, where consumers and the department were confused by carriers exiting, changing plans, or narrowing offerings. He said the department does not regulate Medicare Advantage itself, but does license the carriers, and the notice requirement would help the department advise consumers; he also said noncompliance could affect a carrier’s license and could lead to fines. Members discussed the notice period, and the department and AHIP indicated support for changing it from 120 days to 90 days to align with federal timing. The hearing was closed with plans to work on an amendment in subcommittee.
Finally, the committee heard Senate Bill 247, introduced by Representative Brian Cole, which would prohibit network exclusion for pharmacies that refuse to dispense prescriptions when PBM reimbursement is below acquisition cost. Cole said the bill is meant to stop pharmacies from being forced to sell at a loss. Members questioned whether pharmacies voluntarily enter PBM contracts, whether the bill would raise consumer prices, and whether it would mainly affect independent pharmacies. Cole and others said the issue has changed over time because PBMs now control a much larger share of the market, and that the bill would let pharmacies refuse loss-making fills and direct patients to mail order instead. The discussion also noted that the bill excludes Medicare and Medicaid and that the current proposal does not create a middle-ground option for patients to pay a premium at the counter.

The House opened with prayer, approval of the prior day’s journal by a 120-0 roll call, and a successful motion to suspend House Rule 98 so members could wear hats on the floor. On third reading, House Bill 3329 passed 142-0 to repeal expired tax credits, and House Bill 3405 passed 138-0 to clean up SALT deduction language and improve tax-credit accounting. House Committee Substitute for House Bill 2426, a parental-rights bill, failed on a 70-60 vote after opponents argued it would burden schools and could endanger vulnerable students, while supporters said it affirmed parents’ fundamental rights.
The House also took up House Committee Substitute for Senate Bill 1233, a professional licensure bill dealing with CPA licensing and other occupational-licensure provisions. Members adopted an amendment removing compact language, an amendment allowing APRNs and physician assistants to perform nursing-home physicals was offered but then withdrawn after the sponsor objected, and the bill ultimately passed 129-6. Finally, the chamber debated House Committee Substitute for Senate Bill 1408, a transportation package centered on allowing MoDOT to raise rural interstate speed limits up to 75 mph, with multiple amendments added or removed. The bill drew sharp debate over speed limits, vehicle inspections, DOR language, and road safety, and members also began considering an amendment to add specialty license plates for women’s professional sports teams such as the Kansas City Current and a future WNBA franchise.
