A member of the public also testified at length about concerns that the ADAP changes would harm access to life-saving medications and alleged improper shifting of program funds. Committee members and the presenter acknowledged follow-up questions on several items, but no additional votes or formal actions were taken beyond the favorable report on SB 7010 and adjournment.

Summary: The Administrative Regulation Review Subcommittee met to reorganize its leadership for the new term, renewing Representative Derek Lewis as House co-chair and Senator Steven West as Senate co-chair. The committee then approved the minutes and moved through a series of agency regulations, generally adopting staff-suggested amendments without objection. Among the regulations reviewed were an Attorney General rule changing how a commission reviews and distributes funds and how grant reporting is handled; Personnel Board changes abolishing and renaming certain job classifications and adjusting probationary periods; an Education and Labor Cabinet rule removing references to local board of education members; several Public Protection Cabinet rules covering Board of Claims and Crime Victims’ Compensation procedures; an Alcoholic Beverage Control rule on direct-to-consumer shipping forms; and a Medicaid Services emergency regulation establishing the Kentucky Trauma Hospital Rate Improvement Program for rural hospitals serving many Medicaid patients. The committee also heard that the Board of Claims and Crime Victims’ Compensation regulations included both staff and, in one case, an agency amendment, which were approved. The most extended discussion came on the Department for Community Based Services’ regulation increasing per diem rates for private child-placing therapeutic foster care levels 2 and 3. Committee members questioned the estimated $10 million biennial cost, the source of the funding, and why the cabinet had not yet filed regulations implementing Senate Bill 151 on kinship care. DCBS staff said the rate increase was discretionary and intended to address placement crises for children with high needs, while acknowledging they could not personally explain the budget decisions. A kinship caregiver testified in support of the rate increase but urged the cabinet to also implement SB 151 and expand support for kinship families. The committee expressed frustration over the lack of SB 151 implementation but stated the rate increase itself was appropriate and allowed the regulation to proceed.

Sponsor Rep. Overdorf argued the bill would create accountability for underperforming nursing schools by requiring remediation, tuition refunds in the lowest-performing programs, and public reporting of passage rates. Supporters said it would improve quality and protect students from debt without licensure success, while opponents from private nursing schools warned it could close programs and reduce nurse supply. After extensive debate, the bill was reported favorably 15-0. HB 1553, which would require health care providers to submit identified uterine fibroid data so the Department of Health can implement the research database previously authorized by law, passed unanimously 15-0. The final bill, HB 883, would allow psychiatric mental health nurse practitioners to practice autonomously; supporters said it would expand access to mental health care, especially in rural and underserved areas, while opponents raised concerns about quality and physician oversight. After lengthy testimony and debate, the bill was reported favorably 14-3.

Summary: The Committee on Finance received an informational briefing from the Department of Education on its budget request for the upcoming fiscal year. The Superintendent and staff described the department’s mission, enrollment and staffing scale, recent gains in NAEP reading and math, persistent attendance problems since the pandemic, and the need for resources to support student recovery, middle school math, and other strategic priorities. The department said its proposal is intended to be aligned with its 2023–2029 strategic plan, fiscally balanced, and reliable for schools, while also addressing inflation, workforce needs, and uncertainty in federal funding. Assistant Superintendent and CFO Brian Hallet reviewed federal grants, non-general funds, and the budget development process. He said federal funds make up about 11% of the department’s FY25 appropriation and warned that House budget proposals could threaten predictable funding for core programs. He also explained that the department began its biennial budget work in April 2024 and used an internal review group to identify possible reallocations. The department characterized its request as a “flat” budget proposal overall, with a large share devoted to continued funding for existing recurring needs, and noted challenges including a projected state funding decline, inflation, lingering pandemic impacts, recruitment and retention, and uncertainty about future federal support. A major topic was the department’s capital improvement program. DOE officials argued for a risk-based, proactive approach using lump-sum “buckets” to manage facilities and deferred maintenance across more than 21.5 million square feet at 268 sites. They said this would allow more efficient prioritization of projects and better coordination with complex area superintendents, principals, and legislators. Members asked about how legislative priorities would fit into the bucket system, county-versus-state property jurisdiction issues affecting school facilities, enrollment decline and staffing ratios, and how the department plans to adjust facilities and human resources to shifting enrollment patterns. DOE said it is studying enrollment trends, will brief the Board of Education next month, and is willing to provide further briefings to legislators. No votes or formal actions were taken during the informational briefing.
