Summary: The briefing focused on the Hawaii State Hospital’s overcrowding, construction defects in the new addition, and how Act 26 and related court-ordered processes are affecting admissions and discharges. The chair said the hospital has become increasingly forensic-focused, has lost beds after the closure of Kahimohala, and may face further costs and possible litigation over the defective addition. Hospital and Department of Health officials said they are working with the attorney general and contractors on repairs, and that the hospital is currently using all 292 licensed beds, including 13 waiver beds, while average daily census last fiscal year was 376. Officials explained that the high census is driven by both increased admissions and discharge barriers. They said the loss of Kahimohala returned patients to the state hospital, and that Act 26-related petty misdemeanor cases are contributing to admissions. They also said limited lower-level placement options delay discharges. Hospital staff reported that many patients are repeat admissions, about 22% were unhoused before admission, and a significant share are in categories such as fitness-to-proceed evaluations and conditional-release violations. They said these groups could potentially be reduced if evaluations were done elsewhere and if more community or supportive housing were available. The chair and senators questioned whether some fitness-to-proceed detainees need to be held at the state hospital at all, and whether the Clark consent order requires transfer to the hospital. The attorney general’s office said the Clark injunction does not govern unfitness-to-proceed cases; instead, the requirement comes from state statute, and the statute could be changed. Director Johnson said DCR cannot keep such detainees because the court orders them into the custody of the Department of Health, and the department cannot provide the needed therapeutic level of care in a correctional setting. The discussion also emphasized co-occurring substance use and mental illness, especially among petty misdemeanor defendants, and the need for supportive housing and a decompression plan to reduce readmissions and free beds for civil commitments.

Bills: S0534 , S7020
Committee: Senate Agriculture
Summary: The committee met, called the roll, and opened with the Pledge of Allegiance. It first considered the appointment of Melanie Ressler to the Florida Citrus Commission. No appearance forms were requested, and the committee voted unanimously to recommend her confirmation favorably. The committee then took up SPB 7020, which reenacts a public records exemption for certain aquaculture production records held by the Department of Agriculture and Consumer Services. Senator Trunow explained that the exemption protects shellfish and submerged land lease records, supports compliance with federal partners and statutory requirements, and helps protect marketplace competition. A representative from the Department appeared in support, and the bill was moved as a committee bill and reported favorably. Next, the committee heard SB 534, Senator Bernard’s hunger-free campus pilot program bill. He described a pilot within the Department of Agriculture and Consumer Services to identify campuses with high numbers of Pell-eligible students, develop a survey with the Hunger Task Force, designate staff to help students enroll in SNAP, expand campus food access, and require reporting on outcomes and future funding. The bill had one appearance form in support and was reported favorably without debate. The committee also received a presentation from the St. Pete Youth Farm, led by Carla Bristol and youth ambassadors. They described the farm as a youth-led community project on city-owned land that addresses food insecurity while providing leadership, financial literacy, career readiness, mental wellness programming, composting, aquaponics, and community events. Senators praised the program, asked about possible expansion into a culinary kitchen and partnerships with schools, and the presenters said they hope to expand youth opportunities, food preparation training, and related programming. The meeting concluded with adjournment.

Summary: The House Committee on Higher Education heard several measures focused on health, environment, and research. HB 970 would allow chiropractic students to participate in clinical practice under direct supervision; the Hawaii Board of Chiropractic offered comments and asked for a delayed implementation date until July 2027 to allow time to adopt rules, while the Hawaii State Chiropractic Association supported the bill. Members also discussed that there are currently no chiropractic schools in the state. The committee then heard HB 1185, which creates a plant-based building materials working group, and HB 1337, which establishes an endemic plant seed bank pilot program. Supporters of HB 1185 said the bill could help create green jobs and reduce greenhouse gas emissions by developing materials such as bamboo, hempcrete, and bio-cements, with questions raised about in-state processing. For HB 1337, witnesses supported the goal of preserving endemic species but said a large-scale refrigerated storage and seed-production facility would be needed; one witness estimated startup costs of about $6 million for one island and noted existing seed banks are small-scale and not designed for reforestation. HB 1300 would fund a University of Hawaiʻi Cancer Center multi-ethnic cohort study on cancer disparities among Native Hawaiians, Pacific Islanders, Filipinos, and Asians, including environmental and social factors such as proximity to landfills. The Cancer Center, ACS CAN, and labor representatives supported the bill, emphasizing health disparities and concerns about landfill exposure; committee members asked about federal funding, and the Cancer Center said it would pursue NIH, private, and foundation support, with the state share described as $500,000 per year for two years. HB 736 would create a wastewater technology testing pilot program at the Water Resources Research Center; supporters said it could help certify cheaper alternatives to costly cesspool and septic upgrades, and the Department of Health supported the measure. The committee also heard HB 531, which authorizes special license plates for the Cancer Center; supporters said it would raise visibility and funds, and the Cancer Center estimated revenue would likely be under $100,000. No votes or final actions were taken in the portion of the meeting provided.

Summary: The conference committee discussed a child care tax credit bill and focused mainly on narrowing the eligibility language. Members agreed to remove a proposed 10-mile limitation tied to the state line at first, then revisited the issue after concerns from the Tax Department and Legislative Council about remote workers, border communities, and out-of-state daycare use. Testimony from the Greater North Dakota Chamber supported the credit as a more flexible version of a prior grant program, while committee members debated whether the credit should apply only to North Dakota residents, employees working in North Dakota, or child care providers located in North Dakota or border cities. After extended discussion, the committee settled on keeping the 10-mile language and striking the resident requirement from the definition of “qualified employee,” with the intent of better capturing border-area workers while avoiding broader unintended coverage. Members noted the bill is aimed at workforce and child care access, especially in Fargo, Grand Forks, and other border areas, and acknowledged that the language may still need adjustment in the future. The Tax Department and Legislative Council indicated the revised language would be workable. Representative Foss moved the final amendment to the conference committee report, Senator Powers seconded, and the motion passed on a roll call vote with all members voting yes: Chairman Rummel, Senator Marseille, Senator Powers, Representative Doctor, Representative Foss, and Representative Anderson. The committee then adjourned, with House and Senate members designated to carry the report forward.

Summary: The Committee on Commerce and Tourism convened with several members present and Senators DiCeglie and McClain excused. The committee first heard a presentation from Greg Britton, State Director of the Florida Small Business Development Center Network, who described the network’s statewide small-business assistance, including startup support, export and contracting help, disaster recovery, and rural outreach. He highlighted reported 2023 impacts such as $3.9 billion in sales generated, $575.9 million in government contracts, $346.2 million in capital, and support for 2,009 new businesses, including 130 manufacturing firms over the past two years. Members asked about comparisons with SCORE and about measuring rural success, with the chair suggesting jobs and wages in rural areas would be useful metrics; Britton said he could provide job data but was unsure about wage information. The committee then took up SB 320 by Senator Gates, which creates a five-year demonstration project for an alternative licensure pathway for surveyors and mappers. The bill would allow a “first-step” probationary license based on industry certification, apprenticeship, recommendation from a licensed Florida surveyor, and passage of the Department of Agriculture exam within the five-year period, without requiring a four-year degree. Senators asked about the labor shortage, education requirements, foreign workers, and moral character standards. Gates said the shortage is chronic and worsening, the bill has no degree requirement, and anyone meeting the qualifications could proceed regardless of visa status. The committee voted to report SB 320 favorably. Next, the committee considered SB 316 by Senator Berman, which authorizes series limited liability companies in Florida and sets rules for how Florida and foreign series LLCs may operate and transact business in the state. Berman explained that the bill is intended to let businesses isolate liabilities across separate series while providing clearer rules for Florida citizens and businesses dealing with such entities. There were no substantive questions, one appearance form in support, and the committee voted to report SB 316 favorably before adjourning.

Summary: The House Committee on Crime and Public Safety met in executive session and first took up House Bill 3105, which drew the most discussion. The committee adopted a House committee substitute and two amendments: one replacing references to the Peace Officer Standards and Training Commission with the Director of Public Safety, and another changing venue language to Cole County. Members debated the bill’s effect on cooperation with federal law enforcement, Second Amendment rights, and local control, with supporters saying it would protect law-abiding citizens and allow public safety agencies to work with federal partners, while opponents argued it was unnecessary, politically motivated, or could weaken local authority. The committee then voted the substitute do pass by 11 ayes to 6 noes. The committee also voted House Bill 1740 do pass without discussion. House Bill 3186, relating to sex offenders, received one present vote from Representative Anderson, who cited possible constitutional concerns, but it still passed 15-0-1. House Joint Resolution 124 also passed, 12-4-1. The committee then combined House Bills 3068 and 3049 into a single committee substitute on sex offender registry matters and approved it unanimously, 17-0. Finally, the committee considered House Bill 2868, which would expand DNA swabbing requirements for certain felony offenses. An amendment added several felony categories, including controlled substance offenses, forgery, fraud, auto theft, felony DWI, and felony evading arrest, while removing check forgery language after member concerns. Representative Seitz said the change addressed his concerns and referenced a recent local officer shooting as a reason for support. The committee adopted the substitute and voted the bill do pass unanimously, 17-0, then adjourned the executive session.
