Bills: SB825
Summary: The Senate Committee on Border Security heard testimony on Senate Bill 825 by Senator Middleton, as substituted, which would require an annual or biennial study of the economic, environmental, and financial impacts of illegal immigration in Texas. Middleton said the bill is intended to provide lawmakers with comprehensive data on costs to law enforcement, health care, education, infrastructure, and taxpayers, and to support possible federal reimbursement claims. Several senators, including Hinojosa and Eckhardt, agreed that a study is needed but raised concerns about bias, the scope of the study, and whether the Comptroller’s Office rather than the governor’s office should conduct it. Middleton argued the governor’s office was the best coordinating entity because it could direct multiple agencies to provide data, while Hinojosa and others emphasized the Comptroller’s expertise and prior 2006 study. Public testimony was generally supportive of the idea of a study but critical of the bill’s framing. Sarah Cruz of the ACLU of Texas said the study should be a full cost-benefit analysis and warned that focusing only on costs could create an anti-immigrant narrative. Danny Woodward of the Texas Civil Rights Project also supported the concept but recommended moving the study to the Comptroller or, alternatively, creating a neutral commission. Jaime Pointe of Every Texan likewise supported updating the 2006 analysis and said state agencies should be able to cooperate with a governor-led study. Resource witnesses from the governor’s office, HHSC, TEA, OCA, TDCJ, and DPS explained that data collection would be uneven across agencies. HHSC and TEA said they often do not collect immigration status and, in TEA’s case, federal law limits schools from requesting such information; OCA and TDCJ said they could provide only partial or indirect data unless new reporting requirements were added. DPS said it already has Operation Lone Star data but would need to collect additional information if tasked with the broader study. The chair asked the governor’s office to provide a follow-up answer on separation-of-powers and related authority questions by the following Tuesday, and the committee recessed subject to the call of the chair without taking a vote on the bill.

Summary: The meeting was convened by the Senate Committee on Commerce, Science, and Transportation, where robust discussions were held regarding the need for improved oversight within the Senate. The chairman emphasized the historical decline in oversight activities and proposed motions to authorize subpoenas related to an ongoing investigation involving the Massachusetts Port Authority and allegations of illegal immigrant sheltering at airports. This prompted a detailed examination of the current practices and measures needed to address such issues effectively, particularly in light of recent reports from O'Hare Airport. The committee engaged in deliberations that highlighted the importance of maintaining legislative oversight to safeguard national interests.

Summary: The Committee on Water and Land heard confirmation nominations for several DLNR-related boards and commissions, including GM 530 for Karen Ono to the Board of Land and Natural Resources, GM 582 for Jay Kenan to the Natural Area Reserves System Commission, and GM 584 for Adrien Trulock to the Hawaii Historic Places Review Board. The chair repeatedly noted the volunteer nature of these positions and said the committee would take up decision-making after hearing all nominees. Testimony and comments for each nominee were generally supportive, with agency representatives praising their preparation, experience, and willingness to serve. For Karen Ono, DLNR and several supporters from Kauai testified in favor, describing her as highly prepared and effective on the board. Senators questioned her about DLNR land use, especially state lands near rail stations and whether they should be used for affordable housing rather than commercial development. Ono said she had not taken a board position on those specific proposals because they had not yet come before the board, but she acknowledged the importance of housing and infrastructure. She also responded to questions about DLNR’s management of transferred agricultural lands, saying concerns about the department’s ability to manage such lands had been raised before and remain relevant. One senator expressed strong reservations about the nomination based on the land-use answers. For Jay Kenan, the NARS Commission testimony focused on the commission’s role in advising on land management and conservation policy. Kenan said he hoped to continue helping evaluate properties and policies, and he identified funding and staffing as the main challenge. DLNR staff explained that the position supporting NARS had been abolished and that the department had limited capacity to restore it because other priorities, such as fire-related positions, were taking precedence. The committee also discussed a separate bill affecting Legacy Lands funding through conveyance tax revenues, with members and agency staff expressing concern that the measure could reduce support for land संरक्षण efforts. For Adrien Trulock, SHPD and DLNR staff strongly supported the nomination, citing her preservation background and experience with historic properties. Members discussed the importance of her expertise for reviewing nominations and appeals and for helping with preservation planning. The committee also raised broader concerns about delays in historic-place designations and the difference between state and federal review processes; SHPD explained that board approval places a property on the state register, while federal National Register review can still require revisions and cause delays. No final votes or confirmations were taken during the portion of the meeting provided.

  • all know, from time to time, we come to the legislature seeking support for additional judicial resources
Summary: The Senate Judiciary and Rules Committee first approved a motion to print RS 33676 without taking testimony, noting it would receive a hearing in another committee. The committee then heard SCR 114 from Senator Guthrie, which would limit the number of bill drafts legislators may request in a year, with exemptions for appropriations, amendments, trailer bills, interim committee legislation, and additional drafts approved by legislative leaders. Guthrie and supportive testimony from the League of Women Voters argued the measure would reduce legislative overload and improve quality; the resolution was sent to the Senate floor with a due pass recommendation. The committee next considered SB 1330, sponsored by Senator Galloway, to raise the small claims court limit from $5,000 to $15,000. Galloway and a constituent testified that the current limit is too low for common disputes and burdens small businesses and individuals. Administrative Office of the Courts counsel Jason Spillman said the courts expected additional workload and noted the bill could affect magistrate court jurisdiction; Galloway said he would take the bill to the 14th order to add an amendment removing the $25 cap on attorney fees in small-claims appeals. The committee voted to send the bill to the 14th order for possible amendment. House Bill 556, carried by Senator Foreman, would increase state reimbursement to counties for housing state inmates in county jails from the current $55/$75 daily structure to a flat $80 per day. County officials and sheriffs testified that counties are still subsidizing the state, that actual costs are higher than reimbursement, and that overcrowding and delayed transfers create safety and operational problems. Several senators supported the bill while also raising broader concerns about Idaho’s incarceration rates and sentencing policies. The committee sent HB 556 to the floor with a due pass recommendation. The committee also advanced HB 540, presented by Representative Bingham, which would extend public-records protections and related safety/security exemptions to the Idaho Department of Juvenile Corrections similar to those already available to the Department of Corrections. No opposition was offered, and the bill received a due pass recommendation. Finally, HB 688, presented by Senator Kaiser, would update Idaho’s airbag laws to define counterfeit and non-functional airbags, prohibit knowingly selling or installing them to mislead buyers, and set misdemeanor penalties. Testimony from the automotive industry supported the bill as a consumer-protection measure addressing counterfeit airbags; the committee sent HB 688 to the floor with a due pass recommendation before adjourning.

Summary: The committee first heard House Bill 2508, which would clarify that Missouri series LLCs may obtain standalone certificates of good standing from the Secretary of State and be individually listed on the Secretary of State’s website. Representative Chris Brown said the bill is intended to remove uncertainty created by a newer interpretation of the law and help Missouri businesses operate in other states. Committee members and witnesses from law and business groups generally supported the measure, emphasizing transparency, easier verification of entities, and reduced barriers to interstate business. No opposition was offered, and the hearing on HB 2508 was closed. The committee then heard House Bill 2517, which would require real estate wholesalers to provide a written disclosure before contracting with a seller, stating that they are acting as a wholesaler, do not represent the seller, may assign the contract, and encouraging the seller to seek legal counsel. Representative Brown described the bill as a consumer protection measure aimed at preventing deceptive practices that can harm distressed homeowners, seniors, heirs, and first-time sellers. Members raised questions about whether the disclosure should be more prominent and whether the bill would affect legitimate investors. Brown and several supporters said the bill targets bad actors without restricting legitimate transactions. Testimony on HB 2517 was mixed but broadly supportive of disclosure. The Missouri Association of Realtors, the Missouri Chamber, and several wholesalers and homebuyers supported the bill’s transparency requirements, while warning that overregulation could hurt the market for distressed and blighted properties. Supporters described wholesalers as important to moving off-market homes into the hands of rehabbers and argued that disclosure helps ensure sellers understand the transaction. One witness said the Senate companion bill had been amended to require disclosure 14 days before contracting and to make Attorney General enforcement discretionary, which would eliminate the fiscal note, though some witnesses said the 14-day requirement could burden sellers in urgent situations. The hearing on HB 2517 was then closed, with no votes taken during the meeting.
