Summary: The joint hearing first took up SB 696, which would create an emergency management office and fund tax credits, grants for low-income taxpayers to fortify homes, shelter development, and staffing. Supporters argued Hawaii needs a dedicated preparedness office and funding before the next hurricane season, while the Tax Foundation said the bill was too vague, especially on who would qualify for the tax credits and under what conditions. The Department of the Attorney General and the insurance division offered comments, and both committees recommended deferral of SB 696. The Commerce and Consumer Protection committee then heard SB 179 on construction defect remedies and the contractor repair act. Builders, Realtors, carpenters, and a mortgage industry witness supported the bill, saying it would reduce abusive litigation, speed repairs, and help housing production and affordability. Homeowner advocates and plaintiff attorneys opposed it, arguing it would weaken consumer protections, shift repair costs to homeowners, and delay or limit legitimate claims. One testifier suggested the Senate focus instead on stronger alternative dispute resolution, and the committee noted 105 written supporters, four opponents, and one comment submission. The committee next heard SB 416 on allowing pets in rental housing, with the Attorney General recommending a non-impairment safeguard because of possible effects on existing contracts. SB 593 on commercial dog breeders drew support from the Hawaii Humane Society and others, with concerns raised that counties would be expected to enforce the new regime without funding. SB 641, creating a tax on low-alcohol-by-volume spirits beverages, drew opposition from the Wine Institute, which said it would create a tax break for one segment and likely reduce state revenue. SB 1048 on online crowdfunding received support from GoFundMe and comments from the Attorney General, with GoFundMe urging changes to reduce burdens on charitable fundraising. SB 1213, allowing businesses to accept service of process by email instead of maintaining a registered agent, drew DCCA comments and opposition from LegalZoom, which warned email service could be unreliable and vulnerable to phishing.

Summary: The House Postsecondary Education Committee met and first considered House Bill 251, a cleanup bill related to the Kentucky numeracy counts law. Rep. Emily Callaway and staff explained that the bill shifts responsibility for evaluating education preparation programs and reporting to LRC from the Council on Postsecondary Education, in collaboration with EPSB, to EPSB as the primary party, aligning it with EPSB’s oversight role. The committee had no questions, adopted the motion, and passed HB 251 with favorable expression to the House floor. The committee then took up House Bill 263, relating to the student teaching stipend program, along with a committee substitute that merged in language from House Bill 181. KHEAA explained that the substitute removes the outdated term “expected family contribution” from state student aid statutes because of federal FAFSA changes. Rep. Banta said HB 263 is a cleanup measure to clarify that student teaching stipends are not financial aid, allowing institutions to distribute the stipends properly and easing administration for KHEAA. Joe Carol Ellis said the program is in its first year, with about 450 student teachers served in the fall and an expected 800 in the spring. The committee adopted the committee substitute by voice vote, then passed HB 263 with favorable expression as amended. Members also approved a title amendment changing the bill title to “An Act relating to teacher scholarships.” Chair Tipton noted the meeting was unusually brief and concluded after asking if there was any further business.

Summary: The Committee on Education heard three resolutions. STR 53 SD1 sought to have the Legislative Reference Bureau work with the Hawaii State Public Library System to identify rural and underserved communities needing better telecommunications access so residents can participate in the legislative process. Testimony from the Hawaii State Council on Developmental Disabilities supported the measure, emphasizing that many advocates cannot always travel to the Capitol and need better access. STR 117 SD1 urged the Department of Education to work with the Department of Transportation Safe Routes to School Advisory Committee and the County of Hawaii to inventory bus stops on Hawaii Island used by students and develop safety improvements; DOE described an upcoming live route audit, noted the large number of routes and stops on the Big Island, and said some stops are on private roads. The Department of Transportation, Hawaii County Council, the mayor’s office, and others supported the measure, and members discussed whether the effort could eventually expand statewide. STR 134 asked the Department of Education to provide a detailed report on the true cost of producing school meals to improve transparency and avoid unnecessary price increases. DOE said it already tracks food, labor, benefits, supplies, equipment, and other costs to calculate per-meal costs, but does not currently include transportation costs in the same way; it stated its breakfast cost was $5.80 and lunch cost was $8.66. Support testimony came from the Hawaii Public Health Institute, Hawaii Appleseed, the Hawaii Children’s Action Network, the Hawaii Hunger Action Network, and others, who said clearer cost information is especially important amid funding uncertainty. In decision making, the committee amended and passed STR 53 SD1, reverting it to the original draft by replacing the Legislative Reference Bureau with the Controller and adding coordination with the Office of Planning and Sustainable Development and the Hawaii Broadband and Digital Equity Office, while removing references tied to the LRB and the public access room outreach clause. The committee also amended and passed STR 117 SD1, shifting the lead role to the Safe Routes to School Advisory Committee and adding a request for the County of Hawaii to consider funding the effort. STR 134 was passed unamended. Representative Souza was excused for the votes.
