Committee: Senate Judiciary
Summary: The Judiciary Committee considered a long agenda of claims bills, housing and business measures, and court-administration legislation. It reported favorably several claims bills, including SB 20 for J.N., a minor, SB 14 for the estate of Pennial Janvier, SB 10 for Sidney Holmes, SB 8 for Marcus Button, SB 22 for Eric and Jennifer Miles, and SB 26 for Kristen and Leah McIntosh. Members also approved SB 520 on curators of estates, SB 386 on self-storage lien-sale notices, SB 362 on reusable tenant screening reports, SB 316 creating series LLCs in Florida, and SB 1650 and SB 1652 on vexatious litigants and related public-records issues. SB 248, expanding eligibility for private school and homeschool students to participate in FHSAA sports at public schools, also passed after amendment. Most of the claims bills were described as settled cases with amounts above sovereign-immunity limits, and several senators spoke in support of compensating victims of catastrophic injury or wrongful conviction. SB 10 drew comments about the 34 years Sidney Holmes spent incarcerated after a wrongful conviction, and SB 8 prompted discussion about the long delay in resolving Marcus Button’s injuries from a 2006 school-bus crash. SB 26 was presented as an uncontested claim arising from a DACS employee’s fatal crash that severely injured two teenage girls, and the committee adopted an amendment placing funds for the minor claimant into trust. The policy bills drew more substantive debate. SB 386 would let self-storage operators use websites instead of newspaper ads for lien-sale notices, with newspaper representatives opposing the change and storage-industry witnesses supporting modernization and lower costs. SB 362 would let renters reuse tenant screening reports for 30 days, with the sponsor saying it would reduce repeated application fees. SB 316 would authorize series LLCs while adding record-keeping protections, and SB 1650/1652 would broaden Florida’s vexatious-litigant rules and create a public-records exemption for certain stricken filings. SB 248 passed over concerns from private-school and public-education witnesses about instructional time, funding, and fairness in athletic participation. All measures were reported favorably, with recorded votes ranging from 7-2 on SB 248 to unanimous or near-unanimous support on the other bills.

Summary: The committee first waived the five-day notice rule for five House bills, then held public hearings on several measures. On Engrossed Substitute House Bill 2548, the committee heard staff and sponsor testimony on expanding health care merger notice requirements to the Attorney General, adding transactions involving majority ownership/control and asset sales, requiring public posting of notices, pausing closings until information requests are substantially complied with, and adding filing fees. Supporters, including the sponsor, the Attorney General’s Office, the Office of the Insurance Commissioner, nurses, and patient advocates, said the bill would improve transparency and oversight of consolidation and private equity in health care; the Washington State Medical Association and Washington State Hospital Association were neutral after compromise language, though the hospital association raised concern about the added fees. The hearing closed with many people signed in pro and con but not testifying. The committee then heard Second Substitute House Bill 2333, which would allow candidates and elected officials to use campaign or surplus funds to reimburse personal security expenses related to threats tied to their public roles. The sponsor and several prosecutors described personal threats and argued the bill is needed to protect public servants, while public disclosure officials said current PDC processes and the state Address Confidentiality Program already provide some protections and cautioned against over-codifying agency discretion. Some testimony urged restoring earlier address-protection provisions, while county auditors said the revised bill removed operationally unworkable redaction language and was acceptable as amended. The bill had broad signed-in support and opposition, but no vote was taken. For Engrossed House Bill 1574, staff explained the bill would expand Good Samaritan-style protections for people seeking overdose help, bar arrest or conviction for possession in those circumstances, limit related penalties and forfeiture, and allow hospitals and other health facilities to distribute public health supplies without committing paraphernalia infractions. Supporters said it would save lives and improve access to drug checking and harm reduction services, while prosecutors and law enforcement groups said the bill was too broad, especially regarding arrest limits, protection-order violations, probation/parole, warrants, and civil forfeiture. The sponsor said the bill was intended to keep people alive and encourage calls for help. The committee also heard Engrossed House Bill 2156, which would let Attorney General investigators be designated limited authority peace officers to electronically serve search warrants in economic and financial crime cases; the AGO and retailers supported it as a tool against organized retail theft and wage theft, while sheriffs and police chiefs opposed it and urged added guardrails and deconfliction with local law enforcement. Finally, on Engrossed Substitute House Bill 2320, the committee heard a bill to regulate 3D-printed and digitally manufactured firearms and digital firearm manufacturing code. The sponsor and supporters, including students, pediatricians, and a gun-violence survivor’s family member, said it was needed to address untraceable ghost guns and keep pace with technology, while opponents argued the bill was overbroad, raised constitutional concerns, and targeted files and speech rather than criminal conduct. No votes were taken in the hearing excerpts provided.

Summary: The Senate Transportation Committee heard several measures, with most of the agenda taken up by AB 1944, AB 2453, and SJR 16 after a consent calendar of eight items was approved. AB 1944 by Assembly Member Alex Lee would delay the schedule for reducing the allowable axle weight limits for zero-emission buses while keeping the final cap in place, to give transit agencies and manufacturers more time to develop lighter buses with sufficient range. Supporters, including the California Transit Association and several transit districts, said the bill would help agencies comply with zero-emission bus mandates. Opponents, led by the League of California Cities, argued heavier buses would accelerate pavement damage and increase local maintenance costs. Senators raised concerns about infrastructure impacts and environmental tradeoffs, while others supported the bill as a practical adjustment to technology timelines. The bill passed on a 10-3 vote, with the roll left open and later completed. AB 2453 by Assembly Member Michelle Rodriguez would clarify authority for first responders and peace officers to use off-highway vehicles in official duties, including limited travel on public roads to reach remote areas. The author and supporters, including the Carlsbad Fire Department and the City of Ontario, said the bill would improve response times for beaches, trails, deserts, and special events and reduce burdensome workarounds. No opposition testimony was offered. The committee approved the bill unanimously and sent it to the Committee on Natural Resources and Water. SJR 16 by Senator Caballero urged Congress to act on federal actions affecting California commercial truck drivers after a fatal crash and subsequent federal scrutiny of California’s commercial licensing practices, including English-language proficiency standards and rescinded credentials. The author and Teamsters California said the federal response had unfairly harmed experienced drivers and the supply chain. No opposition was presented. The resolution passed on a 9-3 vote, with the roll also left open and later completed. The consent calendar items were adopted 13-0.

Summary: The Medicaid Subcommittee of the Legislative Joint Auditing Committee met to receive a primer on the subcommittee’s history and on how Medicaid oversight works in Arkansas. Legislative audit staff reviewed the subcommittee’s origins in response to earlier Medicaid audit concerns and explained that Medicaid is audited every year in the statewide single audit because it is a high-risk, large federal program. Staff summarized recent audit findings, including issues with eligibility controls, data matching, contractor charging, incarcerated juveniles’ coverage handling, provider eligibility support, and the state’s Medicaid recovery audit contractor exception request. They also noted a DHS departmental audit finding involving employees who improperly received benefits, which was referred for possible prosecution. The Department of Human Services gave an overview of the Medicaid program, describing eligibility groups, delivery systems (fee-for-service, managed care/PASSE, and premium assistance for expansion adults), the size of the program, and the agency’s budget and provider base. DHS also outlined the difference between state plan amendments and waivers and said other committee materials would be sent to members. The Office of Medicaid Inspector General described its role in detecting and preventing fraud, waste, and abuse, explaining that it investigates suspected intentional fraud, suspends providers when there is a credible allegation of fraud, recovers improper payments in mistake cases, and recommends policy changes when trends are identified. The Attorney General’s Medicaid Fraud Control Unit explained that it prosecutes provider fraud criminally and civilly, handles neglect, abuse, and exploitation cases in long-term care settings, and works with DHS, OMIG, and federal partners. Members asked about where cases are filed, how provider suspensions work, whether beneficiary fraud is investigated, and how education is provided to providers. DHS confirmed that beneficiary fraud cases are referred to local prosecutors and said the expansion population will move toward community engagement/work requirements under federal changes, with a soft launch planned before full implementation. The meeting ended with no formal votes beyond adoption of the prior minutes and no other committee actions.
