KPPA explained that retirees must have a bona fide separation from service, no prearranged agreement to return, and generally a one-calendar-month break in service for retirees on or after January 1, 2024. If a member fails to comply, retirement benefits can be voided, payments stopped, health coverage ended, and benefits repaid. The presenters also noted that rehired retirees do not earn a second retirement account, and employers rehiring them must pay employer contributions and, in non-exempt cases, reimburse health insurance costs.
Members asked about the scale of rehired retirees and the difference between employer contribution and health insurance reimbursement amounts. KPPA said that in fiscal year 2025 there were over 3,500 rehired retirees in CERS and over 5,000 in SPRS, with substantial employer contributions and health reimbursement payments collected. They also explained that some positions are exempt from these chargebacks, including school resource officers and certain law enforcement positions that meet statutory criteria. The committee discussed House Bill 213, which allows cities, sheriffs’ departments, and post-secondary institutions to offer health insurance to rehired officers if authorized by the governing body, effective August 1, 2026, and clarifies the fiscal-year basis for certain exemption limits. No votes were taken.

Members asked about whether that prior program still exists and whether the working group should include the Hawaii Medical Association and Hawaii Primary Care Association; Dr. Lewin said the statute still exists but is unfunded, and that the group should be inclusive. The Department of Labor and other organizations also provided comments.
For SCR 75 SD1, which urges a coordinated interdepartmental effort to reduce fetal alcohol spectrum disorder, Dr. Lewin and others said prevention, prenatal screening, and early intervention are needed because FASD is often hidden until later problems appear. Amanda from Hawaii FASD Action Group said current implementation under Act 192 is still largely a landscape analysis and that Hawaii lacks the infrastructure and specialists for a full system. Darlene Chance Govor urged adding the judiciary as a partner so juvenile justice and probation staff can be trained and referral pathways improved, while the Department of Health said it supports prevention but prefers a broader, systems-based approach focused on child needs and upstream care. The Disability Rights Center supported the resolution and asked for an earlier reporting date.
The committee also heard SCR 149 SD1, which seeks an informal working group to address complex patients with multiple diagnoses involving substance use, mental health, or chronic physical illness. The Hawaii Substance Abuse Coalition and Ke Nui Malo strongly supported the measure, saying current siloed systems leave people bouncing between medical, mental health, and substance use providers without coordinated care, often ending up in crisis, emergency rooms, or the justice system. They said integrated residential care and a coordinated working group could improve outcomes and align with federal funding opportunities. The Committee on Education Postsecondary heard and approved CS/SB 1694, which would revise general education core standards at public postsecondary institutions to incorporate technology-related instruction. The adopted amendment shifted the bill away from creating a sixth core course and instead required technology integration within existing core courses to include digital literacy, AI tool application, and related instruction in areas such as software engineering, networks, databases, and cybersecurity as applicable. For high school computer science courses, the amendment added guidance on critical evaluation of AI results, AI limitations, and ethical use of AI. The committee adopted the amendment and then voted the bill favorably.
The committee also took up confirmation appointments on tabs 1 through 2 and, on one motion, recommended confirmation of all appointees favorably. In addition, it considered SPB 7038 on postsecondary education and workforce development, which addresses tuition and fee policies, consumer protections, career and technical education, student acceleration, and institutional operations. Members asked about dual enrollment expansion, CIE licensure exemptions, and the removal of the Classic Learning Test as a fee-waiver qualifier; staff said the dual enrollment change was intended to expand student options without necessarily increasing enrollment, the CLT removal was an error to be corrected, and a Florida Dental Association representative raised concern about preserving the long-standing exemption for dental assisting programs. The committee moved SPB 7038 as a committee bill and reported it favorably.

The Senate convened, adopted a motion by Senator Zaffirini to suspend Senate Rule 11.13 so committees could meet during the reading and referral of bills, and then proceeded to first reading and committee referral of a large number of measures. The bills covered a wide range of topics, including judicial qualifications, alcohol sales at racing facilities, health care provider participation programs, abandoned land receiverships, local mental health authority governance, school trustee employment eligibility, DFPS review procedures, groundwater district management plans, early voting by mail, contracts with companies from foreign adversaries, wastewater permitting, nondisclosure provisions involving child sexual abuse, child abuse reporting, veterans’ claims assistance, hotel occupancy tax collection by accommodations intermediaries, apprenticeship grants, Sunset Commission renaming, health care entity ownership reporting, firearms and school trespass offenses, water trust and water bank issues, construction contract trust funds and payments, Medicaid recoupment, colonia real estate contracts, epinephrine use in schools, forensic analyst apprenticeship training, online ticket sales disclosures, and public water system security incident reporting.
The chamber also received and read several resolutions, including SCR 27 authorizing burial of Guy Herman in the State Cemetery, SCR 28 urging Congress to propose a constitutional amendment on regulating money in campaigns and ballot measures, SCR 29 designating El Paso as the official boot capital of Texas, and multiple joint resolutions. Those included proposals on county tax exemptions for rainwater harvesting and graywater systems, creation of a Texas Health Care Workforce Education Fund, authorization of sports wagering, dedication of state tax revenue to the Texas Water Fund, a statewide referendum on standard time versus daylight saving time, and clarification of impeachment-trial and removal provisions for public officers. After the readings and referrals, the Senate adjourned until 11:00 a.m. Tuesday, March 11.
