Local Government (Part II) May 15th, 2025

Local Government

Summary: The Senate Committee on Local Government met with a quorum and took up a series of pending bills, mostly local-government measures. Early action included final committee approval of Senate Bill 1633 and S.J.R. 60, followed by Senate Bill 3038 and Senate Bill 3045, both reported favorably and placed on the local and uncontested calendar. The committee also considered House Bill 24, adopted a committee substitute, and reported the substitute version favorably; House Bill 2025 was likewise reported favorably and sent to the local and uncontested calendar. Members then handled several companion and local bills, including House Bill 2713 as the companion to Senate Bill 1331, which was reported favorably and placed on the local and uncontested calendar. House Bill 3348, House Bill 3370, House Bill 3505, and House Bill 4506 were each reported favorably, with no objections to local-and-uncontested placement. House Bill 5424 passed on a 6-1 vote, and House Bill 5652 passed with one present-not-voting, both also sent to the local and uncontested calendar. The committee also adopted substitutes and reported House Bill 3687 and House Bill 4205, though both were later reconsidered because the wrong script had been read. After reconsideration, House Bill 3687 and House Bill 4205 were each re-voted and reported favorably to the full Senate, with both placed on the local and uncontested calendar. Senate Bill 3071 was also reported out on a 5-2 vote after adoption of a committee substitute. The meeting ended with no further business and the committee standing at recess subject to the call of the chair.

Ethics and Elections

Bills: S1622, S1178
Summary: The committee met with a quorum present and first took up Senate Bill 1178, the Foreign Interference Restriction and Enforcement Act, sponsored by Senator Garcia. The bill would expand state restrictions on foreign countries of concern and designated foreign terrorist organizations, including creating a state registration framework for foreign agents, banning gifts to public officials from covered foreign entities, requiring ethics training on foreign influence, tightening procurement limits for information technology and critical infrastructure, restricting sister-city/sister-state encouragement, revising linkage institute rules and tuition provisions, and criminalizing certain conduct tied to foreign governments or unauthorized enforcement of foreign law. Members asked extensive questions about how the bill would affect election technology, software development, federal foreign-agent registration, educational exchanges, and the treatment of organizations such as CARE; the sponsor said the bill focused on ownership/control and foreign countries of concern, not specific components or general participation in events. An amendment by Senator Grall was adopted to clarify definitions, align penalties with willful violations, and specify that new ethics training content is additive. The committee then heard supportive testimony from Kelly Curry of State Armor and Rob Pierce of American Global Strategies, both of whom argued the bill would help Florida counter foreign influence, protect data and infrastructure, and improve transparency. CS for SB 1178 was reported favorably by roll call vote. The committee then considered Senate Bill 1622, which provides a one-time waiver of the automatic fine for a late-filed financial disclosure under specified conditions, including that the filer submitted the disclosure before the maximum fine accrued and had not previously received such a waiver. Carrie Stillman of the Commission on Ethics testified in support, saying the bill preserves transparency and compliance goals while making the fine and appeals process more workable. The bill was reported favorably by roll call vote. Finally, the committee took up confirmation hearings for appointments in tabs 3 through 26. No separate votes were requested, no public testimony was offered, and the block of appointees was recommended favorably to the full Senate by roll call vote. The meeting then concluded with no further business.

Summary: The committee first approved the minutes from the September 11 meeting by motion and voice vote. It then received a brief update on the statewide emergency responder voice system, but no presenter was present. The chair said he expected a more substantive update in November and warned that if there is not real progress on acquiring needed private properties, the committee may consider further action, including possibly freezing funding. The main discussion centered on the Department for Community Based Services’ child removal and reunification work and its structured decision-making tools. Commissioner Lisa Dennis and General Counsel Wesley Duke explained that the intake, safety, and risk assessment tools are being used at very high rates and that the department is still implementing and evaluating the system. Dennis said the tools are meant to inform, not replace, professional judgment; when staff disagree with a recommendation, the worker and first-line supervisor consult and decide together. Members questioned whether the system favors keeping children in the home, whether the department has studied safety outcomes for in-home cases versus removals, and whether foster home shortages affect removal decisions. Dennis said child safety remains the top priority, that the practice has not changed, and that the department would provide additional data on outcomes later. Members also asked about permanency timelines and delays in termination of parental rights cases; Dennis said federal timelines are difficult to meet because of family progress, substance use recovery, and court delays, and she confirmed foster parent shortages were not the reason for those delays. The committee then heard a presentation from the Department of Revenue on the new My Taxes portal. Staff said the portal, launched in March, replaced DOR’s portion of the old Kentucky One Stop Business Portal and now allows businesses to file and pay multiple taxes, update account information, and receive official notices. They reported the system is available 24/7 except for scheduled maintenance every other Thursday evening, has maintained over 99% availability since launch, and now has a dedicated contact center with 50 agents plus a public help line and email. In response to questions, the department said early downtime was caused by unexpectedly high traffic, but server capacity was increased and in the last three months there had been only one day of unexpected downtime.

Bills: SB23, SJR85
Summary: The Senate Committee on Local Government heard testimony on Senate Bill 23 and its companion constitutional amendment, Senate Joint Resolution 85, both by Senator Bettencourt. The bills would increase the additional homestead exemption for elderly and disabled homeowners from $10,000 to $60,000, which proponents said would significantly reduce property taxes and help seniors and disabled Texans age in place. Bettencourt and supporters described the measure as part of a broader property tax relief package, estimating combined savings of about $950 for over-65 and disabled homeowners when paired with other recent homestead exemption changes. Witnesses largely supported the proposal. Testimony in favor came from a lawyer, a private citizen, Texas Realtors, the Texas Silver-Haired Legislature, and the Texas Association of Builders, all emphasizing relief for fixed-income seniors, housing stability, and the ability to remain in their homes. Several witnesses noted rising property taxes, medical costs, and the challenges seniors face in moving or affording home modifications. One witness from Every Texan said a flat homestead exemption is the most equitable way to cut property taxes, but argued against additional tax cuts generally, favoring a circuit-breaker approach and warning that permanent tax cuts could reduce funding for schools and other needs. The committee also discussed data showing many over-65 homeowners already pay no school property taxes in some counties and that the proposed changes would increase that share. After closing public testimony, the committee voted on the measures. Senate Bill 23 was reported favorably to the full Senate by a 7-0 vote, and S.J.R. 85 was also reported favorably by a 7-0 vote. The transcript also shows Senate Bill 898 being laid out and passed unanimously earlier in the meeting, with a recommendation for the local and uncontested calendar.
