Summary: The committee held a public hearing on HB 135, introduced by Representative Michael Harrington. He said the bill would codify a portion of the New Hampshire Constitution to bar New Hampshire businesses from being required to collect sales or use taxes for other states unless Congress mandates it, arguing that the U.S. Supreme Court’s Wayfair decision created an onerous compliance burden for businesses. He described the patchwork of state and local sales tax rules, thresholds, and product exemptions as extremely complex and said the bill was intended to push the issue back toward Congress and the courts. Members questioned whether the bill’s reference to a “foreign government” would apply to other U.S. states, whether the proposal would conflict with the Supremacy Clause, and whether it would create standing for businesses to challenge Wayfair. Harrington responded that “foreign government” meant any government other than New Hampshire, that he believed the state could challenge the decision in court by passing a law contrary to Wayfair, and that businesses were already being harmed by compliance costs. Some members raised concerns about whether the bill was an unfunded mandate or simply a private compliance burden, and Harrington argued that the state itself would not be collecting the taxes, but businesses would still face recordkeeping and administrative costs. Sam Garland of the Department of Justice then testified. He said the department was not taking a formal position on the bill, but offered technical comments. Garland acknowledged that Wayfair created significant compliance burdens and noted that states have become somewhat more uniform, with all states now having a $100,000 economic nexus threshold, though not all use the 200-transaction threshold and local tax variation remains substantial. He said the department’s concerns were legal, describing the issue as uncharted constitutional territory involving both vertical and horizontal federalism. No vote or final action was taken during the hearing.

Summary: The Senate took up several committee reports and House and Senate bills, including a proposal to repeal archaic law criminalizing pregnancy, which was referred to the Judiciary Committee, and Senate bills designating October 15 as Pregnancy and Infant Loss Awareness Day, which were advanced through procedural steps. The chamber also passed to be engrossed local and special legislation, including changes to the Tewksbury town charter, a Boston Police Department age-waiver bill for Lewis Cabral, a Nantucket charter bill making the county charter gender neutral, and a sick leave bank bill for Sally DeRosia of the Department of Correction. The Senate also suspended Joint Rule 12 on a House petition concerning the taxation of certain foreign government pensions and referred it to the Committee on Revenue. In addition, the Senate adopted an emergency preamble for a Warren election-validation bill. The chamber then considered final passage of several bills, including measures affecting the Cotuit Fire District, the Historical Society of Sandwich and Cotuit, and the Salem licensing board compensation, all of which were enacted and sent to the Governor. A separate election-validation bill for Bourne required a two-thirds vote and was enacted by standing vote, with two members in favor and none opposed. The session also included a motion to adjourn in memory of Ralph Edward Pascarelli, which was adopted after a brief tribute and moment of silence. The Senate then adopted an adjournment order and recessed until the next formal session.

Summary: The Senate Judiciary Rules Committee approved the minutes from its January 26, 2026, and February 4, 2026, meetings without objection. The committee then heard four RS requests from members of the Administrative Office of the Courts and senators, with no public testimony taken. Jason Spillman presented RS 33146, a court-initiated cleanup bill to remove an outdated reference to a no-longer-existing court rule in the mediation statute, and RS 33147, which would establish a statutory priority order for distributing partial payments in Juvenile Corrections Act cases. Both measures were described as ways to clarify court procedures and align payment handling with legislative direction. The committee moved both RSs to print. Senator Ben Taves presented RS 33394, a transparency proposal requiring labeling for products sold in Idaho that used fetal tissue in research or production. Senator Ricks said he would support printing it, and Senator Wintrow noted she expected debate on the benefits of biomedical research if the bill advanced. The committee voted to print the RS, with Senator Wintrow recorded as voting nay. Senator Dan Foreman presented RS 33405, which would require ignition interlock companies to notify the Idaho Transportation Department when a device is installed and prosecutors when a vehicle is prevented from starting, in order to improve accountability and track DUI-related court requirements. The committee moved the RS to print, and then adjourned after completing the agenda.

  • I know it's been a long time, but I would imagine as a parent that never leaves you.
Summary: The Special Committee on Tourism met in executive session and approved two bills. House Bill 1756, described as related to “June’s week,” passed unanimously 9-0 after brief discussion. House Bill 1828, which provides funds for memorials and museums dedicated to veterans, also passed unanimously, 12-0. The committee then opened a public hearing on House Bill 2845, sponsored by Representative Lisa Durnell, to designate a memorial bridge for Jared Bennett near Willow Springs. Durnell explained that Bennett died in a 2002 automobile accident, that his family maintained a memorial and stretch of roadway through MoDOT’s Adopt-A-Highway program for years, and that the bridge naming would honor his memory with signage paid for by private funds and no fiscal note. Jared Bennett’s father, Craig Bennett, testified in support and shared personal stories about his son, including his love of fishing. Committee members offered condolences and supportive comments, and one member requested copies of written stories about Jared for the record. No one testified in opposition, and the hearing on House Bill 2845 was closed with no further business.

Summary: The Senate Health and Welfare Committee considered and advanced four RS drafts to print. RS 33228, presented by Senator Cook, would establish a rural health transformation oversight committee to manage and monitor Idaho’s rural health transformation funds; he explained the only change from a prior version was committee composition, increasing legislative appointees to three senators and three House members, plus one nonvoting gubernatorial appointee, while still requiring at least three rural appointees. The committee asked a few questions about the membership changes, then moved and approved the RS for printing. Senator Blaylock presented RS 32891 as a code cleanup measure with no policy change, updating and removing obsolete provisions related to the Petroleum Clean Water Trust Fund, including outdated board appointment and distribution language. The committee had no substantive questions and voted to send it to print. Senator Galloway then introduced RS 3301C1, which would make technical corrections to foster care law, remove the two-month hearing requirement for youth ages 18 to 23 in extended foster care, and expand expedited placement to include kin as well as relatives; she said the changes would help place children more quickly and had no fiscal note. The committee approved that RS for printing as well. Finally, Senator Wintrow presented RS 33161, which directs the Department of Health and Welfare to study and make recommendations on Medicaid for Workers with Disabilities, specifically whether the program should allow participants to keep working beyond age 65 without losing coverage or facing a steep cost increase. She described the issue as affecting a relatively small number of people but one that could create a major affordability cliff for workers with disabilities, and said the bill would require a report by December 1. After questions about how the proposal relates to Medicare and whether other states do similar things, the committee moved and approved the RS for printing. The meeting then adjourned.

Committee: House State Affairs
Summary: The House State Affairs Committee first heard RS 33104, a proposal to revise temporary rule procedures. The sponsor said it was the same concept as a bill from the prior session that passed the Senate 35-0 but did not finish the process, and explained that the measure would require a statement of necessity for temporary rules and limit repeated reissuance after legislative rejection. The committee moved to introduce RS 33104 and approved that motion without objection. The committee then considered RS 32976 C1, a bill aimed at protecting minors from harmful effects of social media. The sponsor argued that addictive platform features contribute to youth mental health problems, including suicide and bullying, and said the bill is intended to let parents control children’s online access while surviving First Amendment challenges. Members asked about the age threshold in the draft, and the sponsor explained the original choice of 15 as a child age benchmark tied to driving age and other Idaho law. Representative Mickelson moved to introduce the bill with all references to age 15 changed to 16, and several members spoke in support, saying the state has protected children physically but not adequately in the cyber world. The sponsor described the bill’s mechanics as requiring large social media platforms to verify a child’s age and use their targeting technology in a way that protects minors. The committee approved the motion to introduce RS 32976 C1 with the age changes, and then adjourned.
