The audit reviewed the mandatory reporting system for insurance claims tied to past-due child support, noting that collections increased after the law took effect in 2022, but that some eligible claims still are not being reported. Auditors said DCS learns about roughly 1 in 10 claims through other channels, and that insurers may miss reporting because they are unaware of the law, make administrative errors, or misunderstand the $500 threshold and timing requirements. The audit recommended that the Office of the Insurance Commissioner help educate insurers by adding information to its website and sharing insurer contact contacts with DCS, and also recommended that the Legislature amend the law to create monitoring and enforcement authority. The auditor said neither DCS nor OIC currently has authority to monitor compliance or take action against noncompliant insurers, though other states use insurance regulators or market conduct exams for this purpose. Committee members asked about possible coordinated enforcement between DSHS and OIC, which the auditor said was beyond the scope of the audit but could be considered by the Legislature. An OIC representative said the commissioner is willing to help educate insurers, post information on the OIC website, and share contact information with DSHS, and that the agency is open to further discussion. Summary: The House Committee on Public Health heard House Bill 5, a proposal to ban THC products outside the Texas Compassionate Use Program while allowing non-intoxicating CBD and CBG products under tighter regulation. Chair Van Deaver gave a lengthy background on the 2018 federal Farm Bill and Texas’s 2019 hemp law, arguing that the lack of guardrails allowed a large, unregulated THC market to develop. HB 5 would impose licensing fees, product registration, testing and inspection requirements, and restrictions intended to keep products away from children. Invited witnesses from law enforcement strongly supported the bill. Steve Dye of the Texas Police Chiefs Association and Brian Hawthorne of the Sheriffs’ Association of Texas argued that THC consumables are widely mislabeled, often far more potent than advertised, and linked to youth access, impaired driving, and organized crime. Both said regulation would be ineffective and would amount to legalization, while a ban would be easier for officers to enforce. They also emphasized support for the Texas Compassionate Use Program and said medical THC should remain available. Dr. Peter Stout of the Texas Association of Crime Lab Directors and Alice Amelot of Texas DPS testified as resource witnesses about forensic testing. They said current lab resources are already stretched thin, that quantitative testing for THC and related cannabinoids is expensive and time-consuming, and that a ban would simplify enforcement because labs could focus on presence/absence testing rather than concentration. Amelot said DPS labs are neutral on the bill but explained that mislabeled products and inaccurate certificates of analysis are common. Committee members asked about traffic safety, impairment, youth use, and the costs of enforcement and lab testing; witnesses repeatedly said the bill would reduce complexity for law enforcement but that any approach would still require more resources for labs.

He explained that crisis intervention funding is carried in a continuously appropriated, non-lapsing account and that some budget lines were reclassified, including software and janitorial services, to reflect actual spending needs. Members asked about national standards, the different academy tracks, crisis intervention funding, maintenance and contract changes, temporary positions, and the court security training program. The agency said it coordinates with national peers through IADLEST, that the part-time and corrections academies are longstanding programs, and that the new court security academy can be delivered either as a full academy or as in-service training depending on resources. The director also said the agency has been running extra full-time academies because of high vacancy rates, but expects to return to three full-time academies this year, with two corrections academies and one or possibly two part-time academies. He also explained the current approach to misconduct records and public disclosure, saying sustained findings under RSA 106-L are heard by the council and published, replacing the older, less standardized exculpatory list process.
