Summary: The Committee on Banking and Insurance met with a quorum present and took up a series of bills, beginning with SB 1286 by Senator Wright. That bill expands the law enforcement recruitment bonus program to include firefighters, creates a DFS grant review panel for fire-related grants, and establishes an institute for PTSD and first-responder behavioral health. Testimony from fire chiefs and others supported the measure, and the committee reported it favorably. The committee then considered several insurance and financial regulation bills. CS/SB 198 by Senator Rousan, as amended, regulates virtual currency kiosks with transaction limits, notice and receipt requirements, and OFR enforcement authority; witnesses described it as a needed anti-fraud measure, especially for seniors, and it was reported favorably. CS/SB 772 by Senator Burgess, as amended, allows limited licenses for portable electronics and eyewear insurance, and CS/SB 1504 by Senator Claudio, as amended, creates a pathway for high school students to qualify for insurance customer representative licensure; both were reported favorably. The committee also approved two cryptocurrency reserve bills by Senator Gruters: CS/SB 1038 creates the Florida Strategic Cryptocurrency Reserve framework, and CS/SB 1040 creates the related trust fund; both received technical amendments and favorable reports. CS/SB 1440 by Senator Martin, as amended, creates public records exemptions and cybersecurity reporting provisions for financial institutions and related entities, and it was reported favorably. Finally, SB 1668 by Senator Burton, which updates the NICA program’s funding and benefit structure, and CS/SB 570 by Senator Polsky, which creates a task force on payment scams, were both heard with supportive testimony and reported favorably. Senators later recorded additional affirmative votes on selected bills before the committee adjourned.

Summary: The Senate Business and Insurance Committee met and first laid over Senate Bills 1969 and 1624 without hearing them. It then considered SB 1953, a health insurance transparency bill requiring third-party administrators to provide employers information on what was spent on employee health benefits; an amendment deleting the word “welfare” was adopted, and the bill passed 7-1. SB 1277, which codifies a three-week work-search requirement for unemployment benefits, passed 8-0. SB 1287, amended to change “may” to “shall,” would bar the Oklahoma Abstractors Board from licensing applicants not legally authorized to work in the U.S.; after questions about the need for the bill and the alleged loophole, it passed 7-2. The committee also passed SB 1061, a cleanup measure on mortgage broker licensing and renewal fees, and SB 1916, which would move the Oklahoma Receivership Office under the Insurance Department and streamline receivership operations. SB 1589, as amended to reference Indian Gaming Regulatory Act authorization, would increase penalties for illegal sweepstakes/gambling operations and expand enforcement against entities profiting from illegal gambling; it passed unanimously. SB 2178, a compromise special-event license bill requiring liability insurance coverage, also passed unanimously. Two major insurance reform bills were debated at length and failed. SB 1444 would shift homeowners insurance rate regulation from a use-and-file system to prior filing with authority for the Insurance Commissioner to declare rates excessive; after testimony from a homeowner about a large premium increase and extensive debate over regulation and market effects, it failed 4-5. SB 1438 would require reporting of underwriting gains and profits, cap average profits at 5% over three years, and require rebates or premium credits if profits exceeded that level; supporters argued it would protect consumers, while opponents warned of market disruption and reduced competition. It failed 2-7. The committee then passed SB 1501, clarifying medical marijuana grow reclamation bond requirements, SB 1873, correcting a drafting error in a prior bill and delaying its effective date, and SB 1364, requiring an affidavit of encumbrances before transferring a medical marijuana business license.

Bills: HB2, SB145, SB143
Summary: The committee first heard Senate Bill 143, which would raise caps on certain agriculture fees so they can keep pace with inflation. Senator Woods explained that the bill only adjusts fee ceilings, not automatic increases, and an amendment was adopted to tie the caps to the Consumer Price Index for All Urban Consumers published by the U.S. Department of Labor. There was no public support or opposition testimony, and the bill was then passed on an 8-0 do-pass vote, with several members excused. The committee then took up Senate Bill 145, which would change the state audit system by raising thresholds for smaller local public bodies and creating a statewide federal single audit for state agencies. The State Auditor and DFA said the bill was intended to streamline audits, reduce delays, and align New Mexico with federal rules and other states, but multiple CPA and audit witnesses opposed the statewide single-audit concept, warning it could reduce transparency, weaken accountability, and increase the risk of fraud, waste, and abuse. Committee members pressed for clarification on how the audit structure would work, which agencies would be covered, and whether DFA or independent auditors would conduct the work; the sponsors said amendments were needed to clarify the bill and remove problematic language, including the appropriation and references to gifts and donations. The committee adopted an amendment striking the appropriation language and then continued questioning without taking final action in the excerpt. The final portion of the meeting shifted to the House Bill 2 budget presentation. Committee members reviewed the Senate Finance version of the budget, which included about a 2.7% increase in recurring spending, 30% reserves, and major investments in health care affordability, early childhood, public education, housing, clean energy, water, and agriculture-related priorities. Members asked about water testing needs, water settlement funding, career technical education funding, and the contingency fund/disaster reserve structure. The presenters said some items still needed technical work and that additional adjustments would be made before final passage.

Summary: The committee considered several House bills dealing with family law and civil procedure. House Bill 1916, concerning a court’s jurisdiction in suits to divide property not divided on dissolution of marriage, was reported favorably on a 4-0 vote and recommended for the local and uncontested calendar. House Bill 1973, addressing proof of the identity of a child’s parents in a suit affecting the parent-child relationship, was also adopted with a committee substitute, reported favorably 4-0, and sent to the local and uncontested calendar. House Bill 2524, on recovery of fees, court costs, and expenses in family law proceedings, and House Bill 2530, on special appointments in suits affecting the parent-child relationship, each received favorable 4-0 votes and were likewise recommended for the local and uncontested calendar. The committee then took up House Bill 3180, which was reported favorably 4-0 and recommended for the local and uncontested calendar. The most detailed discussion centered on House Bill 40, relating to updates to business courts. Senator Hughes explained a committee amendment that made conforming changes requested by the Finance Committee and removed language creating two new judgeships, replacing it with a different judge allocation. The amendment was adopted, the amended committee substitute was adopted, and the bill was reported favorably on a 4-0 vote and sent to the local and uncontested calendar. At the end of the meeting, members briefly clarified procedural details about the House Bill 40 amendment and then closed out the agenda. The committee also noted a correction to an earlier reference to Bartleby the Scrivener, and the Chair recessed the Committee on Jurisprudence subject to the call of the chair.
