Summary:
The House Judiciary Committee opened a hearing on House Bill 148, with the chair limiting testimony to two minutes and asking for no outbursts so the committee could get through eight bills that day. Representative Kofalt, the prime sponsor, said HB 148 was the same as last year’s HB 396, which passed both chambers but was vetoed by the governor. He explained the bill would allow, but not require, separation by biological sex in bathrooms, locker rooms, houses of correction, and certain athletic competitions, leaving local school boards and administrators discretion to set policies. Committee members questioned the lack of a definition of “biological sex” and how the bill would be applied. Kofalt said he did not think a definition was necessary because males and females are generally understood, and he said the bill would give local policymakers latitude to make practical rules. He also said the bill was intended to address situations where people might misuse transgender claims to access spaces inappropriately. In response to questions, he said he was aware of issues in Kearsarge, Milford, and Mascoma school districts and had heard of discomfort in the State House, though he did not know all the details.
Several opponents testified that the bill would discriminate against transgender and non-binary people and create enforcement problems. Executive Councilor Karen Hill said the bill would roll back New Hampshire’s anti-discrimination protections and conflict with the state’s Live Free or Die values. Alice Wade, a trans woman, said she had used women’s restrooms without incident and argued the bill would invite invasive enforcement and harassment. Representative La Selig said the bill was discriminatory and that bathroom concerns were being confused with unrelated harassment by cisgender males. Betsy Harrington supported the bill, citing a girls’ soccer game at Kearsarge that she said was disrupted by a boy playing on a girls’ team. Rosie Emer and her child testified against the bill, saying bathroom restrictions would increase anxiety and risk for trans and non-binary children. Stephen Scaer and Wendy Stallings supported the bill, arguing sex is biologically fixed and that excluding males from female spaces should not require genital inspections. No vote or final committee action was taken in the portion of the hearing provided.

Amendment A10 proposed a more detailed, data-driven framework for the moratorium and included a provision about refunds after implementation; department staff said the language would add cost and would require technical assistance, while senators emphasized the need to address licensure backlogs and avoid making provider delays worse. A10 was approved by the committees, though not unanimously.
Amendment A11 would have set standards for how the commissioner designates provider types or program areas as moderate or high risk, with added transparency criteria. The department said the commissioner already has that authority and raised concerns about federal requirements and the state’s corrective action plan, and Senator Hoffman withdrew the amendment. Amendment A12, offered by Senator Fateh, would preserve remote supports by removing bill language that repealed the service and would add safeguards for remote overnight supervision, including staffing ratios to ensure emergency response times can be met. Several senators supported keeping remote services as an important, cost-effective option amid workforce shortages, while the department said it had program integrity concerns and supported the governor’s proposal to remove the service. The committee nevertheless advanced A12, with members noting the need to balance safety and integrity with access to services.

Summary:

The main floor activity centered on a series of motions to send withdrawn executive appointments back to their originating committees under Senate Rule 8.2. Senator Putnam moved to return appointments from the Agriculture, Veterans, Broadband, and Rural Development Committee, including the Board of Animal Health, the Veterans Affairs commissioner, and the Rural Finance Authority. Opponents, mainly Republicans, argued that sending the appointments back without floor action avoided accountability and transparency, especially in light of fraud concerns in state programs and agencies. Some authors said hearings had not yet been scheduled or that the committee process should come first; others noted at least one hearing had already occurred on a health nomination. The debate repeatedly focused on whether the Senate was fulfilling its constitutional role or delaying confirmation review.
Roll-call votes were requested on the appointment motions. The Putnam, Swadzinski, Her, and Wicklund motions were each adopted by narrow 34-33 margins, returning the appointments to committee rather than leaving them on the confirmation calendar for floor action.

Staff suggested the General Assembly may want to clarify what counts as administrative cost in statute. Members asked about investment returns, local fire department funding, and whether training documentation is required; staff said some of those topics were outside the study scope and that IFSAC testing relies on chief certification that a candidate is ready to test.
Representatives from the Fire Commission then responded, saying they agreed with the report’s recommendations and would work to clarify the 5% issue with legislators and KCTCS. They explained that the reduction in training hours was intended to remove electives, better align with NFPA standards, and address the difficulty volunteer departments have in getting members to complete lengthy training. Commission officials said training is documented through rosters and annual compliance reviews, and that IFSAC-certified firefighter testing is based on demonstrated skills rather than a required number of training hours. They also said the difficulty in tracking the second 5% cap stems from the way KCTCS’s PeopleSoft system records reimbursements as single transactions, making it hard to isolate administrative costs by program.

The House resumed consideration of H.606 on firearm procedures and first took up Section 3 and its effective dates. H.816, regulating the use of artificial intelligence in the provision of mental health services, also passed, as did H.927, technical corrections for the 2026 session.
The House then took up H.930 on chronic absenteeism. The committee member from Manchester described the bill as an AOE proposal responding to high post-pandemic absenteeism rates and their impact on learning, and outlined provisions adding definitions, updating compulsory attendance language, requiring a state model policy, strengthening notification and truancy procedures, and preserving existing penalties. The member said the Education Committee heard from a wide range of education and child welfare witnesses and passed the bill 11-0. After a brief clarification on the absences section, the House proceeded toward third reading of H.930.
