The committee also heard AB 376, which would exempt wildfire settlement payments from state income tax for certain disaster survivors; supporters from rural counties said the money is meant to help victims rebuild and should not be taxed, and the bill was referred to suspense. Finally, AB 480 would allow developers using low-income housing tax credits to switch from allocated to certificated state credits after an award, with supporters saying it would maximize private investment and stretch housing dollars further; it too was sent to suspense. Later, AB 50, allowing Medi-Cal enrollees to access over-the-counter contraceptives without a prescription, passed 67-0 urgency and 67-0 overall; AB 55, streamlining alternative birth center licensing, passed 68-0; AB 596, protecting workers’ right to wear masks or respirators unless there is a direct safety hazard, passed 53-8; AB 631, requiring animal shelters to post intake and outcome data, passed 60-0; and AB 792, allowing consolidated negotiations for court interpreter contracts, passed 52-1.
The Assembly also passed AB 867, banning cat declawing, by 68-0 after bipartisan support; AB 1089, expanding local permitting authority for Western Joshua Tree projects, by 16-0; and AB 1154, clarifying ADU rules, by 63-1. SCR 57, proclaiming Dolores Huerta Day, was adopted 66-0. The second-day consent calendar was then adopted 71-0. The session concluded with adjournment-in-memory remarks for Mary Hammer, a longtime San Lorenzo Valley community leader and environmental advocate, followed by recognition of her family and friends in the chamber.

Representative Bojanowski asked why foundational reading skills are not directly assessed on the third-grade KSA; KDE responded that the assessment is designed to measure end-of-grade expectations, while screening and diagnostics are used earlier to identify decoding needs. Representative Gel asked about early childhood supports, and KDE said it is working with early learning and special education offices and promoting LETRS professional learning for both teachers and preschool educators.
The committee then received the mathematics improvement committee report. KDE said the mathematics committee unanimously approved a new strategic plan for improving math achievement from pre-K through grade 20 and adult education. The plan centers on six priorities: student empowerment, effective mathematics teaching and learning, continuous educator development and growth, a continuum of learning, community and family partnerships, and teacher recruitment and retention. KDE said the plan is intended as a living document with goals, recommended actions, and evidence bases, and that it aligns with the Kentucky Numeracy Counts Act by supporting high-quality instructional resources, professional learning, and family resources. In response to Senator Thomas, KDE explained that the professional learning recommendation means districts should tailor teacher training to classroom needs and instructional materials so math teachers are better equipped to implement standards and support students.

She also raised concerns about the March 1 reporting deadline, the proposed uniform accounting language, aggregate excess insurance, examination costs being charged to the program, and confidentiality provisions that she argued may conflict with right-to-know principles for public entities. She urged the committee to slow down and consider a study committee or more time for review, saying the regulated entities were not adequately involved in drafting the proposal.
Chairman Hunt and the department responded that the bill is intended to create a licensure-based regulatory model, similar to other licensed industries, and that the pooled risk management program would be exempt from producer licensing while anyone else selling or negotiating such coverage would need a producer license. The department said failure to comply would be handled through an administrative licensing process, with denial or nonrenewal of a license and appeal through the department process. On the reporting deadline, the department said March 1 is a standard filing date used for financial analysis and that the filing can be the most recent annual report, regardless of fiscal year end. They also explained that the confidentiality language was taken from existing RSA 5B, that aggregate excess insurance was included as a solvency measure, and that the draft was intended to preserve familiar language while adapting it for pooled risk programs.
The discussion did not include a final vote or formal action on the bill in the portion provided. The committee appeared to be compiling follow-up questions for the insurance department and considering whether additional revisions or a slower process would be needed before moving the bill forward.
