Summary:
The Medicaid Oversight Board met on March 9 with a quorum present and no minutes to approve. The chair reordered the agenda to hear House Bill 689 first. Representative Amy Neighbors presented HB 689, which would authorize Kentucky to seek CMS approval for a Medicaid state-directed payment program for physician and non-physician professional services delivered through qualifying hospital-affiliated groups, beginning January 1, 2026, with retroactive payments for that year. She said the bill is intended to improve access to care in rural and underserved areas, support workforce retention, and generate about $29 million annually in federal Medicaid funds without using general fund dollars. Representatives from Owensboro Health and St. Elizabeth Healthcare testified in support, describing staffing and subsidy pressures, lower Medicaid and Medicare reimbursement, and the importance of the program for maintaining access and quality in rural and safety-net settings. Committee members noted the bill had already passed the House Health Services Committee unanimously and discussed broader concerns about Kentucky’s low reimbursement rates and the need to consider other systems not covered by the proposal.
The board then heard Senate Bill 2011 from Senator Donald Douglas and Cody Hunt of the Kentucky Medical Association. The bill would address a Medicaid coding issue by ensuring that coverage limits do not reduce payment to fewer than two evaluation and management service units per provider, per patient, per day. Douglas argued the current one-visit, one-issue limitation forces multiple visits, increases no-shows, and prevents providers from treating the whole patient. Hunt explained that the bill is meant to correct a longstanding regulation that limited E&M services to one per physician per recipient per date of service, which can prevent providers from coding additional medically necessary work during the same visit. He said DMS has already filed a regulatory amendment to fix the problem, but a statutory change is still needed to prevent the issue from returning. He also said the bill is not intended to change reimbursement policy, only coding rules, and that MCO payment practices vary.
Members generally supported the concept. Senator Berg asked about fiscal impact and private-payer billing; Hunt said there should be no fiscal impact because the bill does not change payment policy, only coding. Representative Moore said the proposal could reduce costs and improve convenience by avoiding extra visits. Chairman Meredith said the bill illustrated problems with fee-for-service care and supported moving toward a more holistic delivery model. Dr. Schuster raised a drafting concern about the bill summary language, and Hunt responded that the regulatory amendment should address the issue generally for providers. No votes were taken on either bill during this portion of the meeting.

The Disaster Prevention and Resiliency Task Force met with a quorum, adopted the minutes from the previous meeting, and heard a presentation from Western Kentucky University’s Disaster Science Operations Center. WKU described its multidisciplinary disaster science effort, including meteorology, emergency management, the Kentucky State Climate Center, the Kentucky Mesonet, and the Disaster Science Operations Center, which was created in 2021 and serves as an operational hub for forecasting, emergency planning, crisis management, training, and decision support. Speakers emphasized applied learning, student field work, partnerships with industry and event venues, and a five-year NSF/UK-led research project focused on weather hazards, disaster preparedness, and building a statewide disaster database to improve mitigation and resilience. Members asked about flooding, the relationship to EKU’s program, Tennessee’s capabilities, and the timeline and goals for the research project; WKU said the data collection is underway and that the evidence suggests tornado risk is shifting east and occurring more at night.
A WKU graduate student also described the value of hands-on storm-chasing and operational forecasting experience, saying it helped prepare her for work in forecasting and emergency management. Members asked about her motivation for joining the program and about the practical realities of storm chasing. The discussion also touched on whether Kentucky’s tornado risk is shifting east; WKU said the evidence from tornado observations and other studies points in that direction, with added concern about nighttime events and communicating warnings to vulnerable communities.
The task force then heard from Amy Shaquinn of the Mayfield Graves County Long-Term Recovery Group, who outlined the county-level recovery process after the 2021 tornadoes. She said Kentucky ranks among the top states for federally declared disasters, has seen a high number of tornadoes in recent years, and also faces major flood risk and earthquake concerns along the New Madrid fault. Shaquinn stressed the distinction between immediate response and long-term recovery, explaining that response covers rescue, cleanup, temporary housing, and short-term assistance, while recovery is the longer effort to restore survivors to safe, sanitary, and secure housing through local long-term recovery groups. She said community-led recovery is essential and that preparedness and mitigation follow once immediate recovery needs are addressed.

Summary:
The Health Finance and Policy Committee heard testimony from the Minnesota Hospital Association and several hospital leaders about the financial strain facing hospitals across Minnesota. The association’s CEO said hospitals are essential 24/7 safety-net providers, but rising labor, supply, technology, and drug costs are outpacing reimbursement from Medicaid, Medicare, and commercial payers. He warned that many not-for-profit hospitals are struggling, that workforce shortages remain significant, and that the committee should consider help on Medicaid rates, discharge/boarding problems, mental health services, workforce development, protecting the 340B drug discount program, and avoiding new mandates that add costs.
Relle Schultz of Winona Health described a community hospital with a 49-bed facility and long-term care services that has faced years of losses, including a $17 million loss in 2023 and $12 million in losses the following year. She said government payers now make up about 65% of the hospital’s mix, and each 1% increase in that mix costs about $1 million. She highlighted the difficulty of sustaining services such as dialysis, which was nearly closed until a local donor provided $3 million to keep it open for three years, and she emphasized the importance of 340B savings and the need for higher Medicaid payments.
Carrie Mulski of Riverview Health in Crookston said critical access hospitals are also under pressure despite their federal designation. She explained that federal support has eroded, that Medicaid and other public programs do not cover full costs, and that her hospital’s 340B savings help keep the doors open. She said Riverview opened a new hospital in 2020 but was hit by the pandemic and inflation, leading to annual losses of $5 million to $6 million and a negative operating margin of 9% to 10%. She also described bond covenant problems, low cash on hand, the prior closure of the nursing home, and the need for rapid state action to stabilize rural hospitals and preserve access to care.

The Senate opened with the Pledge of Allegiance and then took up two local bills for final passage: House No. 2320, establishing an appointed treasurer-collector in Berkeley, and House No. 4136, further regulating stabilization funds in Leicester. Both bills were approved to be enacted and sent to the Governor after being signed by the President.

Several Senate orders from Senator Rodrigues were then adopted, advancing bills related to disposable menstrual products, menstrual product ingredient disclosure, the move over law, and use restrictions for the Foxborough State Hospital. Each order required suspension of Senate rules and placed the measures on the Orders of the Day for later consideration with Ways and Means new drafts pending where applicable.
Before adjournment, the Senate adopted an order setting the next meeting for Tuesday at 11:00 a.m. and dispensing with the printing of a calendar. The Senate then adjourned.
