Summary:
The Information Technology Oversight Committee met with a quorum, approved the prior meeting minutes, and then heard a presentation from Leadcore representatives Jimmy Bird, Mike Murray, and Rebecca Moss on the Kentucky Wired network. Leadcore described its role as the design-builder and service provider under the KCNA contract, saying the network was built with roughly 13,200 feet of fiber, mostly aerial, and that the use of non-armored cable was a Kentucky-side decision made to reduce cost. They also said aerial construction and non-armored cable increase maintenance challenges, including storm damage and squirrel-related damage, and reported FY25 service activity of 104 break-fix events, 30 maintenance replacements, 64 storm-damage events, and nearly 13,000 feet of fiber replaced to date.
Committee members questioned whether the original project anticipated this level of replacement and whether any forecast existed for maintenance under non-armored cable. Leadcore said it did not do a formal forecast and could not say whether the replacement rate was above or below norms, though it acknowledged the decision not to use armored cable came from the Kentucky side of the contract. Members also asked about whether replacements caused network degradation; Leadcore said it tries to replace cable at existing splice points to avoid degradation and, where needed, uses armored cable for replacement sections going forward.
The committee then explored Leadcore’s relationship with Excel and KCNA. Leadcore said it has a service-level agreement for KCNA-related fibers but not for dark fibers used by Excel, and that Kentucky Wired fibers get priority on service requests. It said outages are reported through a 1-800 number and that it was not aware of any access problems to the huts. On the tech refresh, Leadcore said its understanding is that maintaining the network is its responsibility, but the technology refresh is not; it said only a very limited amount of refresh has occurred and that this did not match the original contract intent. Leadcore also said it had not been asked to defer maintenance. The chair closed by saying the testimony would inform a committee report and that he intended to recommend clawing back or withholding some previously authorized Kentucky Wired and refresh funding until an audit is complete, with the committee to vote on a report later.

The Senate Higher Education Committee met on May 5 and considered 12 bills, with most measures relating to higher education administration, student services, and professional licensing. The committee advanced a rural teacher loan repayment program for teachers serving underserved rural areas, a SUNY/CUNY mental health staffing requirement, a bill allowing SED access to patient or client records in professional misconduct cases, an AI-in-therapy regulation bill, cross-profession supervision for certain mental health professionals, an extension of limited permits for social workers, continuing education requirements for acupuncturists, and updated supervision rules for physical therapy assistants. One bill reorganizing SUNY police was held for further negotiations with SUNY, SUNY police, and stakeholders.
Two Article 7, Section 2, subdivision E motions for committee consideration were taken up. Senator Rose’s bill to withhold financial aid from SUNY or CUNY institutions that permit organizations designated as terrorist organizations was defeated after several senators voted no or without recommendation. Senator Kanzanari Fitzpatrick’s bill requiring anti-Semitism awareness training, incident reporting, and compliance with state reporting rules for higher education institutions was approved and sent to the Codes Committee, with some senators voting without recommendation because they viewed the subject as already covered by existing law.
The committee also reported Senator Rivera’s nurse practitioner conformity bill to the floor, and several other bills were reported either to the floor or to Finance depending on their fiscal impact. Most measures were approved without opposition, though some senators voted without recommendation on bills they said overlapped with existing statutes or prior legislation. The meeting adjourned at 10:52 a.m.

Summary:
The committee opened with routine business, including the Pledge of Allegiance, seating alternates, and approval of the minutes and consent calendar. Both were approved without opposition. The committee then moved to the regular calendar, beginning with Department of Environmental Services drinking water rules (2532). Staff noted that the final proposal deleted requirements that had been in the initial proposal, making the published notice technically inaccurate because it said there were no substantive changes. The agency responded that the requirements still exist in other rules, that regulated entities and the Water Council were notified, and that the public had notice through related hearings. After discussion about whether a new noticed hearing was needed, the committee approved the rule.
The next item was Department of Administrative Services personnel rule 2510 on seniority and employee performance evaluation. Staff raised informational comments and one unclear comment about language that appeared to require a checkbox even though no form exists, and about evaluation categories that could overlap. The agency said the checkbox language should be removed, but defended the overlapping categories as part of a long-standing template used by agencies for the past 10 years. Members discussed whether the language was too ambiguous or could lead to inconsistent application, but the committee ultimately approved the rule with a condition striking the checkbox language in the affected sections.
The committee then considered personnel rule 25109 on investigations, discipline, non-disciplinary communications, and non-disciplinary removal. Staff recommended clarifying language distinguishing license suspension from termination for cause, and questioned whether the sexual-harassment discipline language was too broad because the same conduct could fit multiple discipline levels. The agency agreed to add the suggested clarification for the license-suspension provision, but argued the sexual-harassment language should remain because another rule already provides the factors for determining the appropriate discipline and the agency needs discretion for fact-specific cases. The discussion included concerns about how non-verbal conduct might be treated, but the committee moved toward conditional approval with the agreed clarification and approval of the rest of the rule as written.
