Summary:
The Administrative Regulation Review Subcommittee met to reorganize its leadership for the new term, renewing Representative Derek Lewis as House co-chair and Senator Steven West as Senate co-chair. The committee then approved the minutes and moved through a series of agency regulations, generally adopting staff-suggested amendments without objection.
Among the regulations reviewed were an Attorney General rule changing how a commission reviews and distributes funds and how grant reporting is handled; Personnel Board changes abolishing and renaming certain job classifications and adjusting probationary periods; an Education and Labor Cabinet rule removing references to local board of education members; several Public Protection Cabinet rules covering Board of Claims and Crime Victims’ Compensation procedures; an Alcoholic Beverage Control rule on direct-to-consumer shipping forms; and a Medicaid Services emergency regulation establishing the Kentucky Trauma Hospital Rate Improvement Program for rural hospitals serving many Medicaid patients. The committee also heard that the Board of Claims and Crime Victims’ Compensation regulations included both staff and, in one case, an agency amendment, which were approved.
The most extended discussion came on the Department for Community Based Services’ regulation increasing per diem rates for private child-placing therapeutic foster care levels 2 and 3. Committee members questioned the estimated $10 million biennial cost, the source of the funding, and why the cabinet had not yet filed regulations implementing Senate Bill 151 on kinship care. DCBS staff said the rate increase was discretionary and intended to address placement crises for children with high needs, while acknowledging they could not personally explain the budget decisions. A kinship caregiver testified in support of the rate increase but urged the cabinet to also implement SB 151 and expand support for kinship families. The committee expressed frustration over the lack of SB 151 implementation but stated the rate increase itself was appropriate and allowed the regulation to proceed.

Two health-related policy bills were amended in committee and advanced. House Bill 3644, the Blake Burgess Act, requires certain hospitals to adopt policies to prevent venous thromboembolism; members asked whether the required report would be public, and the author said that was the intent. House Bill 1687, the Uniform Health Care Decisions Act, replaces older advance directive and health care agent laws with a single framework for end-of-life decision-making, with committee substitute changes adding safeguards and clarifying surrogate authority. House Bill 3920 created a sales tax exemption for LifeShare Network, matching an exemption already given to the Oklahoma Blood Institute, and it also passed after supportive testimony. All measures considered were reported out favorably, and the committee adjourned after announcing it would meet again the following week.

Most of these bills passed on bipartisan votes, often after questions about implementation, fiscal impact, or scope.
Two of the more debated measures were SB 1782, which would end new tenure plans for higher education employees and move new hires to five-year contracts, and SB 2005, which would restructure the OSSAA board. SB 1782 passed 6-4 after extended debate over constitutional authority, academic freedom, recruitment, and litigation risk, with supporters arguing it would increase flexibility and accountability and opponents warning about legal and retention concerns. SB 2005 failed 4-6 after members split over whether the legislature should intervene in OSSAA governance; supporters said the association was not responsive enough to member schools and families, while opponents argued the issue should be left to the organization and that the bill risked government overreach.

The Department of Juvenile Justice then provided a broader update through Commissioner Randy White and Deputy Secretary Mona Wamik. White said DJJ is under an ongoing U.S. Department of Justice investigation focused on conditions in detention facilities, including use of force, isolation, abuse, mental health care, and special education, and said the department has cooperated with repeated information requests and site visits. He also reviewed recent legislative and administrative changes, including 2023 Senate Bill 162, regional detention planning, facility segregation requirements, staffing and salary investments, improved staffing levels, reduced mental health vacancies, and training efforts related to security threat groups. He said DJJ has made progress but continues to work on staffing, safety, and facility improvements.
