Summary: The Senate met briefly, beginning with the Pledge of Allegiance, followed by remarks from a senator from Worcester and Hampshire criticizing state immigration and court policies. He argued that Massachusetts has not done enough to prevent dangerous individuals from being released or entering the Commonwealth, cited several criminal cases involving immigrants, and urged changes to state law and court practices regarding federal immigration detainers and information-sharing. The chamber then took up an order from the senator from Middlesex and Norfolk establishing a temporary Senate Committee on Rules until a permanent committee is appointed. The order created a nine-member committee, with two minority appointments, and a subcommittee to handle matters referred to it, including issues related to Chapter 250 of the Acts of 2024. The Senate suspended the rules, adopted the order, and printed related communications from the Senate President and minority leader announcing committee appointments. Finally, the senator from Norfolk, Bristol and Plymouth offered an adjournment order setting the Senate’s next meeting for Thursday at 11:00 a.m. The order was adopted, and the Senate adjourned accordingly.

Summary: The Committee on Housing met on February 6, 2025, first in a joint session with the Committee on Labor and Technology. The joint committees heard SB 1235, which would create a Hawaii Housing Finance and Development Corporation program for government employee housing, including a revolving fund and a leasehold rent-to-own program. Testimony was generally supportive from HHFDC, the Department of Budget and Finance, and UPW, with one testifier opposing the bill because it was limited to state workers and should be broader. The committees recommended passage with amendments, including technical changes, $450,000 for two positions, removal of an income restriction, and clarification that leasehold and day-one projects are eligible; both committees adopted the recommendation unanimously, and the joint meeting adjourned. The Housing Committee then took up SB 67, SB 1133, and SB 1333. SB 67 would bar inclusionary zoning requirements on certain housing offered for sale or rent to qualifying residents, and it received support from HHFDC, the Grassroot Institute of Hawaii, and others; the committee recommended passage with technical amendments and adopted it. SB 1133 would allow counties to set rent increase limits tied to CPI and create a long-term residential lease tax credit; testimony included support from the Department of Taxation and opposition from Hawaii Realtors, NAIOP Hawaii, and the Tax Foundation, which warned about rent-control consequences. The committee recommended passage with amendments that made the credit nonrefundable, allowed limited carry-forward, restricted claims in certain family-lease situations, set filing deadlines, and applied the measure to disaster-affected counties; the recommendation was adopted. SB 1333 would allow certain counties to use surcharge revenues for transportation and housing infrastructure and extend the surcharge period. DBEDT, OPSD, HCDA, county officials, and the Grassroot Institute supported the bill, while the Tax Foundation opposed it, arguing temporary taxes were becoming permanent. The committee recommended passage with technical amendments, and members noted concerns that prior surcharge revenues had not produced enough housing projects, which were to be reflected in the committee report. Finally, the committee deferred SB 834 indefinitely because it had already been deferred indefinitely by the Hawaiian Affairs Committee, and the Housing Committee adjourned after completing its agenda.

Summary: The committee met to review Department of Corrections and Rehabilitation budget items, with Representative Steeman asking for clarification on FTE counts and dollar amounts in several line items. DOCR officials explained that the Hart River Correctional Center request was reduced from 26 new FTEs to 7, focused on pre-opening staffing such as security leadership, HR, staff development, warehouse support, and a dentist and dental assistant to address a long dental waiting list. The MRCC temporary housing unit line was adjusted from 7 FTEs to 12.5 FTEs to add case management, treatment, nursing, and maintenance staff, while pretrial, corrections temporary positions, education services, and maintenance items remained unchanged. The Grand Forks line was reduced from 31.5 FTEs to 4, with the remaining staffing tied to case management and treatment rather than full facility operations, and officials estimated that personnel cost at about $670,000. Members also discussed how the staffing changes would be viewed against the closure or transition of Dakota Women's Correctional and Rehabilitation Center in New England. DOCR said the comparison would not be apples-to-apples because Hart River will expand from a 126-bed to a 304-bed facility with more services, and because Dakota Women's staff are not state employees and therefore not counted as state FTEs. Officials noted anticipated efficiencies through shared services such as warehousing, commissary, laundry, kitchen, medical, and dental support across facilities, but acknowledged those savings would be difficult to quantify. The chair thanked the witnesses, noted the committee would return later to address amendments and the bill, and then recessed the meeting.

Summary: The Long Range Capital Planning and Utilization Committee met in organizational session and first elected Representative John Cluder as clerk. A nomination of Senator Mark Makoni as vice chair was made but not voted on because he was absent; it was carried over to the next meeting. The committee also reviewed its guidelines and procedures, including how it handles property-disposal requests, late items, and informational materials, and then approved the November 12, 2024 minutes with one abstention from a member who had been absent. The committee then considered several state property and lease requests. It approved a 50-year, $1-per-year ground lease for about 5.66 acres at Berlin Regional Airport in Milan for a New Hampshire Army National Guard hangar/support facility, after hearing that the project is federally funded, intended for training and search-and-rescue support, and would have no permanent full-time staffing. The committee also approved a 30-year lease for the Department of Justice to move the chief medical examiner’s offices, morgue, and autopsy suite to 279 Pleasant Street in Concord, with testimony that the current Concord Hospital space is inadequate and that the new site would double body-storage capacity. Several Department of Safety and Department of Transportation property items were approved as well. Safety received approval for a 10-year lease, with renewal options, for the State Police aircraft hangar at 91 Airport Road in Concord. Transportation was authorized to continue disposal efforts for remnant parcels in Concord, Conway, Lisbon, Effingham, and Mount Vernon, with testimony explaining market conditions, appraisals, access limits, and easements; members asked questions about access and buildability, but each item was approved. During the Berlin lease item, the committee was told the FAA objects to any lease longer than 50 years at that airport, so the request was revised from 55 years to 50 years on the record before approval.
