Relates to returnable beverage containers; amends certain definitions relating thereto; repeals a certain provision of law relating thereto; provides that a dealer whose place of business is less than ten thousand square feet and whose primary business is the sale of food or beverages for consumption off-premises may obtain an exemption from the obligation to accept empty beverage containers for redemption under certain conditions; provides for different handling fees for beverage containers accepter by a deposit initiator from a dealer or operator of a redemption center; provides that a deposit initiator shall have the right to conduct audits of containers presented for redemption by redemption centers or dealers subject to certain provisions; provides requirements for groups of deposit initiators and brands to form a commingling group; relates to provisions governing redemption centers.
Strengthens protections against discrimination, harassment, and bullying based on actual or perceived immigration status, and to improve implementation and oversight under the Dignity for All Students Act.
Enacts into law components of legislation relating to disaster relief for extreme weather events in Central New York, long-term climate resilience property improvements, and insurance discounts for climate mitigation efforts; establishes the central New York extreme weather relief and resiliency grant program to provide grants to certain persons and entities that suffered damage from covered events (Part A); expands and strengthens the resilient and ready program by providing grants to homeowners impacted by extreme weather events and providing grants for long-term climate resilience improvements for snow and tornado-related weather hazards (Part B); establishes the central New York property/casualty insurance resiliency incentive program to facilitate property/casualty insurance discounts for mitigation efforts (Part C).
Allows for justices to reside in any town, village or city contained in whole or in part within the same assembly district as the court such justice serves or in an assembly district contiguous to such municipality where the court is located; authorizes towns and villages to require that any person who serves as a town or village justice be admitted to practice law in the state.
Extends protections to tenants of cooperative housing entities by expanding the definition of landlord to include cooperative entities; defines cooperative entities.
Provides that in order to present the claim for unjust conviction and imprisonment, claimant must establish by documentary evidence that: they have been convicted of one or more felonies or misdemeanors against the state and subsequently sentenced to a term of imprisonment, and have served all or any part of the sentence; and they have had the one or more felonies and misdemeanors dismissed with prejudice following serving all or part of the sentence; and their claim is not time-barred.
Adds home care visits to existing provisions of law prohibiting health care employers from requiring a nurse to work more than such nurse's regularly scheduled work hours, including regularly scheduled home care visits.
Establishes a master of social work paid field practicum pilot program to provide a stipend to students who are enrolled in a master of social work program for the first 450 hours of field practicum completed towards such masters' degree; requires the office of mental health to complete a report making recommendations on how to expand the pilot program to increase the number of social workers in the state, improve representation in the field of social work, mitigate student debt and improve labor conditions for social workers upon graduation.
Creates the cooperative and condominium ombudsperson program; authorizes the residential unit tax; establishes the cooperative and condominium ombudsperson program fund.
