An Act To Amend Section 27-7-15, Mississippi Code Of 1972, To Exclude Overtime Compensation From The Definition Of "gross Income" For Purposes Of The State Income Tax Law; And For Related Purposes.

An Act To Amend Section 41-4-7, Mississippi Code Of 1972, To Authorize The Department Of Mental Health To Certify, Coordinate And Establish Minimum Standards And Establish Minimum Required Services For The Certification Of Privately-owned Mental Health Providers Who Are Not A Part Of The State-operated Mental Health Community Providers And Do Not Receive Funding From State Mental Health Funds Provided By The Department; To Provide That The Additional Certification Classification Shall Be Required To Meet Minimum Standards For Services And Safety As Those Promulgated For Regional And Community Mental Health Providers; To Authorize The Department To Permanently Waive Any Additional Requirements That Are Not Suitable For The Environment, Structure Or Services Offered By Such Privately-owned Mental Health Providers; And For Related Purposes.

An Act To Amend Section 27-65-40, Mississippi Code Of 1972, To Remove Provisions That Provide That If Any Officer Or Employee Of The State Of Mississippi, Or Any Political Subdivision Thereof, Does Not Pay The State Sales Tax For Which He Is Responsible To Pay Within Two Months After Such Sales Tax Becomes Due And Payable, He Is Not Eligible To Receive Any Salary Or Other Emoluments Of Office From The State, Or From Any Political Subdivision Thereof, Until The Sales Tax, Interest And Penalty, If Any, Is Paid In Full; To Provide That The Department Of Revenue May Pursue All Remedies Against A Public Employee Or Officer As Are Available Against Other Persons Who Fail To Pay Taxes Levied Under The Sales Tax Law; To Provide That Any Garnishment Taken Against Such Public Employee Or Officer Shall Be For An Amount Of 25% Of The Employee's Or Officer's Salary Or The Amount Of The Outstanding Tax Liability, Whichever Is Less; To Amend Section 7-7-43, Mississippi Code Of 1972, In Conformity Thereto; To Bring Forward Section 85-3-4, Mississippi Code Of 1972, Which Relates To The Attachment Or Garnishment Of Wages, Salaries Or Other Compensation, For The Purposes Of Possible Amendment; And For Related Purposes.

An Act To Amend Section 37-28-55, Mississippi Code Of 1972, To Require A Charter School To Transfer, Upon A Student's Disenrollment From The Charter School, To The Student's Home School District A Proportionate Amount Of Total Funding Formula Funds For The Remaining Months Of The School Year Which The Child Is No Longer Enrolled In The Charter School; And For Related Purposes.

An Act To Amend Section 37-11-54, Mississippi Code Of 1972, To Require The State Board Of Education To Develop The Curriculum And Implement A Program Of Conflict Resolution And Peer Mediation To Be Used By Local School Districts; To Provide That The Curriculum Developed For Use Shall Be Age And Grade Appropriate; To Require Programs Of Conflict Resolution And Peer Mediation In Failing Districts To Be Supervised By The School Resource Officer With The Assistance Of Other District Personnel To Combat Violence And Bullying; To Provide That The Program Of Conflict Resolution Shall Provide School Administrators With Alternatives To Handling Student Disciplinary Matters; To Amend Section 37-11-53, Mississippi Code Of 1972, To Require School Districts To Allow Any Public School Student Who Has Never Been Subject To Disciplinary Action Who Commits An Act Or Engages In Conduct For Which The Student Otherwise Would Be Suspended Or Expelled Under The School District's Discipline Plan, At The Election Of The Student, To Participate In A Community Service Program As An Alternative To Suspension Or Expulsion; To Provide That While Participating In The Program, The Student Shall Receive Youth Peer Counseling Deemed Appropriate By The School District; To Amend Sections 37-3-82 And 37-3-83, Mississippi Code Of 1972, In Conformity To The Preceding Provisions; To Bring Forward Section 37-7-321, Mississippi Code Of 1972, For The Purpose Of Possible Amendments; And For Related Purposes.

An Act To Create The Youth And Community Safety Act; To Require Schools To Annually Report Certain Unlawful Activity To The Mississippi Department Of Education; To Require The Department To Make Available To The Public Data Concerning Such Unlawful Activity; To Require The Department To Provide Ongoing Staff Training, Strategies And Evidenced-based Practices To Create Safe, Positive Learning Environments That Improve School District Safety For Youth, Law Enforcement, District Staff And Parents; And For Related Purposes.

An Act To Provide That If The Department Of Corrections Has Any State Inmate In A Work Assignment And In Such Assignment The Inmate Utilizes Raw Cleaning Chemicals, Then The Department Shall Provide Certain Protective Equipment To The Inmate; To Amend Sections 47-5-371, 47-5-401, 47-5-431, 47-5-441, 47-5-451, 47-5-453 And 47-5-555, Mississippi Code Of 1972, To Conform To The Preceding Section; And For Related Purposes.

An Act To Amend Section 17-25-19, Mississippi Code Of 1972, To Prohibit The Use Of Automated Recording Equipment Or Automated License Plate Recognition Systems For The Purpose Of Enforcing Compliance With Traffic Signals, Traffic Speeds Or Other Traffic Laws, Rules Or Regulations, Including Motor Vehicle Liability Responsibility, On The Public Roadway Within This State; To Provide That Enforcement Of Traffic Laws Of The State Shall Only Be Effectuated By Sworn Law Enforcement Officers Acting Within The Scope Of His Or Her Employment With A Local Law Enforcement Agency; To Require Local Jurisdictions Using Automated Recording Equipment Or Automated License Plate Recognition Systems To Remove The Equipment Or System Before July 1, 2025; To Provide For An Exception To The Use Of Automated License Plate Recognition Systems By Local Law Enforcement Agencies, And The Conditions And Purpose For Which They May Be Used; To Permit County And Municipal Governing Authorities To Adopt, Enact Or Enforce Any Ordinance Authorizing The Use Of Mobile Automated License Plate Recognition Systems Mounted On A Law Enforcement Vehicle And Which Are Wholly Owned And Operated By The Law Enforcement Agency For Official Law Enforcement Purposes; To Provide That A Positive Match By An Automated License Plate Recognition System Alone Does Not Constitute Reasonable Suspicion, Which Amounts To Probable Cause, As Grounds For A Law Enforcement Officer To Stop A Vehicle; To Require Law Enforcement Agencies To Update The System Every 24 Hours If An Update Is Available Or As Soon As Practicable After An Update Becomes Available; To Define Certain Terms For Purposes Of Clarifying Any Ambiguities In Interpretation; And For Related Purposes.

An Act To Amend Section 37-103-7, Mississippi Code Of 1972, To Provide The Residency Requirement For In-state Tuition Rates For The Purpose Of Attending A State-supported Institution Of Higher Learning Or Community Or Junior College Shall Be A Minimum Period Of Twelve Months; To Amend Section 37-103-25, Mississippi Code Of 1972, To Provide That Any Student Who Has Resided In The State Of Mississippi For A Continuous Period Of Twelve Months, Or Who Has Received A High School Diploma From A Public Or Private Secondary School In The State Upon Evidencing That He Or She Completed The Final Scholastic Year Enrolled Therein In The Year Immediately Preceding His Or Her Enrollment In A State Institution Of Higher Learning Or Community Or Junior College Shall Be Considered A Resident For Purposes Of In-state Tuition; And For Related Purposes.

An Act To Direct The Governor And The Division Of Medicaid To Enter Into Negotiations With The Federal Government To Obtain A Waiver Of Applicable Provisions Of The Medicaid Laws And Regulations To Create A Plan To Allow The Expansion Of Medicaid Coverage In Mississippi; To Specify The Provisions That The Governor And The Division Shall Seek To Have Included In The Waiver Plan; To Provide That If A Waiver Is Obtained To Allow The Expansion Of Medicaid Coverage, The Division Shall Amend The State Plan To Include The Provisions Authorized In The Waiver And Shall Begin Implementing The Plan Authorized By The Waiver; To Amend Section 43-13-115, Mississippi Code Of 1972, To Conform To The Preceding Provisions; And For Related Purposes.

An Act To Amend Section 41-7-191, Mississippi Code Of 1972, To Direct The State Department Of Health To Issue A Certificate Of Need To A Nonprofit Corporation Located In Madison County For The Construction, Expansion Or Conversion Of Beds In A Community Living Program For Developmentally Disabled Adults In An Icf-iid Facility; And For Related Purposes.

An Act To Create A New Penalty For Any Person Who Kills Another Person While Driving Under The Influence; To Require A Person Convicted Of Driving Under The Influence To Pay Child Support To The Child Of Any Person Killed As A Result Of The Violation; To Bring Forward Section 63-11-30, Mississippi Code Of 1972, Which Provides The Penalties For Driving Under The Influence, For Purposes Of Amendment; And For Related Purposes.

An Act To Amend Section 73-15-9, Mississippi Code Of 1972, To Revise The Membership Of The Mississippi Board Of Nursing To Remove The Licensed Physician Member And Add A Certified Registered Nurse Anesthetist Member; To Provide That The Members Of The Board Who Are Registered Nurses Other Than The Nurse Practitioner Member And The Certified Registered Nurse Anesthetist Member Shall Not Be Advanced Practice Registered Nurses; To Delete The Requirement That Members Of The Board Shall Be Appointed From Lists Of Nominees Submitted By Mississippi Registered Nurse And Practical Nurse Organizations Or Associations; To Amend Sections 73-15-11 And 73-15-15, Mississippi Code Of 1972, To Conform To The Preceding Provisions; And For Related Purposes.
