An Act To Amend Section 27-7-1001, Mississippi Code Of 1972, To Define Certain Terms Related To Catastrophe Savings Accounts, Including Disaster Mitigation Expenses And Disaster Recovery Expenses; To Amend Section 27-7-1003, Mississippi Code Of 1972, To Clarify That The Limits On The Total Amount That May Be Contributed To A Catastrophe Savings Account Is An Annual Limit; To Amend Section 27-7-1005, Mississippi Code Of 1972, To Clarify That Catastrophe Savings Accounts May Be Used For Qualified Disaster Mitigation Expenses; To Amend Section 83-1-191, Mississippi Code Of 1972, To Provide That The Mississippi Comprehensive Hurricane And Wind Damage Mitigation Program Trust Fund Shall Fund The Comprehensive Hurricane And Wind Damage Mitigation Program; To Add "wind" To The Mississippi Comprehensive Hurricane Damage Mitigation Program; To Delete The Repealer; To Create A Special Fund In The State Treasury To Be Designated As The "mississippi Comprehensive Hurricane And Wind Damage Mitigation Program Trust Fund; To Amend Section 83-2-33, Mississippi Code Of 1972, To Provide Funds For The Mississippi Comprehensive Hurricane And Wind Damage Mitigation Program; To Transfer Five Million Dollars From The Surplus Lines Association To The Mississippi Comprehensive Hurricane And Wind Damage Mitigation Program Trust Fund; And For Related Purposes.

An Act To Amend Section 75-8-110, Mississippi Code Of 1972, To Revise The Choice Of Law Governing Investment Securities To Provide That The Local Law Of The Entitlement Holder's Jurisdiction Governs; To Amend Section 75-8-511, Mississippi Code Of 1972, To Revise The Priority Among Security Interests And Entitlement Holders To Provide That If A Securities Intermediary Does Not Have Sufficient Interests In A Particular Financial Asset To Satisfy Both Its Obligations To Entitlement Holders Who Have Security Entitlements To That Financial Asset And Its Obligation To A Creditor Of The Securities Intermediary Who Has A Security Interest In That Financial Asset, The Claims Of Entitlement Holders, Other Than The Creditor, Have Priority Over The Claim Of The Creditor; To Amend Sections 75-9-305 And 75-8-503, Mississippi Code Of 1972, To Conform; And For Related Purposes.

An Act To Amend Section 25-15-301, Mississippi Code Of 1972, To Make Certain Revisions Related To The State And School Employees Health Insurance Management Board; To Provide That When A Proposal Is Under The Board's Evaluation For Pharmacy Benefits Or The Management Thereof, The Executive Director Of The Mississippi Board Of Pharmacy Shall Be One Of The Members Of The Evaluation Committee Of The Board; To Amend Section 25-15-303, Mississippi Code Of 1972, To Include The Executive Director Of The Board Of Pharmacy As A Member Of The Management Board; To Create New Section 25-15-305, Mississippi Code Of 1972, To Set Certain Definitions Related To The Act, Including The Definitions Of Clean Claims, Pharmacy Benefit Plan, Pharmacy Benefit Management Plan ("pbm") And Rebate; To Provide That The Act Shall Only Apply To The Pbm And Its Affiliate That Administer The State Health Plan; To Create New Section 25-15-307, Mississippi Code Of 1972, To Provide That A Pbm Shall Not Reimburse A Pharmacy Or Pharmacist For A Prescription Drug Or Pharmacist Service In A Net Amount Less Than The National Average Drug Acquisition Cost For The Prescription Drug Or Pharmacist Service In Effect At The Time That The Drug Or Service Is Administered Or Dispensed, Plus A Professional Dispensing Fee At Least Equal To The Professional Dispensing Fee Paid By The Mississippi Division Of Medicaid For Outpatient Drugs; To Prohibit Pbms From Charging A Plan Sponsor More For A Prescription Drug Than The Net Amount It Pays A Pharmacy For The Prescription Drug; To Require Pbms To Pay Clean Claims Within A Certain Time Constraint; To Provide Certain Exceptions From This Time Constraint; To Provide That If The Board Finds That Any Pbm, Agent Or Other Party Responsible For Reimbursement For Prescription Drugs And Other Products Has Not Paid Ninety-five Percent Of Clean Claims Received From All Pharmacies In A Calendar Quarter, He Shall Be Subject To Administrative Penalty Of Not More Than $25,000.00 To Be Assessed By The Board; To Authorize The Board To Adopt Rules And Regulations Necessary To Ensure Compliance With This Act; To Authorize A Network Pharmacy Or Pharmacist To Decline To Provide A Brand Name Drug, Multisource Generic Drug, Or Service, If The Network Pharmacy Or Pharmacist Is Paid Less Than That Network Pharmacy's Cost For The Prescription; To Create New Section 25-15-309, Mississippi Code Of 1972, To Set Certain Requirements Related To Pbm, Including That The Pbm Must Provide A Reasonable Administrative Appeal Procedure; To Authorize The Board To Audit Pbms; To Require A Pbm To Reimburse A Pharmacy Or Pharmacist An Amount Less Than The Amount That The Pbm Reimburses A Pbm Affiliate For Providing The Same Pharmacist Services; To Create New Section 25-15-311, Mississippi Code Of 1972, To Require Pbms To Obtain A License From The Board Of Pharmacy; To Create New Section 25-15-313, Mississippi Code Of 1972, To Require Pbms To Pass On To The Plan 100% Of All Rebates And Other Payments That It Receives Directly Or Indirectly From Pharmaceutical Manufacturers In Connection With Claims Or Plan Administration On Behalf Of The Plan; To Prohibit A Pbm Or Third-party Payer From Charging Or Causing A Patient To Pay A Copayment That Exceeds The Total Reimbursement Paid By The Pbm To The Pharmacy; To Create New Section 25-15-315, Mississippi Code Of 1972, To Prohibit A Pharmacy, Pbm, Or Pbm Affiliate From Taking Certain Actions, Including Making Referrals Or Interfering With A Patient's Right To Choose Their Pharmacy; To Create New Section 25-15-317, Mississippi Code Of 1972, To Prohibit Pbms From Retaliating Against A Pharmacist Or Pharmacy Based On The Pharmacist's Or Pharmacy's Exercise Of Any Right Or Remedy Under This Act; To Create New Section 25-15-319, Mississippi Code Of 1972, To Authorize The Board To Bring An Action Against A Pbm Or Pbm Affiliate To Restrain By Temporary Or Permanent Injunction The Use Of Any Method That Is Prohibited By This Act; To Authorize The Board To Impose A Monetary Penalty On Any Pbm Found To Be In Noncompliance; To Create New Section 25-15-319, Mississippi Code Of 1972, To Provide That On The Request By Any Agency Of The State Of Mississippi, Or Any Political Subdivision Of The State Or Any Other Public Entity, A Pbm Shall Deliver Or Otherwise Make Available To The Requesting Agency Or Entity, In Its Entirety And With No Redaction, Any Third-party Aggregator Contracts Or Contracts Relating To Pbm Services; To Provide That Any Entity That Does Not Comply With This Section Shall Be Barred For Five Years From Doing Business In The State; And For Related Purposes.

An Act To Amend Section 13-3-57, Mississippi Code Of 1972, To Provide That Any Nonresident Person, Firm, General Or Limited Partnership, Or Any Foreign Or Other Corporation Not Qualified Under The Constitution And Laws Of This State As To Doing Business Herein, Who Shall Be Registered With The Secretary Of State To Do Business In This State, Shall By Such Act Or Acts Be Deemed To Be Doing Business In Mississippi Shall Thereby Be Subjected To The Jurisdiction Of The Courts Of This State; And For Related Purposes.

An Act To Amend Section 25-11-411, Mississippi Code Of 1972, To Revise The Employer Contribution Rates For Participants In The Optional Retirement Program; To Amend Section 25-11-407, Mississippi Code Of 1972, To Delete The Minimum Number Of Companies That The Public Employees' Retirement System Must Designate To Provide Investment Products For The Optional Retirement Program; And For Related Purposes.

An Act To Establish A Community Health Worker Certification Program In The State Department Of Health; To Provide That The Division Of Medicaid Shall Seek Approval From The Centers For Medicare And Medicaid Services For A State Plan Amendment, Waiver, Or Alternative Payment Model To Provide Reimbursement For Certain Services Provided By Certified Community Health Workers; To Provide That The Department Shall Be The Sole Certifying Body For The Community Health Worker Profession And Practice In Mississippi; From And After January 1, 2025, No Person Shall Represent Himself Or Herself As A Community Health Worker Unless He Or She Is Certified As Such In Accordance With The Requirements Of The Department; To Provide That The Department Shall Promulgate Rules Necessary To Carry Out The Provisions Of This Act, Including Establishing The Core Competencies Of Community Health Workers, The Community Health Worker Certification Application And Renewal Process, Certification Application And Renewal Fees, Procedures For Certification Denial, Suspension And Revocation, And The Scope Of Practice For Certified Community Health Workers; To Provide That The Department Shall Approve Competency-based Training Programs And Training Providers, And Approve Organizations To Provide Continuing Education For Certified Community Health Workers; To Amend Section 43-13-117, Mississippi Code Of 1972, To Provide Medicaid Reimbursement For Certain Services Provided By Certified Community Health Workers; To Extend The Date Of The Repealer On The Section; And For Related Purposes.

An Act To Provide That A Corporation Or Other Legal Entity May Register Motor Vehicles In A Rental Fleet On An Annual Basis So That The Registration Of All Motor Vehicles In The Fleet Expires In The Anniversary Month Established By The Commissioner Of Revenue; To Provide For The Issuance Of Special License Tags And Registration Cards For Rental Fleet Motor Vehicles Upon Application Of The Corporation Or Other Legal Entity Operating A Fleet; To Provide A Fee To Be Paid To The Department Of Revenue Upon The Filing Of An Application; To Provide That A Rental Fleet Registration Card Must Be Carried In All Motor Vehicles In A Rental Fleet; To Provide For The Registration Of Motor Vehicles Added To A Rental Fleet During A Registration Year; To Provide For The Removal Of A Motor Vehicle From A Rental Fleet; To Provide That If A Motor Vehicle Registered In A Fleet Is Removed From The Fleet, The Rental Fleet License Tag Removed From The Motor Vehicle May Be Transferred To And Used On Another Motor Vehicle That Is Added To The Fleet To Replace The Removed Motor Vehicle Under Certain Conditions; To Amend Sections 27-19-3, 27-19-31, 27-19-43 And 27-19-63, Mississippi Code Of 1972, To Define The Term "rental Fleet" Under The Motor Vehicle Privilege Tax Laws; To Provide That Rental Fleet Motor Vehicles Shall Not Be Issued Tag Decals Noting The Month And Year Of Expiration; To Authorize The Department Of Revenue To Prorate The Registration Year Of Motor Vehicles In Rental Fleets So That The Registration Of Such Motor Vehicles Will Coincide With The Anniversary Month For Rental Fleets; To Provide That The Owner Of Motor Vehicles In A Rental Fleet May Make Application For License Tags For Such Motor Vehicles With The Department Of Revenue Or The Local Tax Collector; To Provide That The Anniversary Month For The Privilege License Tax For Motor Vehicles That Are In A Rental Fleet Shall Be Established By The Commissioner Of Revenue; To Bring Forward Sections 27-19-5, 27-19-11, 27-19-15 And 27-19-17, Mississippi Code Of 1972, Which Are Sections Of The Motor Vehicle Privilege Tax Laws, For The Purposes Of Possible Amendment; And For Related Purposes.
