AN ACT Relating to medical insurance premium reimbursements for surviving spouses of line of duty deaths;

Summary

HB 2441 amends Washington law governing survivor benefits for certain public employees killed in the line of duty. The bill expands medical insurance premium reimbursement for surviving spouses, domestic partners, and dependent children of covered members, including reimbursement for premiums paid for Washington Health Care Authority coverage, Medicare Part A and Part B, COBRA continuation coverage, and, in some cases, other medical insurance premiums. It also clarifies that eligible survivors must enroll in Medicare Parts A and B to remain eligible for the Medicare-related reimbursement. The bill also updates the treatment of retirement allowances and death benefits for members who die in the course of employment, including members killed while performing certain public service or emergency response duties. It provides rules for payment of accumulated contributions, survivor benefit elections, and continuation of benefits for children in specified circumstances. The act applies retroactively only to premium payments made after June 30, while otherwise operating prospectively.

Impact

The bill changes multiple provisions in Washington’s retirement and survivor-benefit statutes, primarily affecting line-of-duty death benefits administered through the state retirement system and related medical premium reimbursement rules. It creates a new section and amends existing RCW provisions to authorize broader reimbursement of health insurance premiums for surviving spouses, domestic partners, and dependent children, while also imposing Medicare enrollment conditions for those eligible for Medicare. The practical effect is to increase and clarify benefit eligibility for a limited class of survivors of public employees and emergency responders killed in the line of duty, and to require the retirement system and related agencies to administer the expanded reimbursements.

Sentiment

The bill appears to have been strongly supported and noncontroversial. It passed the House Appropriations Committee, the House floor, the Senate Ways & Means Committee, and the Senate floor unanimously, with no recorded dissenting votes in any stage. The voting history suggests broad bipartisan agreement that the measure was a targeted benefit enhancement for surviving family members of fallen public servants.

Contention

No significant contention is evident in the available record. There are no committee transcript excerpts indicating debate, and every recorded vote was unanimous. Any potential policy issues would likely have centered on the scope and cost of expanded premium reimbursements, the Medicare enrollment requirement, and the retroactive application to premiums paid after June 30, but none of these appear to have generated opposition in the legislative process shown here.
