Dental plans. Prohibits a dental plan (an insurance policy, a health maintenance organization contract, or a preferred provider plan) from directly or indirectly requiring a dental provider to provide a dental service to a covered individual at a fee amount that is: (1) set by the dental plan; or (2) subject to the approval of the dental plan; unless the dental service is a covered service under the dental plan. Prohibits a third party administrator or another person from arranging for a dental provider to provide dental services for a dental plan that sets the amount of the fee for any dental services unless the dental services are covered services under the dental plan. Authorizes the insurance commissioner to issue a cease and desist order against a person that violates any of these prohibitions and, if the person violates the cease and desist order, to impose a civil penalty upon the person and suspend or revoke the person's certificate of authority.

Preferences in public works and public purchasing. Provides that a manufacturing business, defined as a business that processes raw materials or parts into finished goods, is not a small business if it employs more than 100 persons or if its annual sales for its most recently completed fiscal year exceed $4,000,000. Provides that any state agency that purchases goods, supplies, or services for the state must report by October 1 of each year to the budget committee the amount of Indiana business and Indiana small business preferences granted in the agency's procurement of goods, supplies, or services for the state.

State police pension trustee. Urges the legislative council to assign to the interim study committee on pension management oversight the task of studying whether the trustee of the state police pension trust and the police benefit fund should be the board of trustees of the Indiana public retirement system. Specifies that the corpus and income of the pension trust shall be distributed to participants and their beneficiaries in accordance with certain provisions.

Statewide assessment results. Provides that, after a school receives statewide assessment score reports, a teacher of a student shall discuss the student's statewide assessment results with a parent at the next parent/teacher conference or, if the school does not hold parent/teacher conferences, send a notice to a parent of the student offering to meet with the parent to discuss the results. (Current law requires that, after a school receives statewide assessment score reports, the school shall offer a parent/teacher conference to discuss a student's statewide assessment results with a parent who requests the parent/teacher conference or the parent of each student who does not receive a passing score on the test.) Requires the department of education to include in a contract entered into or renewed after June 30, 2022, with a statewide assessment vendor a requirement that the vendor provide a summary of a student's statewide assessment results that meets certain requirements.

Sentence modification. Establishes a procedure to allow certain inmates in the department of correction (department) an additional opportunity to request sentence modification from the sentencing court if the department has recommended sentence modification. Requires that an inmate who receives sentence modification be placed under supervision of: (1) a community transition program; (2) a court; (3) community corrections program; or (4) a supervised reentry program.

Montessori program day care licensure exemption. Provides that an educational program that is validated as a Montessori program by the United Montessori Schools of Indiana is exempt from licensure as a day care center.

Professional licensing agency. Reduces the membership of the following boards to five members: (1) The state board of dentistry. (2) The state board of registration for professional engineers. (3) The Indiana board of veterinary medical examiners. Reduces the membership of the state board of cosmetology and barber examiners to six members. Eliminates certain requirements for an applicant seeking licensure as a clinical social worker, marriage and family therapist, mental health counselor, addiction counselor, or clinical addiction counselor. Makes conforming amendments and a technical correction.

Associational standing for judicial review. Provides that an association or representative organization that meets certain requirements has standing to: (1) bring a declaratory judgment action as to an ordinance adopted under the planning and development law; and (2) obtain judicial review of a zoning decision.

FAFSA. Requires each school corporation and charter high school to: (1) use the model FAFSA notice prepared by the commission for higher education (commission); and (2) provide the model notice to certain students. Allows a nonpublic school to provide the model notice to certain students. Requires the commission to develop an online FAFSA affirmation form and provide information to certain schools to determine which students have completed the FAFSA and the affirmation form. Amends the information required to be included in the model FAFSA notice.

Mental health professionals. Allows a political subdivision, in consultation with the technical assistance center, to contract with mental health providers for the purpose of supplementing existing crisis intervention teams with mental health professionals. Specifies certain eligibility requirements for mental health professionals seeking an appointment to a crisis intervention team. Requires a mental health professional who is appointed to a crisis intervention team to accompany responding law enforcement or police officers to a call involving a mental health or substance abuse disorder crisis. Provides that a law enforcement or police officer (officer) may not be held liable for damages, including punitive damages, for any act or omission related to a mental health professional's contribution to a crisis intervention team or a crisis intervention team response. Specifies that no other person or entity may be held liable for certain damages by reason of an agency relationship with an officer. Defines certain terms.

Study of low-carbon and green industries. Requires the Indiana University Paul H. O'Neill School of Public and Environmental Affairs to: (1) assess the potential for the development of low-carbon and green industries in Indiana and the job creation, economic growth, and wealth generation that could result for Indiana communities from the development of these industries; and (2) report the results of its assessment to the legislative council in an electronic format not later than December 1, 2022.

School employee misconduct. Provides that a policy adopted by a school corporation, charter school, or nonpublic school with at least one employee addressing expanded criminal history checks or expanded child protection index checks (background checks) must prohibit the hiring of, continuing the employment of, contracting with, or continuing to contract with a person who has been convicted of an offense requiring license revocation, unless the conviction has been reversed, vacated, or set aside on appeal. (Current law provides that such a policy addressing background checks must prohibit the hiring of a person who has been convicted of an offense requiring license revocation, unless the conviction has been reversed, vacated, or set aside on appeal.) Provides that: (1) a school corporation; (2) a charter school; or (3) an entity: (A) with which a school corporation contracts for services; and (B) that has employees who are likely to have direct, ongoing contact with children within the scope of the employees' employment; shall consider whether information obtained from the background checks concerning an individual's conviction for certain offenses constitutes grounds to not employ, not contract with, or to terminate the employment of or contract with the individual. Provides that, in the event that an entity obtains information that an individual employed by the entity who works at a particular school corporation or charter school has been convicted of certain offenses, the entity shall immediately notify the school corporation or charter school of the employee's conviction. Makes changes to the list of offenses for which the department of education shall permanently revoke a teacher's license. Makes conforming changes.

Firearms matters. Makes the current offense of carrying a handgun without a license applicable only to persons who are at least 18 years of age but less than 21 years of age. Allows certain persons who are at least 21 years of age to possess or carry a handgun without a license unless the person fits into one of several categories, including a person who: (1) has been convicted of, or arrested for, specified crimes or delinquent offenses; (2) has been prohibited by a court from possessing a handgun or has been found by a court to be dangerous; or (3) has been found by a court to be mentally incompetent, has been involuntarily committed, or has been the subject of a 90 day or regular commitment. Allows certain persons who: (1) do not meet the requirements to receive a license to carry a handgun; and (2) are not otherwise barred from carrying or possessing a handgun by state law; to carry a handgun in specified instances. Makes it a Class A misdemeanor for particular persons to possess or carry a handgun. Increases the penalty to a Level 5 felony in some instances. Defines certain terms. Makes conforming amendments and repeals obsolete provisions. Makes a technical correction.
