As introduced, Bill 26-103 would require that before entering into an exclusive agreement with respect to the use of District owned recreational property for a term of 3 or more years, the Mayor shall satisfy certain public engagement requirements. It requires the exclusive agreement to include a provision for an annual audit to ensure compliance with the terms of the exclusive agreement. It also requires a proposed resolution to the Council for review and approval, which shall include a description of the District’s current use of the District-owned recreational property, the fair market value of the requested use, and the anticipated amount that would be charged for exclusive usage.

As introduced, Bill 26-104 would establish a “cumulative impact statement” process that must be completed to obtain District permits and other relief for environmentally harmful actions in overburdened communities. It would also establish a “modified cumulative impact statement” to assess District agency plans that impact the siting of significant sources of environmental harm in overburdened communities and it would create accountability to ensure that these processes are enforceable and result in meaningful progress for overburdened communities. It also establishes an environmental justice division at DOEE.
